同性婚姻与我国区际私法中的公共秩序保留

目前国际社会中同性同居者争取合法地位的运动已经在一些国家或地区取得成功.各国面临是否承认外国或外法域同性同居关系的局面.随着我国对外开放的深入,我国法院将来也会面临这些问题.如果一概拒绝承认基于外法域法律成立的同性同居关系,可能不利于保护依附该关系而成立的其他民事法律关系,因此,应当区分不同情况.区际私法中尤其需要慎用公共秩序保留制度,当同性同居关系仅仅是作为其他问题的先决问题时,我国大陆法院可考虑适当承认该关系的有效性.     

Competitive Liberalization,Competitive Imperialism,and Intellectual Property

Aggressive pursuit of free trade agreements (FTAs) and customs unions (CUs) by major and minor trading powers alike challenges the conventional wisdom in favor of such pursuit – competitive liberalization. An equally plausible explanation for an active bilateral and regional trade agreement policy, one which effectively de-emphasizes multilateralism, may be competitive imperialism. The protection and enforcement of intellectual property rights is one area in which new provisions, going beyond multilateral rules, are being negotiated and written into FTAs and CUs. Such provisions may yield insights into which characterization of bilateralism and regionalism – competitive liberalization or competitive imperialism – is more apt. 褪黑素对内毒素血症山羊肝线粒体自由基代谢的影响

为探讨褪黑素对内毒素血症山羊肝线粒体自由基代谢的影响,将48只山羊随机分为4组,生理盐水组(NS组)、内毒素组(LPS组,1 mg/kg)、褪黑素组(MT组,1 mg/kg)和褪黑素保护组(MT LPS组),每组分别在处理后第3和6 h各宰杀6只羊,取肝组织,提取肝线粒体,检测肝线粒体中超氧化物歧化酶(T-SOD)、总抗氧化能力(T-AOC)、过氧化氢酶(CAT)、谷胱甘肽过氧化物酶(GSH-Px)和谷胱甘肽还原酶(GR)活性及丙二醛(MDA)含量的变化。结果显示,内毒素血症时山羊肝线粒体中抗氧化酶的SOD、GSH-Px、GR和CAT活性降低,T-AOC活力下降,MDA含量明显增加,而褪黑素保护组肝线粒体抗氧化酶活性普遍回升,MDA含量明显下降。提示,褪黑素能减轻内毒素血症山羊因脂质过氧化造成的肝线粒体损伤,保护肝线粒体功能。

浅议入世后我国中小企业经济发展政策

加入WTO后 ,我国中小企业既面临着发展的机遇 ,也面临着严峻的挑战。中小企业的经济管理及其成长发展的优劣 ,对正在向市场经济体制转轨并已成为世贸组织成员的中国来讲 ,具有十分特殊的意义。我国应把促进中小企业经济发展作为 2 1世纪的一个重大战略决策来对待 ,并实施与之相适应的有关政策     

论我国结构性失业问题的成因及政策分析

结构性失业将成为我国入世后的主要失业形式。本文在对引起结构性失业问题的成因及相关数据进行分析的基础上,着重从减少劳动力供给、增加劳动力需求、协调地区之间经济发展、调整产业结构、大力发展第三产业、实现经济快速健康稳定增长、农村剩余劳动力的转移几个方面对我国当前解决结构性失业问题的政策进行探讨,力图寻找解决我国结构性失业问题的制度和对策。

Self-settled Refugees in Uganda: An Alternative Approach to Displacement?

This paper investigates the complex security and economic dynamicsthat influence the lives and opportunities of self-settled refugeesliving in Uganda. It focuses on the opportunities and problemsfaced by self-settled refugees, and questions the assumptionthat Uganda's current local settlement policy is best suitedto the country's social, economic and political realities. Itsuggests that far from being passive victims, self-settled refugeesare taking control of their lives without any additional externalassistance and are planning for the day they can return to theirhomeland. Consequently, the paper argues that there is reasonto believe that local integration is likely to succeed whereother models have failed.     

The Influence of Advisers and Decision Strategies on Foreign Policy Choices: President Clinton's Decision to Use Force in Kosovo

In the following paper, I analyze the influence of advisers and domestic political factors on President Clinton's decision to use force against Slobodan Milosevic and the Serbs in Kosovo in March 1999. I present an analysis and examination of President Clinton's decision-making process, using press reports, personal speeches, etc. In other words, I attempt to trace the process by which Clinton came to the decision to use force in Yugoslavia. Specifically, using the poliheuristic theory, I argue that President Clinton's decision was influenced by noncompensatory domestic political calculations and the strong influence of his Secretary of State, Madeleine K. Albright. Examining how advisers interact with one another, their status in the advisory group, and the manner in which presidents solicit information from advisers will further our understanding of how, when, and under what conditions national security-level decision makers make decisions.
