Fiji Economy: Muddling Through

Abstract

Twenty-five years since the first military coup in 1987, Fiji continues to muddle through both politically and economically. The promise of a general election under a race-free constitution remains the fervent hope of all citizens. Economically the country continues to slide downwards, reflected in poor economic growth in 2010 and 2011. A poor level of private sector investment remains a feature of the macroeconomic picture, and it is unlikely to change for the foreseeable future. This article provides an overview of the Fiji economy and reflections on future prospects.     

完善赌博罪立法的若干建议

我国《刑法》第三百零三条虽然对赌博罪作了专门规定,但是该规定明显原则化,不能适应打击新形势下赌博犯罪的需要。所以,需要从犯罪主体、罪状结构和刑罚设置等方面进一步完善赌博罪立法。     

关于建立查禁跨境赌博违法犯罪长效机制的建议

境外赌博违法犯罪危害极大,根据国务院的布署,在公安部的支持和省政府的领导下,2004年12月以来开展了查禁边境地区赌博犯罪活动专项斗争并取得明显成效。为了防止“死灰复燃”,建立长效机制,切实提高防范、发现、打击赌博违法犯罪活动的能力,一是建立健全禁赌预警机制和快速反应机制;二是加大宣传教育力度,营造良好舆论氛围;三是采取多种措施,防止和减少中国公民出境参赌;四是充分发挥各有关部门的职能作用,齐抓共管,形成联合禁赌格局;五是建立倒查责任追究制度。

打击境外赌博的困境与对策

二十世纪末以来,境外赌博的声势不断加强,严重地危害了社会治安,腐蚀了国家干部队伍,危害了国家金融安全,引起了中央政府的高度重视。在打击境外赌博的过程中,困难重重。加强对境外赌博的打击和查处,是公安机关的一项长期而艰巨的任务。

Greyhound racing emerged in Britain in 1926 and, during its first quarter of a century, was subject to institutional middle-class opposition because of the legal gambling opportunities it offered to the working class. Much maligned as a dissipate and impoverishing activity, it was, in fact, a significant leisure opportunity for the working class, which cost little for the minority of bettors involved in what was clearly no more than a ‘bit of a flutter’.     

The impact of revenue diversification on municipal debts: comparing short-term and long-term debt levels

The extant literature has offered two competitive implications of revenue diversification: revenue stabilisation and fiscal illusion. Stabilisation helps governments have less revenue volatility, while fiscal illusion expands tax burdens through the increase in expenditure. The competitive views on revenue diversification leave a niche to explore the association between revenue diversification and debt levels in local governments. We estimate the static and dynamic effects of revenue diversification on both short-term and long-term debt levels in 150 fiscally standardised cities. Our findings show that local governments with greater revenue diversification are more likely to reduce short-term debts while expanding long-term debts. The findings imply that a stabilised revenue structure helps local governments better manage operational budgets but also invest in capital projects with greater debt capacity.     

论我国保险公司破产原因立法之妥适性——兼论我国《保险法》第90条、第149条之规定

保险公司破产具有特殊性,因此,从世界各国立法来看,保险公司的破产原因经历了从现金流标准和资产负债表标准向监管性标准的转变,是一个从“时间上的后置性”逐渐向“时间上的前置性”的演进过程。而目前我国保险公司的破产原因与一般企业相同,仍采用的是现金流标准和资产负债表标准,没有体现保险公司破产原因“时间上的前置性”。因此,有必要在参照国外监管性标准的基础上,重构我国保险公司的破产原因。而采用监管性标准为监管机构和法院提供了一个明确的、可以量化的标准,为未来我国保险公司破产原因之立法完善方向。
