刑法教义学既包括教义学方法,也包括教义学知识;教义学方法是无国界的,但教义学知识是对一国现行有效的法律所作的解释,因而是有国界的。德日刑法关于共同犯罪的规定表明,共犯的定罪与量刑均取决于正犯,因而决定了其共犯理论必须采取实质客观说以区分正犯与共犯;而中国刑法关于共同犯罪的规定表明,共同犯罪的定罪与量刑是截然可分的不同层次,因而在正犯与共犯的区分上采取形式客观说就足以解决问题。中国刑法和德日刑法对侵占罪规定的成立要件并不相同,"拒不退还"、"拒不交出"在中国的侵占罪中是一种客观处罚条件,是独立的行为要件,因而不能将其融入"非法占为已有"的含义之中。中国的刑法教义学研究必须清醒地认识到,要以中国刑法的规定为研究的逻辑起点并受其严格约束;要真正构建中国的刑法教义学,必须唤起研究者的主体意识。  相似文献

Four fluorescent fingerprint powders (RedWop?, GreenWop?, Basic Yellow?, and Yellow Powder?) were evaluated as a marker for blow fly larvae. Administration methods included ingestion (high vs. low concentration) or topical. Ingestion of high concentrations of Basic Yellow? and RedWop? caused higher larval mortality. Basic Yellow? delayed development and adult emergence while RedWop? and Yellow Powder? had a significant effect on particular stages of development, however, emergence time was not altered. Optimal administration is through ingestion at low concentration levels (<10%) or topically, with GreenWop? demonstrating minimal adverse effects. Optimum wavelength for discrimination between powders was 450 nm. This research can aid in investigative training to increase visibility of larval and pupal blow flies. It can also be used in entomological studies to differentiate between larval blow flies (or other dipteran) species or individuals to further understand complex interactions and behavior during larval development.  相似文献

The Engage programme was launched in April 2006 by the Government Communication Network (GCN) in the UK. As a civil service body supporting those in government working as press officers and in marketing roles, the GCN under the New Labour government in the period 2006–2010 was involved with the extension of the logic of marketisation to government communication. This article charts this process by examining key government policy documents from this period. The rationale for Engage rested on the assumption that government in the UK needed to adapt its communication approach to reach what were perceived as individualised consumers in society. The extension of the logic of marketisation to government communication that happened under Engage is shown to be consistent with the New Public Management approach to public services under New Labour. 鉴于元朝灭亡的教训,朱元璋力图从制度上预防与惩治贪污腐败。他制定低俸禄与低办公经费制度强迫官员保持节俭的作风,以严酷的法律惩治贪污腐败,并建立了一个完善的监察系统搜集官员腐败的证据。朱元璋的制度建设虽然对遏制贪污腐败起到了一定震慑作用,但即使是在朱元璋时代,贪污行为也屡发不绝。朱元璋过世后,低俸禄与低办公经费成为官员贪腐的正当理由,严酷的反贪法律的执行因为完全取决于皇帝的态度实际上也逐渐废止了,监察制度也变成了党争的工具。尽管如此,朱元璋的制度反腐仍然为今天的廉政建设提供了可资借鉴的经验与教训:反腐教育应当常抓不懈,反腐应摆脱依赖个人意志的法律,注意保持官员的适当工资水平。  相似文献

Little is known about how different sources of information drive citizen trust in government. To address that gap this article compares disaster evacuees to observers, noting how trust differs as attention to media coverage increases. First‐hand experience supplies information to update trust through biological and personal processes and performance assessments, while secondary sources provide information about other people's experiences, filtered through lenses that take an active role in crafting information. These two types of information have varying effects depending on the level of government being trusted. Using surveys administered a year after Hurricane Katrina, I find that Katrina evacuees have the highest trust in federal government, until they start paying attention to media coverage, and that attention to coverage has the most dramatic effect on these evacuees compared to all other groups. I also find that increasing attention to second‐hand information corresponds with higher trust in local officials, and that this effect decreases as the level of government increases. It appears media coverage creates a comparison in the mind of hurricane evacuees, causing them to update their performance assessments based on comparing their own experience to that which they observe, thereby updating their political trust.  相似文献

The Covenant of Mayors (CM) is the mainstream European movement involving local authorities who voluntarily commit to increase energy efficiency and the use of renewable energy sources within their territories with the aim of reducing CO2 emissions and meet the European Union objectives by 2020. One country that has a greater number of signatories of this agreement is Spain. This article analyzes which factors influence the decision of Spanish local authorities to join the ever‐growing movement. An empirical model is formulated to describe the behavior of Spanish local governments, this being a binary choice model which is a function of various political, economic, and technical factors. Among the prominent factors that influence this decision are population, availability of renewable energy, fiscal and environmental stress, citizens’ political preference, the contagion effect of neighboring municipalities, the existence of covenant coordinators, and finally, economic motivations.  相似文献

由于中国内地与港澳死刑政策的冲突,及三法域间各自独立的刑事管辖权的并行存在,使得跨境犯罪的死刑案件的司法协助变得更为复杂。本文探讨两个问题:跨境犯罪死刑案件中死刑犯是否该移交及移交的标准。在对前一个问题作出肯定回答的同时,进一步论述在跨境犯罪死刑犯移交中应遵循坚持“属地管辖原则”为基础,加强三法域间平等的“协议管辖”协商。从立法和司法方面进行三法域间刑事方面的联系与协助,有效打击严重的跨境刑事犯罪。  相似文献
