我国出口企业应对反倾销的法学思考

被诉倾销己成为困扰我国出口贸易的重大问题,其产生的根源在于WTO反倾销立法在倾销认定、损害认定和倾销与损害之间因果关系认定方面的非公平性,以及欧盟等国在市场经济国家定位上对我国的政治性歧视,应对的有效措施是对出口企业加快国有股减持,加强会计制度建设,建立规范的会计账簿体系.     

The Preference for Indirect Harm

We presented subjects pairs of hypothetical scenarios. The action in each scenario harmed some people in order to aid others. In one member of the pair, the harm was a direct result of the action. In the other member, it was an indirect byproduct. Subjects preferred the indirect harm to the direct harm. This result could not be fully explained in terms of differences in judgments about which option was more active, more intentional, more likely to cause harm, or more subject to the disapproval of others. Taken together, these findings provide evidence for a new bias in judgment, a tendency to favor indirectly harmful options over directly harmful alternatives, irrespective of the associated outcomes, intentions, or self-presentational concerns. We speculate that this bias could originate from the use of a typical but somewhat unreliable property of harmful acts, their directness, as a cue to moral evaluation. We discuss the implications of the bias for a range of social issues, including the distinction between passive and active euthanasia, legal deterrence, and the rhetoric of affirmative action.     

反盗版行为的法治对策

盗版行为侵蚀了版权制度,扰乱了市场秩序,侵害了作者的知识产权,损害了消费者合法权益。近年来,盗版行为之所以猖獗,原因是多方面的,如中国传统文化心态影响下人们的版权意识不强;巨大的经济利益是盗版行为的主要动力;不健全的行政体制为盗版提供了温床;不完善的法律制度使盗版有机可乘等。因此,依法反盗版行为,必须增强反盗版意识,加强对盗版行为的惩罚力度,完善市场准入法律制度,完善版权法律制度,不断增强法律规定的可操作性。     

对危险驾驶罪的法定刑设置的反思

危险驾驶罪与以危险方法危害公共安全罪、交通肇事罪共同构成维护公共交通安全的刑网体系,但是在法定刑设置上,对危险驾驶罪判处拘役并处罚金与上述两罪并不协调,也存在漏洞;罚金和拘役功能相同,并处罚金不能实现特殊预防,应增加1年以下有期徒刑和轻微危险驾驶肇事行为的刑罚配置,同时就危险驾驶的结果加重犯单独作出规定,以便与相关条文相协调。

Evaluation of the Phoenix TRUCE Project: A Replication of Chicago CeaseFire

The Phoenix TRUCE Project was modeled after the Chicago CeaseFire program. There have been relatively few process and impact evaluations on the model compared to the level of funding and attention the program has rendered. This paper presents findings related to the evaluation of the TRUCE project. We found that the program engaged in a strong media campaign, conducted conflict mediations, and identified high-risk individuals for case management. The program did not, however, establish a coordinated and collaborative relationship with the faith-based community or other community groups. Time-series analysis showed that program implementation corresponded to a significant decrease in overall levels of violence by more than 16 incidents on average per month, a decrease of 16 assaults on average per month, and resulted in a significant increase of 3.2 shootings on average per month, controlling for the comparison areas and the trends in the data.
