盐业合伙契约的历史意义和现代价值——兼论新《合伙企业法》的不足与完善

合伙兼具设立简便、出资灵活、管理便利等诸多优点,是一种古老而又有生命力的人类生产活动的组织方式,各种合伙制度又因历史传统、经济基础等不同而在形式和内容方面呈现出差异性.盐业合伙契约作为我国近现代一种独具民族传统特色的资本组织形式,具有十分丰富的内容和非常鲜明的特点,分析盐业合伙契约并阐释其历史意义和现代价值,对于探讨我国新《合伙企业法》存在的不足,提出完善的思考和建议有着一定的启发作用.     

“Gendering” European security: policy changes,reform coalitions and opposition in the OSCE

The Organisation for Security and Co-operation in Europe (OSCE) has rarely been considered in scholarship on gender and security, even though it was one of the regional security organisations whose gender policy predated the United Nations Security Council’s call for more international attention to issues related to women, peace and security in October 2000. Based on an analysis of official OSCE documents and on semi-structured interviews, we trace the integration of gender issues in the OSCE and explore the rationale behind and the challenges associated with it. We identify two phases of gender policy change in the OSCE and show how the integration of UNSCR 1325 brought about an expansion of OSCE gender policy from an exclusive focus on “soft” security issues towards increased inclusion of gender in the area of “hard” security. Drawing on historical and feminist institutionalism, we argue that reform coalitions were crucial for the policy changes in the OSCE but that they encountered institutional and ideational barriers, which hampered implementation of the gender policy. In light of rising opposition, our analysis warns of a backlash that might jeopardise current achievements.     

Memory and forgetting: examining the treatment of traumatic historical memory in Grave of the Fireflies and The Wind Rises

Within Japanese popular culture, manga and anime have played a significant role in mediating responses to the outcome of the Pacific War. Miyazaki Hayao's (possibly) final feature-length film, The Wind Rises, has been an important addition to the preceding body of popular media ‘texts’ that raise such themes. This article aims to address the question of how far cinematic animation can reasonably be obliged to follow the kinds of historiographical concerns that inevitably arise when engaging with Japan's militarist past. To answer this question, considerable space is devoted to examining the historical context of what others have done in the post-war period and integrate that commentary into an analysis of how the works of Takahata Isao and Miyazaki Hayao fit amongst a succession of creative works that have been co-opted in the reshaping of historical perceptions of the Japanese at war amongst the Japanese themselves. This will also require some incidental discussion of methodological issues that arise when dealing with such cases as vehicles for understanding transformations in historical consciousness. Ultimately it is argued that Miyazaki does indeed make an important contribution to the commentary on the Japanese war experience, although it must, perhaps unavoidably, be on highly personal terms so far as The Wind Rises is concerned.

On the Tort of Negligence in Common Law Legal System

It is difficult for judicial practitioners to determine the liability of tort of negligence due to the fact that it has not been specially stipulated in the provisions of the Tort Liability Law or other civil laws and regulations in China. On the contrary, the principles of tort of negligence in common law legal system have been refined in judicial practice and provided the corresponding solution for determining the liability of tort of negligence. The author believes that the empirical research on the tort of negligence in common law legal system will help us to further strengthen the understanding and application of the Tort Liability Law in China. This article thus comprehensively surveys and researches the tort of negligence from the perspective of common law legal system.

The Capitalocene Part II: accumulation by appropriation and the centrality of unpaid work/energy

This essay – Part II – reconceptualizes the past five centuries as the Capitalocene, the ‘age of capital’. The essay advances two interconnected arguments. First, the exploitation of labor-power depends on a more expansive process: the appropriation of unpaid work/energy delivered by ‘women, nature, and colonies’ (Mies). Second, accumulation by appropriation turns on the capacity of state–capital–science complexes to make nature legible. If the substance of abstract social labor is time, the substance of abstract social nature is space. While managerial procedures within commodity production aim to maximize productivity per quantum of labor-time, the geo-managerial capacities of states and empires identify and seek to maximize unpaid work/energy per ‘unit’ of abstract nature. Historically, successive state–capital–science complexes co-produce Cheap Natures that are located, or reproduce themselves, largely outside the cash nexus. Geo-managerialism’s preliminary forms emerged rapidly during the rise of capitalism. Its chief historical expressions comprise those processes through which capitalists and state-machineries map, identify, quantify and otherwise make natures legible to capital. A radical politics of sustainability must recognize – and seek to mobilize through – a tripartite division of work under capitalism: labor-power, unpaid human work and the work of nature as a whole.     

Investigating Ministry Names for Comparative Policy Analysis: Lessons from Energy Governance

This commentary contends that ministry names offer a valuable construct for furthering the state of comparative policy analysis. Using energy governance as an example, this study shows that ministries’ names are stable in some countries but subject to changes in others. Furthermore, there is variation in the ministries’ names over time. Creating or maintaining a ministry that explicitly mentions “energy” is interpreted as signaling enhanced political attention to this issue, whereas removing the referral to “energy” signals the opposite. The names of ministries responsible for energy matters also affect energy policy outputs. Drawing on 43 OECD and BRICS countries, the empirical analysis shows that countries which have ministries in place that mention “energy” together with “economy” in their names are swifter in adopting renewable energy targets. Ministries that mention “economy” along with “climate” and/or “environment” also have an inclination to be faster in adopting such targets, but the coefficients fail to reach conventional levels of statistical significance. Given this finding, it appears worth pursuing this line of research further.     

Data Analysis and Data Visualization as Active Learning in Political Science

While data analysis and the related skills of data management and data visualization are important skills for undergraduates in the field of political science, the process of learning these skills can also be used to develop critical thinking, encourage active and collaborative learning, and to apply knowledge gained in the classroom. Drawing on our experiences using data work in upper-level courses in International Relations and American Politics, we discuss how data work and quantitative analysis can be incorporated into subject-based (i.e., nonmethods specific) courses, and how it can also enhance critical reasoning skills. An evaluation of this approach using direct and indirect assessment is included.
