"亲亲相隐"作为以人伦亲情为纽带的传统法律制度,对尊重人性与实现正义,以及保护人权与构建和谐社会有着十分重要的意义,应当在我国刑事立法中予以体现。本文在介绍"亲亲相隐"制度的历史沿革与国外立法例的基础上,分析了"亲亲相隐"制度在我国现行刑事立法中缺失的成因,论证了如何重新构建亲亲相隐制度,以期裨益于刑事立法与司法。  相似文献

The Guiding Principles on Business and Human Rights (UNGPs) were endorsed by the United Nations Human Rights Council in June 2011, following the six‐year mandate of the Special Representative to the Secretary General (SRSG) on the issue of human rights and transnational corporations and other business enterprises. The SRSG developed a framework comprised of three pillars: (1) States have a duty to protect against human rights abuses committed by third parties, including business enterprises; (2) business enterprises have a responsibility to respect human rights; and (3) victims of business‐related human rights abuses need access to effective remedies. In particular, guiding principle (GP) 11 provides that business enterprises should respect human rights, that is, they should avoid infringing on the human rights of others and address adverse human rights impacts with which they are involved. This article considers the implications of the Guiding Principles' framework for business; the continuing role of conventional accountability mechanisms in providing access to remedy for victims under the third pillar of the framework; and developments in ‘hard law', with a particular focus on the approach by the UK, since the introduction of the UNGPs, before turning, briefly, to the future for business and human rights.  相似文献

This article examines India’s historical efforts to spy inside Pakistan from the mid-1960s to the early 1970s. It draws from memoirs of notable Indian spies who were jailed for espionage in Pakistan and spy ‘fiction’ written by former Indian intelligence and military officers who allege their writing is based on actual cases. The article highlights commonalities among Indian spies using the words of Indian officers to better understand human intelligence efforts inside Pakistan. It finds that Indian spies in these books have initially been Hindus or from multi-religious families, from the Indian-Pakistan border and have been poorly treated by the Indian government and its intelligence services.  相似文献

This article explores the tension between the production of “naming and shaming” reports as tools of activism by international nongovernmental organizations (INGOs) and the usage of these reports as cross-national indicators of human rights violations. Because INGOs are strategic actors, their reports are not a reflection of the “true” levels of abuse. Although existing scholarship has raised this issue in relation to bias in cross-national indicators, it has yet to explain the process by which NGOs produce reports. This article exploits subnational variation across domestic and international NGOs within India, showing how the divergence in their reports can be explained by these groups’ organizational structures, probability of success in their chosen issue areas, and target audiences. By explaining how human rights NGOs produce reports, this article concludes with suggestions to ensure that the biases prevalent in a single source of data do not drive the results of future scholarship.  相似文献

自动驾驶汽车是人类研发、制造、使用和管理的智能产品,不是犯罪主体或刑事责任主体。在自动驾驶汽车自主控制状态下发生交通事故的,其生产者、使用者和其他人员难以按照我国现有刑法的罪名定罪处罚。除非道路交通安全法和刑法有专门的规定,驾驶位人员不接管汽车或接管后无力改变交通事故结果的,不构成交通肇事罪或其他管理过失犯罪。驾驶位人员的注意义务是阻止自动驾驶汽车自主控制下发生交通事故,其注意义务不应过高。允许的风险、紧急避险理论不能为自动驾驶汽车紧急路况处理算法的生产与应用提供合法、合理的解决方案,生产者遵守算法安全标准仅可以使生产行为合法化。鉴于现行刑法不适应自动驾驶汽车应用的特性,我国应当建立以生产者全程负责为中心的新刑事责任体系,使之在自动驾驶汽车生产和应用两个阶段承担安全管理责任,生产者拒不履行自动驾驶汽车应用安全管理义务且情节严重的,应当承担刑事责任。  相似文献

The identification of long-term missing persons and unidentified human remains is a global challenge. Many people stay on missing persons registers, with unidentified human remains stored for extended periods in mortuaries around the world. Research exploring public and/or family support for providing DNA in long-term missing persons cases is scarce. The aims of this study were to examine whether trust in police predicted the level of support for providing DNA and explore public/family support and concerns for providing DNA in such cases. Trust in police was measured through two widely used empirical attitude scales; “The Measures of Police Legitimacy and Procedural Justice”. Support and concerns for giving DNA were measured through four hypothetical missing persons case scenarios. The results showed more positive attitudes towards police legitimacy and procedural justice significantly predicted support, with the percentage level of positive support across the four case types as follows: cases involving a long-term missing child (89%), elderly adult with dementia (83%), young adult with a history of runaway (76%), with the lowest level of support for an adult with an estranged family (73%). Participants also reported more concerns about providing DNA when the missing person circumstances involved family estrangement. Understanding levels of public/family support and concerns around providing DNA to police in missing persons cases is vital to ensure that DNA collection practices reflect what the public/family support and, wherever possible, alleviate public concerns.  相似文献
