我国刑事和解制度阙失的根本成因在于对其法理基础的不自信,本质是被害人在刑事诉讼过程中的缺位、边缘化和失语。刑事和解制度的建立和完善是我国刑事司法制度实现由国家主义向民本主义转型的必然要求,是重估和校正传统的刑罚功能判定的必然结论,是凸显刑罚促进社会和谐价值的必然举措。适用于特定刑事案件的刑事和解制度的建构及其运作,应当遵循促进当事人和解、尊重当事人意思自治、坚持司法机关主导的基本原则,并对达成刑事和解协议的加害人实行轻缓化的刑罚处遇。  相似文献

Since the collapse of the Soviet Union, the post-Soviet space has seen regional integration in the framework of the Commonwealth of Independent States (CIS). The CIS while moribund has affected migration in the post-Soviet space. Despite its persistence and effect on migration, few studies have sought to explore public perceptions towards the CIS. We address this limitation by developing several arguments, anchored on the literature on public opinion and European integration, to explain how perceptions towards migrants and employment status affect public trust in the CIS. Our analyses make use of the sixth wave of the World Values Survey that includes seven CIS member-states and finds strong support for our hypotheses. Our contribution lies in the investigation of public attitudes in a non-EU setting while applying arguments from EU literature and the wide coverage of our study compared to the extant literature on the CIS and public opinion.  相似文献

The low turnout of the 2012 police and crime commissioner (PCC) elections have led to questions surrounding their legitimacy and have even led to the former Deputy Prime Minister Nick Clegg describing the elections—elections his party helped to introduce—as a ‘failed experiment’. Despite this, the election of a majority Conservative government in May 2015 appears to offer some longevity to the role of police and crime commissioners and cements next year's PCC elections in the political diary. Concerns in the immediate aftermath of the elections focused upon the costs of the elections. In this article I offer some suggestions as to what lessons could be learned from this experiment and, through exploring the attitudes of voters, political parties and the media, suggest that we can learn four lessons: (1) that spoilt ballots cannot be ignored; that (2) political parties and (3) the media's attitudes toward elections are important in encouraging people to vote; and (4) that high numbers of independent candidates cannot simply be welcomed at times of elections.  相似文献

Why does the public sector innovate, how should the public sector innovate, and, even more basically, should the public sector innovate? These are some of the questions that these contributions explore and to which they provide some salutary answers. Martin Stewart‐Weeks, an independent consultant working at the intersection of government, innovation, and technology, draws some lessons from his direct experience and advisory work about how the public sector catches the innovation ‘bug’ and turns it into in‐ spired action. From infection to inspiration to implementation, the public sector needs to lower its defences and put itself ‘in harm's way’ to engage with innovators and new ideas. Tim Kastelle, one of Australia's leading innovation scholars and practitioners, sets out some practical ways that the public sector can extend and entrench its innovation practice. Political actors and legislative bodies often invoke net present value calculations to support proposed legislative change. This paper explores the idea that adopting a law is like investing in a productive asset to identify possible misleading applications of net present value calculations. Investment involves incurring a present cost in the expectation of future benefits. Legal systems can be regarded as making investment decisions when incurring present lawmaking costs that will generate benefits over time. Lawmaking investments share, in varying degrees, three important attributes with other investment decisions. First, lawmaking costs cannot be recovered if the enacted rules prove to be ineffective or undesirable at a later time. That is, lawmaking investments are partially or completely irreversible. Second, there is often uncertainty over the future benefits of the legislation. Chosen rules may prove ineffective or changes in the social or economic circumstances may render them obsolete over time. Third, like any investment decision, timing is an issue for lawmakers to determine: lawmaking innovation or revision of current rules can be postponed. Often delays in such investment decisions come at a cost, given the forgone benefits of the investment in the immediate future. This paper focuses on the value of waiting in lawmaking, illustrating the interaction among the above factors in identifying the conditions that determine the optimal timing of legal intervention. The basic model is followed by two extensions. In the first extension, we allow for some learning and informational benefit from the immediate implementation of the new law. In a second extension, we allow for political time preference to affect the lawmaking choice.  相似文献
