WHERE IS THE JUSTICE? PARENTAL EXPERIENCES OF THE CANADIAN JUSTICE SYSTEM IN CASES OF CHILD SEXUAL ABUSE*

Research concerning child victims of sexual abuse in the judicial system cites largely negative experiences and outcomes. However, few investigations focus on parental experiences of the justice system. Using a grounded theory method this Canadian study explored parental experiences of legal and judicial processes for child sexual abuse victims. Nineteen in‐depth interviews with parents encountering the justice system, as well as interviews with professionals working in those systems were analyzed. Results show a wide range of experiences, with parents reporting predominantly negative outcomes that potentially impede healing for children, indicating earlier judicial reforms have not been realized. Recommendations call for structural changes in the judicial system and more provision of parent‐focused supports.     

国学考据学的证据法研究及展望——从一重证据法到四重证据法

本文论述人类学对传统的国学方法之开拓与更新:文学人类学和历史人类学作为现代以来的人文研究新范式。在方法论上与国学考据学相对接,经历了从 20 世纪初期的二重证据说,到 90 年代的三重证据说,人类学视野与方法的介入给国学带来的格局变化;再到 21 世纪初的四重证据说,描述跨学科潮流影响之下的文化整合认知范式出现及其意义,侧重在古史研究方面,梳理出从信古、疑古、释古到立体释古的四阶段发展演变轨迹。对立体释古范式的现阶段应用实践及其前景,结合人类学中新兴的物质文化研究和新史学发展潮流,作出学术评估与展望。     

The Procedural School of Sao Paulo

The Procedural School of Sao Paulo originated itself from the lessons of Enrico TuUio Liebman, Italian scholar, during his stay in Brazil at the time of the Second World War, and consisted of the gathering of local studious participants who had a methodological unity and a scientific point of view of the procedure. The School spread for all the country. The master died in 1986, but his influence is still alive among us. Everywhere and in every Brazilian author＇s writings, one may recognize the master＇s method as well as his most important ideas.     

利用激光、光敏印章机伪造印章印文的鉴定

利用激光刻章机雕刻、光敏印章机制印伪造印章印文是近年来出现的一种新的、仿真程度较高的伪造印章印文的方法。鉴定实践表明,这类伪造印章印文趋于专业化、技术化,且伪造的印章印文与真实印章印文的相似度较高。依据传统的鉴定依据和方法难以鉴别真伪,因此从该类伪造方法对其特点和鉴定依据、方法要点进行研究,尤其是对伪造形成方式及特点的研究,有助于科学的鉴定其真伪。     

多类别养老保险对居民家庭消费影响的对比研究

在老龄化不断加深、居民消费率增长缓慢、消费需求日益多元化的背景下,研究不同类别养老保险对居民家庭消费水平和消费结构的影响日益重要。采用CGSS(2015)调查数据,使用倾向值匹配(PSM)回归模型,分析不同类别养老保险对居民家庭消费水平和消费结构的影响及内在机制,研究发现:参加基本养老保险和商业性养老保险均会显著增加居民家庭总消费、生存性消费和发展性消费,基本养老保险和商业性养老保险对发展性消费的增加效应均大于生存性消费;参加商业性养老保险对居民家庭总消费、生存性消费和发展性消费的增加效应大于基本养老保险;养老保险影响居民家庭消费的核心机制是居民的总收入以及再分配偏好。为拉动居民消费,应把第三支柱的个人养老金缴费纳入个人所得税专项或专项附加扣除;提高基础养老金的水平,进一步落实养老金水平的动态调整机制。     

Beyond opportunism: Intermediary loyalty in regulation and governance

Regulators and other governors rely on intermediaries to set and implement policies and to regulate targets. Existing literatures focus heavily on intermediaries of a single type – Opportunists, motivated solely by self-interest. But intermediaries can also be motivated by different types of loyalty: to leaders (Vassals), to policies (Zealots), or to institutions (Mandarins). While all three types of loyalists are resistant to the traditional problems of opportunism (slacking and capture), each brings pathologies of its own. We explain the behavioral logic of each type of loyalty and analyze the risks and rewards of different intermediary loyalties – both for governors and for the public interest. We illustrate our claims with examples drawn from many different realms of regulation and governance.

有关WTO规则在我国适用的若干法律问题

我国加入世界贸易组织已有数年。但WTO规则究竟应怎样在我国国内予以适用与实施的问题,至今为止,理论界尚无定谳,立法上更无统一、明确的规定,最近通过的宪法修正案亦未提及。不过,在这一问题上,该组织其他成员方在立法与实践中的诸多做法,将无疑为我国立法机关和司法部门提供有益的参考与借鉴。     

关于加强实践课教学的思考

成人高校应该将改革固有、陈旧的教学形式放在教学改革的首位。实践课的教学就是理论教学中一种能起到积极作用的辅助性教学方法。实践课的教学要采取灵活和多方位的教学手段 ,通过有效的考核制度 ,保证实践课在教学过程中真正达到培养学生创新能力、应用能力的实际效果。
