Families in need of supervision

Abstract

Even judiciaries that do not have histories of serious or pervasive corruption need to be watchful lest what I refer to as judicial corrosion occurs. Drawing on studies of institutional entropy, I identify some of the external and internal sources of such corrosion and comment briefly on challenges that face its prevention or repair within the judicial realm.     

美国注册会计师行业监管制度变迁及其启示

向国际惯例靠拢是研究制定我国资本市场监管机制的一项重要指导思想,也是我国审计规范建设的一项十分重要的目标。本文回顾了20世纪70年代以来美国对会计职业管理体制的两次变革,分析了1984年的《美国统一会计师法案》与2002年《萨班尼斯—奥克斯利法案》的立法过程,以期为完善我国注册会计师行业的监管提供一些有益的启示。     

危机动员与中国社会团体的发展

在全球化的国际环境背景下 ,现代社会既是一个常态管理的社会 ,也是一个呈现多种危机的非常态管理社会。在处理危机事件中 ,不仅需要采用行政动员和政治动员的常规形式 ,而且还需要启用符合社会主义市场经济的社会动员形式 ,充分发挥社会团体在危机动员中的积极作用 ,开发社会总资源 ,降低社会总成本 ,及时有效地扼制危机事件 ,使社会尽快回复到正常的生活和工作状态。政府在确立危机意识、成本意识和主体意识的同时 ,应适时进行制度安排 ,把社会团体在危机应对中的重要作用显现在各种制度安排中 ,真正构建起政府、市场与社会三元关系良性循环的新型结构     

The exclusion of Roma claimants in Canadian refugee policy

The arrival of thousands of European Roma seeking refugee status in Canada elicited a range of legislative and policy instruments that severely restrict their acceptance and create conditions antagonistic to further admissions. Interventions have included visa restrictions, actions by Immigration and Refugee Board, the Balanced Refugee Reform Act followed by the Protecting Canada's Immigration System Act, and ministerial rhetoric about the illegitimacy of Roma as refugees. Other factors have involved interpretations of persecution in relation to the Geneva Convention and Protocol, and the implications of the conditions required for membership to the European Union. These political circumstances in large part determine Canadian acceptance rates for the Roma. Their systematic exclusion is reminiscent of the historical treatment of other groups due to institutional racism. In the new racism, however, refugee law and policy is racist in effect while evading the language of race.     

Economic strain and perceptions of social cohesion in Europe: Does institutional trust matter?

The degree to which different social groups get along is a key indicator of the cohesiveness of a society. This study examines perceptions of social cohesion among Europeans and explains variations in those perceptions by considering the separate and combined effects of economic strain and institutional trust. Analyses were conducted with the 27 member countries of the EU based on the Eurobarometer 74.1 on poverty and social exclusion conducted in 2010. Results show that individuals living in households experiencing economic strain perceive social cohesion to be weaker than their less economically hard‐pressed counterparts. By contrast, individuals trusting their political institutions perceived there to be higher levels of cohesion. Furthermore, institutional trust substantially moderates the negative relationship between economic strain and perceptions of cohesion. These results are robust to various model specifications. Moreover, extending the analysis revealed that this moderating effect held when considering social relations between the poor and rich and between different racial and ethnic groups. Theoretical and practical implications of the results are discussed.     

Historical perspective and better regulatory governance: An agenda for institutional reform

Compared to economics, sociology, political science, and law, the discipline of history has had a limited role in the wide‐ranging efforts to reconsider strategies of regulatory governance, especially inside regulatory institutions. This article explores how more sustained historical perspective might improve regulatory decisionmaking. We first survey how a set of American regulatory agencies currently rely on historical research and analysis, whether for the purposes of public relations or as a means of supporting policymaking. We then consider how regulatory agencies might draw on history more self‐consciously, more strategically, and to greater effect. Three areas stand out in this regard – the use of history to improve understanding of institutional culture; reliance on historical analysis to test the empirical plausibility of conceptual models that make assumptions about the likelihood of potential economic outcomes; and integration of historical research methods into program and policy evaluation.     

制度执行力:概念辨析及构建要素

制度执行力就是指制度本身所具有被执行落实的强制力、执行效力,以及相关组织在执行相关制度时的执行力量和执行效力。制度执行力与政府执行力、政策执行力之间具有交叉重叠的关系。制度执行力的构建,需要从完善制度、执行元制度、执行主体、执行行动、执行要件等方面着手。     

公共利益法律化：理论、路径与制度完善

在多元社会背景下,为了整合各种形态的特殊利益,代表公共利益的国家借助法律的形式,建立起一种法律秩序,使其对社会的控制和管理合法化。公共利益也表现出从法律外的抽象政治理念到具有实质内容法律概念的现代转向,公共利益法律化的主要内容在于寻求公共利益的确定法律内涵。从实体和程序两个角度探讨公共利益的法律化忽视了公共利益作为法律概念与非法律概念的区分。将公共利益视为一个不确定法律概念,围绕着其规范目的进行具体化研究是公共利益法律化的有效路径。因而,公共利益的法律化不应停留在立法对公共利益概念的表述,更应当完善确定公共利益法律内涵的法律界定模式。     

建国60年来中国地方行政区划和府际关系的变革与展望

地方行政区划和府际关系的重构是20世纪以来中国现代国家制度建设工程的重要内容．关系到国家的政治稳定和地方社会经济的可持续发展。建国60年来,中国地方行政区划和府际关系的调整和改革,基本上延续了传统中国的治理逻辑和治理术,即以属地管辖和行政内部发包制为特征、由职权同构和行政分权构成的多层级的地方政府结构为基本治理结构。为适应工业化、市场化和城市化的现实要求,中国地方行政区划和府际关系必须根据法治政府、责任政府和公共服务型政府的制度设计,对既有的地方治理结构进行改革和调整。以民主化和地方自治促进和改善地方治理,使地方行政区划和府际关系以及相应的产权、财税权和人事权等制度走向法治化、制度化和规范化。     

The Multifaceted Balance of the Concept of Staatswissenschaften in the Tradition of the Historical School

The article critcizes recent contributions which argue that the historical school was neither German, nor historical, nor a school. Instead, the historical school has a pronounced multifaceted basis which is mostly ignored in the recent literature. Some of these multifaceted dimensions are briefly highlighted. Finally, the practical relevance of the approach is discussed by referring to some recent economic policy issues.
