This article details a simulation of formulating a new international human rights treaty designed for an introductory international studies course. Student understanding and interest in a range of international relations topics—including diplomacy, two –level games, international law, human rights, and group decision making—are reinforced by actively engaging the students in policy formulation and state –to –state negotiations. The article is structured around the four key components of active learning approaches—educational objectives, design parameters, procedures, and assessment and debriefing—in order to provide a full understanding of the goals, set –up, process, and advantages of the simulation. The simulation has been successfully run multiple times at both a large state university and a small liberal arts institution. Supportive student feedback and an interesting variety of outcomes indicate that this simulation is a positive addition to the course and reinforces the use of active learning approaches in the international studies classroom.  相似文献

Basin countries of the Lower Mekong River Basin in 1996 signed a new agreement about use of the shared water resources, which superseded the previous agreement in 1975. The new agreement is less binding for riparian countries in terms of use of water in the main stream and major tributaries. The difference reflected the changes in socio-economic and political settings. Following lessons were obtained out of the case: (a) A collaborative scheme may not function as expected when it is established by strong stewardship of donor countries. (b) The pace and character of the negotiation process towards implementation of a collaborative scheme is endogenous to the broader political and economic context of the basin countries. (c) An agreement among basin countries may be sustained only on a delicate balance of economy and political power among riparian states.  相似文献

当前国际体系正处于新旧交替和质变飞跃的过渡期,筹划和推动新的国际体系建设是事关国际政治经济发展的重大问题。冷战结束以来三十年的国际体系延续和发展了二战后国际体系的主体框架,处于突变后的渐变过程,世界在“后冷战体系”和“前多极体系”之间探索和徘徊。越来越多的非西方国家在批判过时的国际关系理论,国际社会作为一个整体也在扶正祛邪中不断促进国际体系朝着更加公正、合理的方向前进。未来三十年世界将开启东西方力量相对平衡和世界多极化基本稳定的新时期,这一进程大体上与中国的第二个百年奋斗目标同步推进,国际体系将从后冷战转型期朝着构建新型国际关系和人类命运共同体的方向演进,并最终成熟定型。中国在逐步走近世界舞台中央的历史进程中,应注重加强国际体系理论建设,准确把握国际社会的主要矛盾。解决各自的发展问题和国际社会的共同挑战,对公平正义的普遍需求和供给的相对不足将越来越成为国际社会发展的主要矛盾。中国要着力解答当前和未来的时代命题,勾勒国际体系改革基本架构,进而促进和平、发展、合作、共赢的时代潮流不断向前,推动实现公正、共同富裕的新时代目标。  相似文献

2017年夏天以来美国在中美贸易之间频频制造摩擦并对中国的相关立法和企业行为发起挑战,其表象是美国政府作出的决定,但实际上背后私人企业是始作俑者;它们所涉及的问题实质是私法行为公法化现象及其理论。历史地看,私法行为公法化自近代国际贸易出现之日起,就已经存在,只不过美国政府将其表达的更为直接而已。私法行为公法化意指私人将蕴含营利性的动机、目的等意志的行为通过特定形式变成国家意志的行为或过程,它影响或干预国际贸易,以实现其追求自己利益最大化之目标;通过它,私人部门对国际贸易法律制度的形成和发展产生重要影响,并体现为国际贸易的国内与国际法律规范,进而对后进的国家之国际贸易产生制约。应对中美之间的贸易摩擦不能仅限于政府之间,企业等私人部门的参与也至为重要。  相似文献

Abstract

As this paper briefly notes, an elaborate international legal system has been established to combat terrorism. But this system has two primary deficiencies: There are serious gaps in the current law and the law already on the books is not being implemented vigorously. The paper examines the specific nature of the gaps and recommends the establishment, under the auspices of the United Nations Security Council, of a committee to oversee implementation of the antiterrorist conventions. The paper also examines some recent work of a less well‐known branch of the United Nations, the Committee on Crime Prevention and Control. Finally, the paper considers the possibility of establishing an international criminal court with jurisdiction over drug trafficking and related acts of terrorism, a proposal that is currently on the agenda of the United Nations International Law Commission.  相似文献

《企业所得税法》第58条试图全面解决税收协定在国内适用的三个问题,即条约的国内法效力、适用方式和法律位阶。对于如何理解第58条中的不同规定与办理,存在绝对主权说和国际条约说之争。虽然两种学说的理论依据和具体主张有所不同,但它们均以维护法律体系的纯粹性为最高目标。这两种学说并不符合中国的混合一元条约适用体制。当前,中国应采取更具实质主义导向的方法适用税收协定。  相似文献

Suspect interviewing and interrogation practices have been studied in many different countries, including those in North America, Europe, Asia, and Australia. These studies have produced useful and interesting findings, while also leaving an opening for future inquiry. Specifically, previous research has noted that we might expect interrogation and interviewing practices to vary among different countries or regions, due to distinct approaches to suspect questioning. However, to our knowledge, few previous studies have examined the comparative use of tactics, techniques, and procedures employed to elicit confessions and information from criminal suspects across multiple countries. In the present study, using a consistent survey, we contrasted the interviewing and interrogation practices of 185 practitioners from America, Canada, and Europe, Australia, and New Zealand. In large part, we found that American and Canadian interrogators were similar to one another, and conformed to an accusatorial approach (in both deception detection and questioning techniques). In contrast, interviewers from Europe, Australia, and New Zealand conformed more to an information-gathering approach.  相似文献

The international monetary system is the basis to establishing acomprehensive global financial safety mechanism. To understand the internalconnections between the reform of the international monetary system and the globalsafety mechanism has important policy implications. The reform of the internationalmonetary system and the construction of the global safety network are inherentlyrelated to each other. Risk management and crisis response are the functions ofthe international monetary system and serve to ensure the safety of the globalfi nancial system; liquidity management and international exchange rate coordinationare conducive to the maintenance of the stability of the global financial system.International exchange rate coordination, the control of spillover effect of US monetarypolicies and the reform of governance structures of the international monetary systemcontribute to global fi nancial safety. However, the reform of the international monetarysystem and the establishment of the global fi nancial safety mechanism are faced withproblems such as Triffin Dilemma, the technical shortcomings of global financialsystem, the ill coordination of global and regional fi nancial security network and thegrowing number of political issues involved. In order to build a sound global fi nancialsafety system, cooperation should be enhanced in the following fi ve aspects: to promotethe reform of the Bretton Woods institutions; to build the global financial safetynetwork; to establish the liquidity management system; to facilitate the construction ofthe super sovereign currency; and to deepen regional monetary cooperation.  相似文献
