完善劳动教养制度有关问题的思考

本文在探讨现行劳动教养期限、适用对象、执行模式等制度存在问题的基础上,提出从立法上完善劳动教养期限和适用对象的有效措施。改革创新执行模式,可以更加充分地体现司法公正、现代矫治理念和劳动教养的特色。这些对完善我国治安法制建设,强化人权保障,改进社会治安的综合治理,具有重要的意义。     

关于文化经济的几个理论问题

文化经济将发展为一种新的经济形态。它是在以高新科技为主导的知识经济基础上,融入人文精神,强调以人为本,以文化资源为轴心,发散式扩展的经济形态,是一种轴心经济或者网络经济。经济学必须建立起文化价值论和生态价值论,并与劳动价值论综合起来,形成现代文化经济的价值论基础,进一步解释现代经济的运行机制,为国民经济核算体系和市场价格体系提供理论依据,为合理的分配制度提供理论基础。

非正规的“正规化”:劳动力市场分割与家政服务企业——基于2019年四个城市的家政工人调查

在非正规就业盛行的家政市场,家政服务企业的重要性日益凸显,亟待考察这些劳动力市场中介机构的就业效果。通过分析2019年四个城市的家政工人调查数据,发现家政服务企业的发展可能会影响家政业内不同工种的收入差距,改变非正规就业市场的原有结构。伴随管理者企业的介入,家务员收入大幅提升,母婴护理员和家庭保洁员的收入则出现下降。家政企业对工人收入的改善和工作正规化的促进作用是有限的。本文不仅呈现了家政就业市场内部的异质性,为家政工作的正规化讨论提供中国经验数据,还指出劳动力市场中介机构在以女性为主的非正规就业市场上的特殊性,具有一定政策意义。     

大病风险冲击下农户户内劳动供给的性别差异分析——来自四川贫困县的证据

本文首先利用四川省秦巴山区一个县2696户农户调查数据和153户深度访谈数据,考察贫困地区农户大病风险以及大病风险下农户户内劳动供给的性别差异,然后通过典型案例总结大病风险下农户户内女性劳动供给的模式。研究发现,农村女性面临更多的大病风险,但却提供更多的户内劳动供给———从事更多的家庭收入创造活动和提供家庭成员大病患者的照料服务。文章最后讨论了大病风险下户内劳动供给性别差异的原因并提出了相关建议。     

Inmigrantes laborales y flujo en tránsito en la Frontera Sur de México: dos manifestaciones del proceso y una política migratoria

This text presents a characterization of Guatemalan labor immigration into Mexico, its historical perspective and processes of change in relation to new places of destination, crossings and labor insertions. It also sets out the most fundamental traits of migrants who cross Mexican territory when in transit from Central America, new crossing trajectories and social costs in terms of human rights, within a framework of greater social vulnerability. It analyzes the role that the Mexican state has played in relation to the establishment of a new migration policy set forth in the last two administrations (2001–2012) by the Partido Acción Nacional (National Action Party), institutional and legislative arrandos gements, progress and unresolved matters with respect to the proclamation of human and labor rights. It is concluded that even though unprecedented progress has been made in terms of immigration regulations, these policies still have serious shortcomings with regards to Central American immigration into Mexico, be it labor immigration or migrants in transit. This migration has taken on new forms and has registered qualitative and quantitative changes in crossing, in an environment of greater risk in Mexican territory.     

目前我国企业劳动关系的新变化及调整

市场经济条件下我国企业的劳动关系发生了许多新变化,从而使劳动关系的确立、变更、终止变得十分随意,劳动关系中利益摩擦增多,劳动争议案件上升。对此,只有通过完善劳动关系法律体系、健全处理劳动争议的司法调解和仲裁工作体系,完善劳动合同制度和发展劳动力市场等方法予以解决。     

论职业活动的社会前提

人类的职业活动是在分工的前提下展开的,但是,进入后工业社会,情况发生了根本性的变化,人们的职业活动不再是以分工为前提的,而是以社会分群为前提的。职业活动的前提从分工到分群的变化,意味着对职业活动的科学认识需要根本性的视角转变。在社会治理职业活动中也是这样,对于作为后工业社会治理模式的公共管理需要从社会分群的角度来加以认识。     

Racialisation of Immigrants at Work: Labour Mobility and Segmentation of Peruvian Migrants in Chile

This article explores the emergent racialisation of Peruvian migrants as one element conditioning the labour segregation that characterises Peruvian insertion in Chile. We understand racialisation as a process of construction of categories in which both individual and collective actors participate, and whose expression is demonstrated by the differentiation and inequality that affects the racialised group. We tackle the articulation of racial differences among individual actors, both Chilean employers and Peruvian migrant workers, to suggest that the attribution of naturalised characteristics to migrants is related to segregation, mobility, and specific trajectories in the labour market.
