This paper aims to redress the under-appreciated significance of rent for political ecological analysis. We introduce the notion of value grabbing, defined as the appropriation of (surplus) value through rent. A concept that is analytically distinct from accumulation, rent is both a social relation and a distributional process that is increasingly central to the reproduction of contemporary capitalism. Emphasis is placed on the “grabbing” of value in order to shed light on the processes at work by which surplus value is distributed unevenly between different classes and fractions of classes. A focus on rent within political ecology, we argue, can help us distinguish between two organically related but analytically distinct “moments”: (a) the creation of property rights that establish rent relations and (b) the struggle over the appropriation and distribution of surplus value generated by the rent relation itself. We explore some of the implications of this perspective for understanding new forms of socio-ecological struggles and their varied relations to the state. We maintain that a value-grabbing perspective has far-reaching consequences for political ecology, as it provides a sharp conceptual tool for situating a wide range of socio-ecological conflicts and movements as class struggles over value appropriation and distribution.  相似文献

目前我国有关故意杀人罪中死刑裁量因素的审查难有真切、统一的基准,而在司法实践中对相关刑法条文含义的理解和阐释较为草率;最高人民法院的指导性案例体现的裁判趣旨未得到充分领会;各量刑因素的作用莫衷一是、标准不一,“估堆”量刑的困境萦绕其间,因而须探索故意杀人罪中相对合理的死刑裁量基准。具体而言,须区分各量刑因素的轻重、位阶,建构以责任刑为主、预防刑为辅的死刑裁量基准。至于是否入围死刑圈主要是仰仗责任刑阶段的判断。若责任刑阶段均是从严因素,基本会入围死刑圈的审查。死刑圈内的三种准刑种如何抉择,取决于对行为人的人身危险性判断。在预防刑阶段若均是从宽因素,一般死缓的判决即可满足要求;若从宽因素和从严因素交错,死缓限制减刑的判决基本可满足要求;若只有从严因素,则有判决死刑立即执行的可能。  相似文献

Many surveys show that China’s political regime, under the Chinese Communist Party’s authoritarian rules, enjoys a high level of public support. However, it is still uncertain whether China’s emerging middle class will become the “agent of democratization” as suggested by modernization theory. Using the data of Asian Barometer Survey conducted in China in 2011, this article demonstrates that the relationship between class identity and preference for liberal democracy in China may be inverted U-shaped. The Chinese middle class shows a higher preference to features of liberal democratic regimes than its counterparts of the lower- and upper-class. Members of the Chinese middle class also tend to regard democracy as the best form of government. Thus, the middle class has the potential to initiate democratization in China if the Chinese government fails to keep satisfying the middle class’ quest for economic well-being and protection of property rights.  相似文献

ABSTRACT

This article explores the migration experiences of Ethiopian migrant returnees from domestic work in the Gulf countries and Lebanon. The returnees reside in the town of Girana located in Habru sub-district, North Wollo zone of Amhara region. There is much female work migration to the Arab Middle East from the town, particularly to Saudi Arabia through Muslim pilgrimage. Employing a qualitative method, the study examines how the returnee women perceived and experienced labour migration and analyzes the impacts of labour migration on childcare, family survival back home, and debt payment. The returnees made voluntary regular and irregular labour migration to the region and engaged in domestic work, which is not preferred by the host society. However, domestic work is unregulated by the labour policy of the destination countries. This made the returnees’ employment situation rather exploitative, exacerbating their vulnerability to abuses, ethnic denigration, and undermining of cultural identity.  相似文献

The following article analyzes the under-researched theme of Indian migration during indenture in British Guiana and Trinidad. It is understood that Indians were brought to the Caribbean under a series of restrictive colonial policies that stymied free movement. However, it is argued that some Indians resisted these very colonial regulations and exercised their individual right to migrate and subsequently dictate their own lives. Some independently took illegal action to acquire freedom while others waited until their contracts expired to migrate. While the number of those who migrated was consistently smaller than those who remained on the plantations, migration was a permanent feature of the plantation system that lasted as long as indenture itself. Indian migration during indenture can be conceptualized into three overlapping historical phases: (1) desertion from the plantations; (2) migration from the plantations to settlements (rural) to urban areas; and (3) intra-regional migration from one Caribbean island to the other.  相似文献

The Organisation for Economic Co-operation and Development (OECD) proposal for taxation of digital economy constitutes one of the most ambitious projects in the field of taxation and may lead to the most significant reform to international tax rules in the 20th century. Based on a two-pillar approach, Pillar Two of the proposal suggests the adoption of Global Anti-Base Erosion (GloBE) provisions that are aimed at introducing a worldwide minimum tax. In this article, a critical analysis is based that the GloBE proposal suggests that it represents a shift in the OECD policy. As compared to base erosion and profit shifting (BEPS), it jeopardizes the tax sovereignty of jurisdictions and it raises fundamental challenges of implementation, both in terms of amendments to domestic law and conflicts with tax treaties.  相似文献

The regulations of cross-border data flows is a growing challenge for the international community. International trade agreements, however, appear to be pioneering legal methods to cope, as they have grappled with this issue since the 1990s. The World Trade Organization (WTO) rules system offers a partial solution under the General Agreement on Trade in Services (GATS), which covers aspects related to cross-border data flows. The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) and the United States-Mexico-Canada Agreement (USMCA) have also been perceived to provide forward-looking resolutions. In this context, this article analyzes why a resolution to this issue may be illusory. While they regulate cross-border data flows in various ways, the structure and wording of exception articles of both the CPTPP and USMCA have the potential to pose significant challenges to the international legal system. The new system, attempting to weigh societal values and economic development, is imbalanced, often valuing free trade more than individual online privacy and cybersecurity. Furthermore, the inclusion of poison-pill clauses is, by nature, antithetical to cooperation. Thus, for the international community generally, and China in particular, cross-border data flows would best be regulated under the WTO-centered multilateral trade law system.  相似文献
