The English law of theft is confusing and problematic in principle. Since the introduction of the Theft Act 1968 there has been inconsistency in the interpretation of appropriation as court and commentators have grappled with the intuition that appropriation must entail some subjective element and cannot be purely objective. Although subjectivity is traditionally associated with culpability rather than with conduct, it is argued that some acts can be subjective and yet factual and stand as causes to effects. Appropriation is such an act, its necessary and sufficient condition being a mindset, here termed proprietary subjectivity, on the part of the actor. It is argued that clarification of the concept of appropriation can help to resolve misperceived problems. Such clarification will also reveal other problems in the law of theft. Through a brief history of a widely published canon debate in nineteenth century Orissa, this article describes how anxieties about the quality of ‘traditional’ Oriya literature served as a site for imagining a cohesive Oriya public who would become the consumers and beneficiaries of a new, modernized Oriya-language canon. A public controversy about the status of Oriya literature was initiated in the 1890s with the publication of a serialized critique of the works of Upendra Bhanja, a very popular pre-colonial Oriya poet. The critic argued that Bhanja’s writing was not true poetry, that it did not speak to the contemporary era, and that it featured embarrassingly detailed discussions of obscene material. By unpacking the terms of this criticism and Oriya responses to it, I reveal how at the heart of these discussions were concerns about community building that presupposed a new kind of readership of literature in the Oriya language. Ultimately, this article offers a longer, regional history to the emerging concern of post-colonial scholarship with relationships between publication histories, readerships, and broader ideas of community – local, Indian, and global. 相似文献

This article proposes a phenomenological and semiotic analysis of sensibility in the era of globalization, which is the era of global communication. How are time, space, self, others, life, death, health, illness, work, employment, unemployment, free-time, development, underdevelopment, and so forth, perceived in today's world? As vast as this excursion may seem, these different issues concerning sensibility all bear on the problem of the relation between identity and alterity. The hypothesis guiding my analysis is that the common denominator in science and sensibility today is the ideology, or ideo-logic, of identity. However, taking Europe as our societal paradigm the ideo-logic of identity reveals itself as a menace to the difficult process of forming the European Union. In Europe – indeed, in world history at large – the logic of identity and of alterity can be traced in all the important phases that have determined peoples’ historical destiny. In the current phase of development in the social reproduction system of advanced capitalism, the contrast between identity and alterity is at an extreme, at the point of exasperation. In this article I intend to explore the possibility of opening sensibility to alterity not only in Europe, but in the anthroposociosemiosic sphere at large. 相似文献

AbstractAmong female youth in Nigeria, especially those living in Abuja, Nigeria’s Federal Capital Territory (FCT), and its environs, skin design or tattooing has become a trendy social ritual in reinventing the notion of the “self” or perceived personhood, according to some subjective relevance. The body, or the skin in particular, has become a site for cultural (re)production and interpretation of meaning and a symbolic resource for embodied social capital and individual agency. This article interrogates the practice of tattooing among these youth: its motivations, semiotic interpretations, and perception. It illuminates how female tattoos have helped to create a conceptual dialogue between the biological (objective) body and the social (subjective) body. The study is conceptually rooted in African feminist thoughts and postmodern perspectives about the (female) body which view it as a text that can be written, rewritten and interpreted in powerful ways through a cultural lens. The results indicate that female tattoos are symbolic investments that represent fashion, self-expression, individuality, social change and sexual agency. Fundamentally, the aesthetic and artistic female body is deployed to reconstruct postmodern female identity while protesting the mainstream stereotyped representation of women especially in a male-dominated conservative society like Nigeria. 相似文献

In developing his theory of the “literary field,” Pierre Bourdieu essentially had in mind the case of France from the second half of the nineteenth century, the use of which as a case undoubtedly contributed to his marginalizing numerous aspects of the national microcosm. Among its unstated and unrecognized particular qualities, France is mono-national (rather than multinational) and monolingual (rather than multilingual), and occupies the dominant position in the international Francophone world (much as Germany is at the heart of the German-speaking world). A state, a nation, a language, a territory, a literature – all of these make one unit and prevent one from considering situations more complex or tangled, such as those of many minority literatures. These allow the tackling of issues – among others, problems of their “autonomy” in relation to realities outside of literature such as the political, religious, linguistic, and economic. Rather than imposing constraints on a research agenda, the study of minority literatures allows one to shed light on the complex and contradictory relations between the political (the national, the communal, and sometimes the state), the market, and the literary game. 相似文献
