余华的<兄弟>在2005、2006年的分期出版是当代文学的一次重要事件,它的生产与传播过程典型地显示了消费市场和商品文化主导与影响下的文学生产机制对文学的宰制作用.从文学叙事的角度看,消费文化及其文学生产机制影响了<兄弟>的审美品格和叙事特征,文革历史与改革时代的现实在小说中呈现出夸饰化、漫画化、荒诞化的倾向.这种文学症候标识出余华由先锋作家到畅销写手的某种隐形蜕变,同时,对于当代文学的发展来说,文学与市场、消费文化保持适度联姻时,要规避其对文学自主性和文学审美品质的潜在伤害,要对消费文化保持适当的警觉.  相似文献

Risk is a projection of a specific temporality performed by the observer. However, this projection is doomed to impossibility because of the prohibiting problems of time, causality, subjectivity and relativity of risk. The observer is left only with a castrated projection that defies the role of science as a pedestal for the projection and institutes negation as its driving force. This projection is materialised within the Law in the form of the Precautionary Principle. Risk evokes undesired dualisms, especially the one between Idealism and Operationalism. The essay attempts to bring the two together by extrapolating the hard appearance of the legal system as seen through Luhmann’s autopoiesis and the need for critical openness of a contextualised environmental law. 主体间性是指主体间的相关性和统一性。它是西方现代以来对传统主体性哲学进行反思和超越而构筑的哲学研究新范式。传统法律解释理论是以主体性为分析进路、以正确理解法律文本为核心、以研究具体解释方法为内容的法律理论。然而,随着法律实践的发展,以主体性为分析进路的传统法律解释理论存在着无法克服的理论困境。因而,引入以主体间性为分析进路的现代法律诠释学理论就十分必要。它进一步发展了法律解释学,对于人们更全面、更深入地认识和理解法律解释活动具有十分重要的意义。  相似文献

ABSTRACT

I started my fine art training in the 1990s at the university currently known as Rhodes.* The foundation of art training was drawing. First year focused on two subjects: the European plaster cast and the nude black model. This practice situated my learning of art in the European past as well as the South African present. Drawing on black feminist thought I show that framed by colonial norms the black body was a humiliated and abject subject. She was a racial stereotype rather than an object of beauty. Recent protests at universities specifically targeting art, confirms a deep dissatisfaction amongst students with colonial epistemic knowledge and value systems. By rejecting the colonial and apartheid legacy of universities younger generations use protest action as a means to demand urgent change.  相似文献

This article argues that we need to consider the question of ‘who belongs’ in terms of individuals' construction as market actors, workers and migrants as well as citizens. Using Hegel's theory of civil society, and Charles Mills' critique of the social contract, it argues for the significance of the process of self-government and the construction of a ‘hard inside’ for understanding migration and its relationship to embodiment, labour and belonging. This approach can take us beyond the distributional framework of the territorial state, and the assumption of stable membership, to interrogate the boundary-setting aspects of the political and the meanings of interdependence and vulnerability.  相似文献

Territorial rule ‘begins’ with an assertion of who deserves protection and who does not. The question of responsibility and its limits is integral to the making and maintenance of a nation state. But a modern refugee rights regime externalises the question of asylum. Asylum claims are made by strangers dealt with by bureaucracies. How has this come to pass? How has responsibility become thought in terms of the territorial state and the society and order it begets? In this article, I try to make the case through a historical example that asylum is not external to the constitution of the nation state, rather territorial rule begins by figuring out who to protect and who not to. At the core of these ideas about protection and responsibility is a notion of political subjectivity, which is graduated, hierarchical and centred on the state. The privileging of an ahistorical idea of how political subjectivity has been so limited has contributed to the externalisation of asylum, where the troubling questions of to whom we are responsible and whom not barely figure because asylum claims become the subject of a technicalised procedure. In this article, I focus on the British colonial authority's encounter with native slaves seeking asylum in Perak.  相似文献
