论忠诚是检察官的立身之本

检察机关行使宪法授予的法律监督权,检察权的特殊性需要检察官的忠诚品格。检察官是忠诚的代表,忠诚是检察事业发展的基础,是检察官职业道德的核心,是检察官对法律的信仰。     

Loyalty,Justice, and Rights: Royce and Police Ethics in Twenty-First-Century America

The killings of Trayvon Martin, Michael Brown, Eric Garner, Tamir Rice, Alton Sterling, Philando Castile, and others have instigated widespread debate concerning the ethics and politics of police behavior toward young black men in America. In this article, I show how Josiah Royce’s philosophy of loyalty provides a useful theoretical framework for diagnosing and working to overcome strained relations between police and black citizens in the United States. I begin by establishing the relevance of Royce’s thought to the realm of police ethics. Then, I argue that Royce’s notion of loyalty to loyalty is a useful and powerful lens through which we can examine the practice of police discretion, particularly as it comes to bear on racial profiling and use of force. I conclude by offering what I regard as Roycean recommendations aimed at ameliorating the fractured relationship between police and blacks in America today.     

Intent to Exit: Why Do US Federal Employees Leave?

This study examines factors that may influence an employee to exit an organization. Factors that are considered to influence exit are derived primarily from Hirschman’s model of exit, voice, loyalty, and neglect. Other variables considered are public service motivation, job satisfaction, pay satisfaction, gender, race, supervisory status, and agency. The study evaluates the relationships between these variables using data obtained from the United States’ 2010 Federal Employee Viewpoint Survey. Overall, the data suggest that there is a slight tendency of public employees to be intrinsically motivated.

Abstract

Even judiciaries that do not have histories of serious or pervasive corruption need to be watchful lest what I refer to as judicial corrosion occurs. Drawing on studies of institutional entropy, I identify some of the external and internal sources of such corrosion and comment briefly on challenges that face its prevention or repair within the judicial realm.

中华民族有着重视道德修养和道德践履的优良传统,也一向重视道德评判,而忠毫无疑问是我们的先人最常使用的重要尺度和标准之一.孔子开了把忠作为臧否人物、评判是非重要标准和尺度的先河.迄于战国,忠则流芳百代、不忠则生不如死似已成为士庶普遍接受的价值理念.秦汉以降,直至明清,无论官方还是民间,忠始终都是臧否人物、裁断是非的重要道德标尺.特别是晋以后,根据忠德方面的表现对人作出品行优劣的评判,业已成为社会生活中的一种常态,而推崇忠德、旌表忠臣,更为历代士庶所乐此不疲.

论夫妻忠诚协议之效力

忠诚协议效力问题在理论上争议颇多,忠诚协议的效力认定难以一概而论,必须分情况讨论,笔者通过对忠诚协议的概念内涵、性质问题进行理论分析,结合各种学说及对一些立法例的评价,得出结论:当协议具有财产性和身份性时,其效力判断可以依据《合同法》进行,当协议纯粹为身份契约时,根据契约的本质来判断其效力.这样在立法和司法中才能尽量做到面面俱到,才不至于在碰到具体情况时束手无策或者不假思索就得出武断的结论.     

论人民警察忠诚度及其培养

人民警察忠诚度是人民警察对党、对国家、对人民、对法律的忠诚程度。人民警察作为国家意志的忠实执行者,其忠诚度对公安机关的执法行政有着不可低估的价值,它直接关系到公安机关政治责任和社会责任的落实程度。加强人民警察忠诚度培养,关键要抓好民警忠诚认知、忠诚情感和忠诚行为三个环节。     

公司机会准则的司法裁判

源于美国普通法的公司机会准则,具有平衡公司与董事之间利益诉求冲突的功能。为使这一功能在实践中得到充分发挥,我国《公司法》应当借鉴美国法中的丰富判例与成熟规则,对公司机会认定标准与董事得以合法利用的情形作出明确细致的规定,以增强该制度的可操作性,促进司法裁判的有效开展。     

对法不容情的批判性解读——以容隐制度与亲属拒证权为视角

通过对中国的容隐制度和西方的亲属拒证权进行考察发现,亲属容隐制度与西方大多数国家所规定的亲属拒证权有着共同的价值基础。虽然这项制度在建国后被当作封建消极的东西予以摒弃,但是在当代中国仍有其存在的合理性,而且具有回归的现实基础,应当在立法中重新设立这一制度。对“法不容情”应作批判性的解读。
