Finding the missing and unknown: Novel educational approaches to warming up cold cases

In recent years, students in police academies and higher education institutions around the world have worked together to analyse cold cases including long-term missing persons cases in collaboration with investigators and prosecutors. In 2020, three European organisations, the Police Expert Network on Missing Persons (PEN-MP), AMBER Alert Europe and Locate International, succeeded in connecting these educational organisations enabling them to work collectively on cases and conduct cold case analyses (CCA) across international borders. The International Cold Case Analysis Project (ICCAP) learning objectives were to 1) collect the necessary information about the victim, 2) reconstruct the crime, and 3) investigate trace control.In a learning objective-based evaluation using Computer-Assisted Web Interviewing, 76 participating students from the German and International ICCAP teams were asked to complete a pre- and post-review questionnaire to self-assess their personal competence development. Participants reported significant increases in competence in all evaluated areas, thus demonstrating that authentic and relevant collaborations can enrich the learning environment, promote the use of professional skills, and provide significant knowledge exchange opportunities between academia and industry.Drawing on case studies of cold case missing persons' investigations and unidentified found remains, this article shares how university academics, students and community volunteers can work together nationally and internationally to find out what has happened to missing people and how we can more effectively identify the previously unidentified. In so doing, we share the expertise required to progress these cold cases and provide recommendations to support other institutions and organisations in adopting this innovative approach.     

数据要素对制造业高质量发展的影响——来自制造业上市公司微观视角的经验证据

随着数字经济与实体经济的不断融合发展,数据已经成为经济发展进程中的关键生产要素。基于手工整理的2011—2020年我国A股制造业上市公司年报数据的研究表明：制造业高质量发展是企业研发创新、生产制造、市场匹配三个环节整体联动实现更高效率发展的一种高级状态。数据要素能够显著促进我国制造业高质量发展,且主要是通过关键性技术突破与知识创新的研发创新效应、生产流程优化与协同的生产协同效应产生影响,但市场匹配效应尚未完全显现;数据要素对我国制造业高质量发展的推动作用在非国有企业、高技术密集度行业与东部地区更加显著。研究结论为数字经济时代下我国如何激活数据要素潜能、推进传统产业转型升级提供了政策启示。     

数字经济下的生产社会化与企业分工协作:演进与特性

数字经济是以数字化原料为劳动对象,利用数字化劳动资料进行生产活动的经济形式,在此基础上,数字技术经由企业分工协作体系的重塑推动着生产社会化的发展。依据马克思主义政治经济学原理,以企业分工协作为切入点,通过剖析企业间网络化分工协作和企业内部数字劳动过程,可发现并阐明数字经济下生产社会化中的最新进展及其双刃剑特性。该性质表明:数字经济既可以推动生产活动向社会化方向发展而代表更先进生产力,同时也会激化企业分工与社会分工、生产社会化与生产资料私人占有之间的矛盾。由此表明,数字经济下的生产社会化演进必将呈现出企业分工代替社会分工,以及所有制形式由生产资料私有制向公有制形式转变的发展趋势。     

Cross-sector collaboration in times of crisis: findings from a study of the Funing tornado in China

ABSTRACT

The recent occurrence of several large-scale crises, such as the Wenchuan and Yaan earthquakes, the Gansu mudslides, the Tianjin port blast, and the Funing tornado, has led decision makers in China to increasingly recognise the need to engage non-government organizations (NGOs) in responding to crises. In this study, we establish a framework to analyse collaboration between government and NGOs during crises. This framework consists of four levels for cross-sector collaboration, and six conditions explaining them. The framework is used to analyse a case study on collaboration between local government and NGOs during the Funing tornado. Collaboration occurred at the information sharing and action coordination levels. We conclude the formal collaboration between government and NGOs in this case was still limited and it was not based on negotiations and interactions. Instead, it was essentially hierarchical and control-oriented. This type of collaboration might have the advantage of responding to crises in an effective way, but it comes at the cost of trust, commitment and reciprocity.

随着网络在商业领域运用的逐渐普遍和深入,以及在巨大经济利益的驱动下,出现了大量的将他人商标注册为域名的行为,此类行为在恶意抢注的情形下构成侵权或不正当竞争行为,时此类权利冲突纠纷应区别驰名商标和普通商标适用中华人民共和国《商标法》、《反不正当竞争法》分别给予法律救济,同时为避免类似权利冲突的产生应完善我国相关的法律制度。     

俄罗斯刑法恶意欠薪罪解构与借鉴

拖欠劳动者工资已经成为中国严重的社会问题，在现有的法律救济措施未能有效解决该问题的情况下，某些人渴望通过将恶意欠薪行为犯罪化的方式来解决。能否在中国刑法中增加“拖欠工资罪”在学者和法律工作者中引起广泛争论。在规定恶意欠薪罪的各国刑法中，俄罗斯刑法最具典型性，对俄罗斯刑法恶意欠薪罪的正确解读，能够为我国不将恶意欠薪行为犯罪化提供极有价值的借鉴。     

基层综合应急救援体系建设中的跨部门协同——以云南省文山州消防改革为例

基层综合应急救援体系建设对实现服务型政府的内在价值具有重要意义,地方跨部门协同能力在服务型政府建设的政策执行中发挥着重要的作用,甚至直接影响政策实施的成败。本文通过对云南省文山州消防部队的调查研究,从协同政府的理论视野出发,探讨了文山州消防支队跨部门协同的战略设计及网络架构。总结分析文山州跨部门协同的有效机制对我国应急救援体系建设具有普遍的借鉴意义。     

恶意透支型信用卡诈骗罪“持卡人”的认定

恶意透支型信用卡诈骗罪中的＂持卡人＂不仅包括信用卡申领人,也包括实际使用信用卡的人。在信用卡申领人将信用卡交付他人使用的过程中,信用卡申领人和使用人往往能构成利益共同体,其在恶意透支上,可能构成共同犯罪的行为,在此种情况下,应将信用卡申领人和信用卡实际使用人都认定为＂持卡人＂。     

Australia's Children ‘Safe and Well’?1 Collaborating with Purpose Across Commonwealth Family Relationship and State Child Protection Systems

So ubiquitous is reference to collaboration in policy documents that it is in danger of being ignored altogether by service deliverers who are not clear about its rationale, how it is built, or its real value. This is evident in the child and family services context where for example the National Framework for Protecting Australia's Children calls for collaboration and a ‘shared responsibility’ across the state, Commonwealth and the non‐government sectors to keep children safe and well. This article describes a project undertaken to analyse and ultimately increase levels of collaboration between state and Commonwealth government family service providers. The research reinforced an important message that levels of collaboration should align with the vulnerability of children and their families: the greater the level of risks to children, the greater the level of collaboration needed within and between systems to keep children safe.

当前的法律不能很好地打击恶意欠薪的行为,恶意欠薪的行为已经具有严重的社会危害性,因此《刑法修正案（八）》草案将恶意欠薪的行为入罪。恶意欠薪罪的主体不应该包括机关,恶意欠薪罪的罪过形式是故意,恶意欠薪罪客观方面的行为有两类。
