农村富余劳动力向非农产业转移已成必然.由于主客观因素的双重制约,农民工终难摆脱权益困境.维护农民工的合法权益,是工会的基本职责.针对农民工的基本特征、基本现状及权益缺失的基本制因,工会应整合区域间城市总工会的维权资源,优势互补,联动维权,从落实农民工的务工岗位、培训、输送,到劳动关系的建立、履行、终止,都纳入工会组织的关怀与监控之中,将维权重心前移,形成维权系统链.构建城际间工会维权联动机制,正是农民工系统组织维权新途径的实践与探索.     

Sense of Belonging Among High School Students Representing 4 Ethnic Groups

The authors investigated the dimensions and mechanisms of belonging relevant to motivation and achievement among high school students representing 4 ethnic groups. Using survey data from 9th to 12th grade students (N = 5,494) attending 7 ethnically-diverse high schools, structural equation modeling was employed to explore, independently for each ethnic group, the relationships between students’ perceptions of their belonging (encompassing relationships with teachers and peers, extracurricular involvement, and perceived ethnic-based discrimination), motivation (efficacy beliefs and valuing school activities), and academic success. All 4 measures of belonging were significant for European-American and Latino students. However, friendship nominations were not significant for all groups, suggesting potential variability in perspectives across ethnic groups. The strength of the structural model postulating belonging as a mediator, including statistically significant indirect paths, supported the hypothesis that the belonging construct accounted for much of the relationship between student motivation and success across groups.Beverly Faircloth is a doctoral candidate of the University of North Carolina at Chapel Hill. Her research interests include the developmental and motivational processes that support adolescent school engagement in ethnically diverse settings.Jill Hamm is an Assistant Professor at the University of North Carolina at Chapel Hill. She received her Ph.D. from the University of Wisconsin-Madison in 1996. Her research interests are adolescents’ peer relations in ethnically diverse schools and classrooms.

THE SEXUAL SUBALTERN IN CONVERSATIONS “SOMEWHERE IN BETWEEN”: LAW AND THE OLD POLITICS OF COLONIALISM

Ratna Kapur’s recent book entitled Erotic Justice proposes a new politics of postcolonialism whereby the sexual subaltern disrupts the normative principles of the universal, liberal, legal domain. Kapur traces legal strategies regarding censorship, sex-work, homosexuality, sexual harassment, trafficking and migration which travel a treacherous path, countering allegations of ‘unIndian’ and Western practice with cultural histories of ‘authentic’ sexual legitimacies, towards a new politics of desire. Kapur frames her analysis through postcolonial feminist theory as providing a tool for feminist struggle, yet distinct from and disruptive of a liberal project of global sisterhood. This review deeply values the role of the sexual subaltern which disrupts the tenets of a linear, progressive liberalism. Drawing upon Indian feminist and Western feminist perspectives, the review considers how the distinct position of the postcolonial sexual subaltern subject informs the generic role of law as a tool constructing relations of domination regarding gender, sexuality, caste, property and religion. Kapur observes that both the West and the Hindu Right have engaged with liberal legal principles. 香港输入外劳的政策及其影响

“外劳”在香港是指那些来自所谓第三世界落后国家的、从事体力劳动的蓝领工人,特别是透过政府实施的“输入劳工计划”的输入劳工。1989年以来,香港政府输入外劳政策经历了“一般输入外劳政策”、“扩大输入外劳政策”和“补充劳工政策”三个阶段。香港政府输入外劳政策不仅对香港经济发展产生了影响,对香港的劳动力市场也产生了重要影响。     

关于农民工权益保障问题的研究与思考

农民工在为促进城乡发展、建设现代化国家作贡献的同时,自身权益保障问题日益突出,成为社会广泛关注的焦点。要从构建社会主义和谐社会的高度充分认识农民工权益保障问题的重要性,加大立法与执法力度,建立健全维权机制,提高农民工整体素质,形成党政主导、各方齐抓共管的农民工维权格局。     

关于农民工就业歧视的法律思考

随着我国社会结构的变迁而产生了农民工这个特殊的群体.由于制度性及一些非制度性因素,国家对农民工的保护机制不健全,引致他们在就业、工资待遇及社会保障等方面缺乏法律保护并成为备受歧视的弱势群体.本文基于对甘肃省天水、陇南两市农民工就业状况的调查数据,从国家制度、法律及农民工自身原因等方面分析了产生农民工就业歧视的原因,并在从法律视角提出消除农民工就业歧视的建议.
