On special protections for rescuers and helpers

There is something intuitively correct about singling out emergency workers for legal protection, and for criminalizing not just assault, but obstruction. Moreover, at least one sophisticated theory of right and wrong – Scanlon’s—indicates some deep reasons for endorsing these intuitions. After applying Scanlon’s theory in the relevant way, I want to argue that the same grounds it provides for recent Scottish legislation and UK sentencing guidelines can also be given for punishing more seriously offences that current English law trivialises.

新生代农民工市民化的现实困境及对策——以吉林省为例

农民工市民化是提升城镇化水平,加快现代化建设的必然要求,不仅有利于扩大内需,促进经济发展,而且是解决＂三农＂问题的重要突破口,也是构建和谐社会、保持社会稳定的客观需要。目前,新生代农民工已成为农民工的主体,渴望融入城市是他们最大的利益诉求。吉林省应从提高城市综合承载能力,进一步降低和细化进城落户条件,完善社会保障措施以及加大培训力度等方面努力促进新生代农民工市民化。     

论股东大会的概念

股东大会作为由公司全体股东组成的对公司重大事务进行决策的机制在本质上并不是＂机构＂,而是一种制度,是股东民主的制度形式。股东大会与政治国家中的立法机关（议会）具有本质性的差别,在理论上不能将其类比为立法机关（议会）,而应当将其视为一种类似于＂全民公决＂的重大事项决策机制。股东大会作为股东民主的制度形式只能采用多数决的规则,决定了股东大会制度面临着与政治民主制度同样的问题,即如何保护少数派（股东）的利益。     

流动青少年犯罪的特点、原因及防治对策

我国流动青少年犯罪具有犯罪数量多,犯罪比例大;犯罪低龄化严重,文化程度普遍偏低;犯罪类型以侵财犯罪为主,暴力犯罪亦很突出;团伙性犯罪上升,地域性特征明显等特点。流动青少年犯罪大量增多,既有社会转型历史背景和城乡二元社会结构方面的原因,又有经济上相对贫困、流动人口管理上存在漏洞,家庭、学校教育不当和流动青少年自身心理异常等方面的原因。要遏制流动青少年犯罪多发的势头,必须采取大力改革户籍制度,取消城乡二元社会结构;保障九年义务教育,提高流动青少年的素质;大力发展经济,缩小贫富差距;优化社会环境,完善社区建设;加强普法教育,贯彻宽严相济的刑事政策等对策。     

解析工资集体协商中的三个难题

工资集体协商工作要想开展得富有成效,仅有法律支持还不够,尚须努力破解三大实际难题:一是"不敢谈"的问题;二是寻求协商共同点难的问题;三是协商争议解决难的问题。这些难题,需要相关部门与相关同志在实践中都来作积极的破解性探索。     

农民工身份认同及其影响因素分析—以河南省郑州市为例

当前有相当一部分农民工处于身份认同模糊的状态,并且大部分农民工倾向于认同农民这一制度性身份。经SPSS统计软件回归分析后发现,务农时间、进城期望、进城时间、市民朋友数量、社会交往情况、生活满意度、相对剥夺感、农村传统生活方式认同度、未来打算这几个变量显著地影响着农民工的身份认同状况。     

浙江畲族宗法制度初探

浙江畲族宗法制度独具特色,表现为畲族妇女在宗族、家庭中的地位较高,畲族家法族规以训诫为主、惩罚为辅,畲族婚姻礼仪中保留了古代婚俗的特点。它既存在着维持畲族的生存和繁衍,维护畲族团结、增强民族凝聚力,促进畲族经济发展,有利于畲族村民自治的积极作用,同时也存在着一些消极的作用。     

A Life Table Approach to Estimating Disproportionate Minority Contact in the Juvenile Justice System

Disproportionate minority contact (DMC) in the U.S. juvenile justice system persists despite substantial efforts to reduce it. The juvenile justice system is comprised of a series of interconnected stages, yet few studies to-date use methods to measure DMC that take the cascading nature of the decision-making process into account. Our study addresses this gap by applying life table analysis to identify the cumulative nature of DMC across multiple stages of the juvenile justice system using data from 2008 to 2010 in Georgia that include white, black, and Hispanic/Latino youth. We then compare these state-level results to life tables from a national sample of black youth and a subnational sample of Hispanic/Latino youth. Our findings show that arrest/referral accounts for the greatest proportion of total system-wide DMC for black youth, but most of the total DMC for Hispanic/Latino youth results from later stages.     

Class or Citizenship? Debating Workplace Conflict in China

While a new working class is in the process of remaking itself in China, the latest trend in labour studies has rejected the Marxist tradition which sees the social relations of production as the point of departure for analysing workplace conflict. According to the new current, influenced by post-structuralism, class is only one of the identities articulated by workers, and it can be understood only with reference to their discourses. By critically evaluating an important book by Ching Kwan Lee (Against the Law: Labor Protests in China's Rustbelt and Sunbelt), this article suggests that her approach generalising workers' protests with the notion of citizenship cannot satisfactorily explain the changing pattern of labour protests in China since 2004. By using fieldwork data and connecting the analysis of the social relations of production with the changing patterns of workers' struggle, this paper argues that migrant workers protests are a significant part of the emerging class conflict in China.     

Reaching the Hard to Reach: Drawing Lessons From Research and Practice

Communicating with citizens, stakeholders, or service clients is challenging under normal circumstances. Reaching government audiences who are hard to reach because of language or culture differences, lifestyle unpredictability, mistrust, isolation, or other reasons compounds the difficulty. This article examines who the hard to reach are, addresses reasons why it is important for governments to reach them, explores research and experience, suggests effective approaches for reaching these audiences—drawing upon a social constructionist approach—and proposes lessons and guidelines for public sector communicators. Communication practice and research indicate that more effective strategies include: utilizing knowledge about target audiences; forming partnerships with agencies and individuals that interact with targeted populations; utilizing children to reach parents and older relatives; using ethnic media that effectively reach immigrant and ethnic minority households; and simplifying communication and using feedback techniques.
