“三种精神”引领职工文化自信

职工文化自信是文化自信的具体体现,打造健康文明、昂扬向上的职工文化,离不开工人阶级和广大劳动群众的伟大品格,离不开工匠精神、劳模精神和劳动精神。这三种精神,是新时代职工文化建设的旗帜,是新时代职工文化自信的引领。     

发扬“工匠精神”对于振兴实体经济的现实意义

自2016年3月5日李克强总理作政府工作报告时首次正式提出"工匠精神"以来,党和国家领导人为振兴实体经济多次提出要发扬"工匠精神"。发扬"工匠精神"对于振兴实体经济有着重大的现实意义。我国实体经济在经济社会转型期表现出的发展缓慢问题,在国际市场上表现竞争力不强问题,根本原因之一就在于我国企业缺乏更多拥有"工匠精神"的高素质职工队伍。培育、关心尤其要大幅提高拥有"工匠精神"品牌职工的待遇和地位,是打造更多享誉世界的"中国品牌"的前提和基础。以弘扬"工匠精神"为目标的职工文化是振兴我国实体经济的有力抓手。     

Modern poetry,popular song and their dangerous liaisons

Abstract

In this article, Tsuboi Hideto examines the mutually entwined pursuits of modern poetry and music in interwar Japan, focusing especially on the work of Nakahara Chūya, Kitahara Hakushū, and the People's Poetry group. Cutting across their respective distinctions within the poetry establishment, Tsuboi draws attention to these figures’ shared investment in symphonic, folk and popular music. In so doing, he identifies among them a prevailing concern for curating a poetic voice that might harmonize the conflictual registers of individual and collective expression and thereby attune the work of the poet to that of the ‘people’ more broadly. Meanwhile, the essay traces the currents of modernist and avant-garde thought in Japan and Europe that framed these poets’ engagements with music and sound. Tsuboi then illustrates the varying degrees to which these voices, forged within the cosmopolitan milieu of the Taisho period, bent toward the nationalizing project and later gave way to the chorus of wartime fascism and imperial expansion.     

Contested paradigms of ‘viability’ in redistributive land reform: perspectives from southern Africa

This article reviews some of the salient aspects of the controversy over capitalism and the fate of Russian peasantry, among the Russian Marxists and the narodniks immediately prior to and after the Bolshevik revolution. At issue was the characterization of peasant economies. The narodniks believed that neither marginalism nor Marxism fully captured the nuances of peasant agriculture and the economic system/systems that evolved out of it; neither the market model nor class analysis adequately described the allocative and distributive processes in such economies. While nineteenth-century narodniks stressed the role of institutions based in the village community, Chayanov's twentieth-century populism stressed the organizational dynamic of peasant households within an institutional framework. Accordingly, the economics of the Chayanovian interpretation are examined from an institutional and organizational perspective. Such an exercise, it is argued, lends more credibility not only to the narodnik agenda, but also to the peasantist model of development.

金融衍生交易的法律解释——以合同为中心

金融衍生交易特别是场外衍生交易规则与传统民商法之间的冲突是大陆法系国家普遍存在的问题。衍生工具作为一种新的合同类型,与传统合同的显著区别在于"当前订约、未来履行",从中派生出特殊的履约风险、缔约风险等一系列新问题。对赌、显失公平等法律争议正是基于衍生合约本身的特性而产生;而通常被称为"衍生交易规则"的一整套制度实际上是市场自发创设的防范履约风险的安排。在此,场外衍生交易与场内衍生交易之间没有本质区别,英美法系与大陆法系需要应对同样的问题。通过还原衍生交易规则背后的法律逻辑,可以构筑一个以"合同"为中心的衍生交易法律问题的分析框架,容纳从合同效力、履行、缔约到信息披露、监管等一系列问题。以合同为主要处理对象的民商法应扩张自身的体系以容纳实践中产生的新合同类型,从而为整个金融衍生交易法律规则体系提供坚实的基础。     

我国涉“商业秘密”信息公开之反思——基于实证分析的视角

与一般的信息公开不同的是，涉“商业秘密”信息公开关涉到公民的知情权与商业秘密拥有者利益之间的平衡。此类信息公开制度的完善关涉到我国政府信息公开制度整体的发展，然而目前涉“商业秘密”信息公开在具体制度细节上存在一定不足，在体制上也存在一些需要克服的困难。以涉“商业秘密”信息公开的实证分析为视角，对此类信息公开过程中所遭遇到的困境进行贴合实际的分析与反思，并提出相应的完善路径。
