Displacing your Principal. Two Historical Case Studies of Some Interest for the Constitutional Future of Europe

The framework of public decisions, and particularly the provision of law, is seen here as an agency contract. What distinguishes this contract is the nature of the right delegated to the agent: The capacity to make law gives the opportunity to take advantage of the incompleteness of the constitutional contract. The agency relationship may be loosened or even reversed. This article tries to draw some lessons from the English and American history in that matter and applies them to the making of the future European State.     

Harming America: Corporate Crime in a Context of Deregulation

ABSTRACT

Like many Republican presidential candidates before him, Donald J. Trump campaigned on a pro-business, anti-regulation platform, and since his election in November 2016, he has directed his administration to move forward with deregulation in many arenas, including consumer financial protections, environmental controls, and workplace safety among others. Past efforts to roll back regulations governing certain industries, such as the savings and loan and the mortgage industries, have had harmful consequences for the general public or for specific interest groups. In this study, we review what the Trump administration has accomplished with regard to deregulation to date. Then, based on past deregulatory fiascos, we theorize the harmful collateral consequences that may result from this most recent swing of the regulatory-deregulatory pendulum.     

Bringing the Falklands/Malvinas Home: Young People's Everyday Engagements with Geopolitics in Domestic Space

This paper draws on recent research examining feminist and everyday geopolitics to focus on the relatively neglected domestic sphere as a space where geopolitical events like the Falklands/Malvinas war are learnt, (re)produced, remembered and contested by young people. It presents qualitative data drawn from interviews with young people from Argentina (Río Gallegos) and the Falkland Islands (Stanley), locations with intimate connections to the 1982 war. It argues that research in domestic environments that engages the familial relations, objects and practices that embody geopolitical pasts can help make sense of how young people (are able to) express geopolitical agency.     

Violence as a part of the drug scene

Our study explores the violence that occurs in the drug scene from the perspective of those who use illicit drugs in Finland. We conducted 56 theme interviews with people with experience using multiple substances and studied how they produced agency related to violent acts. We were interested in the kinds of meanings they gave to violence and how these meanings varied according to different positions: (1) experiencing violence (victim), (2) committing violence and (3) witnessing violence. We found that in the drug scene, these positions were not fixed but overlapping and intertwined. Violence was usually projected onto the psychopharmacological properties of the substances or rationalized as being necessary for survival. The relations to and positions of violence differed considerably between men and women. Whereas in men’s interviews violence was often anchored to masculine power and questions of honour, in women’s accounts it was often related to intimate partner violence. However, irrespective of the individual’s position and gender, violence appeared to be a damaging experience that weakened his or her self-esteem. This vulnerability is encountered when people wish to quit the drug scene and its internal normative rules.

我国房地产登记机构赔偿责任的法律思考

房地产登记机构的赔偿责任是我国当前不动产物权登记立法中的重大、疑难问题之一,理论上对此也多有纷争。从我国房地产登记的立法精神以及实践做法来看,登记机构的赔偿责任应当认定为以过错归责为原则的国家赔偿责任。在共同责任形态下,应当根据侵权责任法的原理科学分配登记机构的赔偿责任形态。同时,应当借鉴国外经验,适当限制房地产登记机构的赔偿范围,并建立以专项赔偿资金为主体、以追偿和罚款所得为补充的资金保障制度。

表见代理的构成,需要本人具有归责性。归责性的要件地位之确立,在价值实现和逻辑贯彻之外,尚有着重大的方法论意义。归责性具有程度之维,其要件地位的确立,使得一项比较权衡的框架得以建立,从而可通过本人归责性程度与相对人信赖合理性程度的比较权衡,来决定相应的法律构成和效果。从解释论的角度看,对于《合同法》第49条之规定,透过文义、历史、比较法等解释方法,可确立本人归责性的要件地位。
