In March 2007 HM Treasury published its latest thoughts on Financial Inclusion (HM Treasury Financial inclusion: The way forward, 2007), highlighting that after 10 years of activity in this area there is still growing evidence that the market is not meeting everyone’s needs, with significant numbers of people not able to access basic financial services such as credit. This continues alongside media stories of further bank branch closures in some areas, branches for high income earners only in others and the continuing controversy surrounding charges. This article will, with reference to the UK government’s financial inclusion agenda assess whether the time has come to implement legislation mandating that UK credit institutions have regard to customers needs when making decisions that could affect those most at risk from restricted access to financial services. These needs can include both access to affordable credit and access to financial services, such as bank accounts. The paper will use as a comparator the much talked about United States Community Reinvestment Act, enacted in 1977 and since amended, hailed (Barr New York University Law Review 80:513, 2005) and criticised (Macey and Miller Virginia Law Review 78:291, 1993) in equal measures, designed to ensure that depository institutions meet the credit needs of the communities they serve, particularly low and moderate income areas. Although not designed to tackle the perceived problems identified by the UK government, would enactment of similar legislation do more to achieve these aims that the activities undertaken so far. The article proposes that one way in which to improve the fight against financial exclusion is to improve the disclosure requirements of financial institutions, forcing them, where necessary, to provide data on lending patterns in disadvantaged areas.

当代中国法理学的发展与法律本质理论的变迁与进步有着千丝万缕的联系。我国学者从坚持法律的阶级性,到认可法律是阶级性与社会性的统一,再到承认法律本质的层次论,法律本质理论在争鸣和反思中不断丰富。在此基础上,本文从研究意义、逻辑起点、基本工具、经世目的等方面对法律本质研究进行了再思考,最终认为,正义才是法律的本质。  相似文献

Peace education has been offered to children for decades, but those curricula have been only minimally guided by children’s developmental stages and needs. In this article, the authors apply their research on children’s developmental understanding of peace along with peace education principles and Vygotsky’s sociocultural theory to present recommendations for educating children about peace at six developmental levels. Two sample lesson outlines dealing with communication skills and personal peace are provided, and implications for future research and practice in different contexts are discussed.  相似文献

The extant literature has offered two competitive implications of revenue diversification: revenue stabilisation and fiscal illusion. Stabilisation helps governments have less revenue volatility, while fiscal illusion expands tax burdens through the increase in expenditure. The competitive views on revenue diversification leave a niche to explore the association between revenue diversification and debt levels in local governments. We estimate the static and dynamic effects of revenue diversification on both short-term and long-term debt levels in 150 fiscally standardised cities. Our findings show that local governments with greater revenue diversification are more likely to reduce short-term debts while expanding long-term debts. The findings imply that a stabilised revenue structure helps local governments better manage operational budgets but also invest in capital projects with greater debt capacity.  相似文献

Local governments increasingly use online strategies to strengthen political participation of citizens in policy and politics. Young people, however, are generally under-represented. This article studies age patterns of participation across offline and online forms of action to test whether online initiatives are able to overcome this age bias. We first report a case study of online and offline problem reporting to local authorities. We find that simply going from offline to online participation reinforces rather than mitigates age bias. We then report a case study of message posting on an online political forum. In this case, age bias disappears. In contrast to the traditional instrumental modes, a forum is an expressive form of online participation. The young seem to value the act of participating over the outcomes of participation. For practice, these findings suggest a need for participation policies that speak to these expressive needs of young. In recent years, social media have reinforced the potential for expressive participation.  相似文献

In his book The Imaginary Institution of Society, the French philosopher Castoriadis wanted to explain the radical change of societies and their diversity; the social imaginary matters, and explains social change. But what is it today? The Castoriadis's answer is mainly a criticism of the imaginary of the bureaucratic society (perfect anticipations). He hoped more autonomy. In the paper, it is proposed this interpretation of the imaginary of the city: The main myths are personal strength, chance (here the reference is Ulrich Beck's book The Risk Society), and individual happiness (the reference being the works of the French philosopher Lipovetsky). One is able to explain the discrepancy between public policies (including city planning) and the real social needs. It exists because the doctrines used lag behind the "social imaginary significations". The concerned fields are the beauty of cities, spatial segregation, women in the city, environment, drugs, etc.  相似文献

Public organizations need to custody and protect heritage assets. This article questions the appropriateness and quality of the unique International Public Sector Accounting Standards (IPSASs) in delivering financial reports that meet the user needs in regard to heritage assets. By refining the earlier findings in Italian local governments with data from a completely different region being Flanders, the results highlight that the IPSASs are lacking an important area of expectations from a relevant user need perspective, being the local ruling politicians. Finally, current article improves previous publication by examining the different kinds of responses in the light of certain municipal characteristics.

The case for Universal Basic Services (UBS) is a recent idea that is attracting much attention. This article provides a theoretical justification for extending the delivery of public services, as an alternative to the longer‐standing argument for Universal Basic Income (UBI). It rests on human need theory and the concept of provisioning systems. Both recognise the irreducible heterogeneity of consumption, the multi‐faceted nature of human needs and the variety of systems on which we all depend. Both recognise the importance of shared systems and mutual benefits. The final part restates the case for social rights or entitlements to the satisfaction of basic needs and for collective responsibilities to meet them to serve the values of equality, efficiency, solidarity and sustainability.  相似文献
