宽严相济政策与公诉案件质量考评指标

公诉案件质量考评指标对提高案件质量,在公诉工作中贯彻宽严相济的刑事政策,具有一定的促进和推动作用。然而,目前我国公诉案件质量考评指标,主要局限于对案件数量指标的考评,无法体现宽严相济政策对公诉案件的质量要求。为此,需要根据宽严相济政策对公诉案件的司法精神、证据意识、案件处理方式、办案技巧的要求几方面来改变考评指标,建立"以质为主、以量为辅"的案件质量考评体系。     

Introduction of a standardized "paternity index" for the statistical evaluation of blood group findings in paternity testing

The introduction of a standardized paternity index (PI) for the statistical evaluation of blood group findings in cases of disputed paternity is proposed and explained. By using the PI $\text{X}\text{Y}$ as parameter, it is not necessary to give the information of the probability of paternity in percent. The PI includes the full information of the blood group findings. In addition to that, by using the suggested standardization based on the probabilities of error according to Schulte Mönting and Walter the test volume is also taken into account. The interpretation of the mathematical result is given by verbal predicates, the limitations of which are orientated by the verbal predicates for the probabilities of error according to Schulte Mönting and Walter, published by us elsewhere. Besides the essential fact that the test volume is taken into account, the most important advantage of this procedure is that the mathematical result is involved in the court decision only by the PI (which is free of any valuation) and its verbal predicate and not by sometimes relatively high percentages, which may be misunderstood by laymen.     

平板玻璃受热后折射率的变化规律初探

目的探索平板玻璃受热后折射率的变化规律。方法首先采用差示扫描量热仪测定玻璃样品的转变温度Tg,将样品加热至不同的温度(温度范围从室温到Tg以上),自然冷却至室温后再用GRIM3测量折射率。结果加热温度在Tg以下时,玻璃的折射率基本不变,加热温度在Tg以上时,折射率有明显变化。结论对于从火灾和爆炸现场提取的玻璃,在进行折射率比对时应当考虑现场高温对测量值的影响,并进行必要的修正。

The design of equipment and thermal routines for annealing glass particles

Equipment for annealing casework sized glass particles is described. Investigations were carried out using a simple muffle furnace, a temperature programmed furnace and a metal sample holder. Because they produced a uniform and reproducible thermal environment, best results were obtained from a combination of the temperature programmed furnace and the metal sample holder. Refractive index changes for window and toughened glass specimens were investigated and a simple, reproducible annealing routine for casework was devised.

论我国刑法改革的价值取向

未来我国刑法改革应当强化刑法的明确性和刑罚的轻缓性,重视刑法的行为评价和引导功能,弱化刑法的威慑功能,切实保障人权;同时积极推进刑事法网的严密化和法益保护的早期化,积极防卫社会,努力实现保障人权与防卫社会两大价值取向的动态平衡。     

Determining the Refractive Index Variation within Panes of Vehicle Windshield Glass

Refractive indices of seven double‐paned vehicle windshields were measured to assess the variation across the pane of glass and to evaluate collection techniques for known glass standards by comparing false negative rates. Measurements were made using a Foster and Freeman GRIM3 instrument, and a minimum of 240 measurements were made per pane. The mean SD of the windshields was 0.00004. It was further determined that collecting a known sample from two different sections of a shattered windshield gave the lowest rate of false negatives when using ± 2 standard deviations to estimate the RI variation of the known glass. Additionally, refractive indices often were highest in the center of the windshield and decreased toward the left and right edges; in approximately half the sample set, the two panes of a single windshield were differentiated by one or more properties.
