Improving Policy Effectiveness: Land Use Planning in a Devolved Polity

Improving public policy efficiency and effectiveness in land use planning is an established priority on the prevailing political agenda in the UK. Practical measures to enhance policy formulation in local land use development plans in Scotland offer an interesting case study of an attempt to improve policy consistency, and to secure efficiency gains in policy authorship. This article considers the specific focus on the drafting stage of public policy‐making drawing on insights provided by research into the production of model policies in Scotland. It questions the extent to which such an initiative will promote a more robust public policy‐making discipline in light of the policy cycle. The discussion of the case study illustrates a practical attempt by central government to enhance public policy‐making at the local level, while raising questions about the dangers of invoking a technocratic and instrumentalist approach to policy analysis.     

生育权初探

生育权是目前社会关注的问题,也是实践中遇到纠纷比较难解决的问题。生育权是指具有合法婚姻关系的男女依照法律规定享有决定是否生育、何时生育和生育子女数量的权利。侵犯生育权应承担相应的法律责任。     

回到中国——转轨经济法的存在及其价值

上世纪九十年代,中国经济法抛弃了早期的计划经济法范式,转向西方寻求资源,形成了市场经济法范式,认为经济法是弥补市场缺陷之法,而当下中国还处在计划权力经济向市场法治社会转轨过程中,中国的问题不是市场高度发达到出现了自身无法解决的缺陷,而是市场发育不全,经济发展处处受到权力因素的掣肘。市场经济法范式与转轨现实脱节,存在严重的正当性危机。如果要问中国法学向何处去?经济法学的回答是:回到中国,回到转轨现实。中国经济法学需要也正在进行第二次范式转换,转换到转轨经济法范式,推动权力经济向法治经济转轨。     

论素质导向的行政管理专业人才培养——理论与实践的复合审视

本文将行政管理专业的就业状况、行政职业素质需要、实务者函询等实践层面的数据与行政学理论结合起来，以在专业培养的探索中体现行政学实践性的学科本质。通过分析行政管理专业的就业现状，发现人才培养思路必须进行适当调整，关键出路之一在于以专业素质为核心的培养目标的梳理和确定，而目前这方面的分析因缺乏理论观照还不够系统。结合职业素质的分析成果，本文初步提出了行政管理专业的六种素质，以及行政管理专业素质培养的三个原则，供学界参考。     

The Universal Adversary will attack: pigs,pirates, zombies,Satan and the class war

This article explores a category to have recently emerged out of the national security state: the Universal Adversary. The category appears in emergency planning documents and suggests a new way of thinking about the enemy that is becoming embedded in the logic of security and emergency. However, the radical expansiveness of the category offers new possibilities for thinking about the “universality” with which the enemy of bourgeois order has historically been considered and offers new ways of connecting this universality with a particular figure: the disgruntled worker.     

Coordination outside formal organization: consensus-based decision-making and occupation in the Occupy Wall Street movement

Previous work has shown that a vital component for successful collective action is formal organization, in particular because it facilitates internal coordination. But how is coordination achieved in the absence of formal organization? To answer this question, this article presents findings drawn from an ethnographic study on Occupy Wall Street (OWS) in New York City. It first introduces the concept of ‘autonomy’ to discuss the particular challenge faced within the decentralized structure of OWS of developing coordination. It then shows how the practice of holding mass assemblies and the occupation of Zuccotti Park itself each served, in incidental and unintentional ways, as mechanisms of coordination. These findings confirm previous work on the importance of coordination and build upon it by demonstrating that not only is coordination possible outside formal organization, but that it is also in some cases achieved without conscious intention. This suggests the utility of moving beyond an overly rational understanding of social action by acknowledging the inevitability of unforeseen outcomes.
