手机短信诈骗犯罪的特点与类型分析

利用手机短信进行诈骗已成为一种新的诈骗犯罪类型。手机短信诈骗犯罪是指以非法占有为目的,用虚假事实或者隐瞒真相的方法向手机用户发送虚假信息,以骗取手机用户财物数额较大的行为。本文从手机短信诈骗的犯罪构成、完成形态及危害结果入手,对手机短信诈骗犯罪的特点和类型进行探讨。

我国刑法将侵犯商业秘密罪规定为结果犯,给司法实践带来许多困惑.实践中司法机关被拖入重大损失的认定上,导致对权利人保护不力,使一些本应由刑法调整的侵犯商业秘密行为未得到应有的处理,应改变将侵犯商业秘密罪规定为结果犯的立法模式.     

Linking democratic anchorage and regulatory authority: The case of internet regulators

Scholars and practitioners have repeatedly questioned the democraticness and the authority of transnational multi‐stakeholder organizations, especially those that regulate the internet. To contribute to this discussion, we studied the “democratic anchorages” and the regulatory authority of 23 internet regulators. In particular, we conducted a fuzzy‐set qualitative comparative analysis assessing whether and which anchorages correspond to necessary and/or sufficient conditions for exerting regulatory authority. Our results show that strong anchorage in democratic procedures is specifically relevant for this outcome. Further, we find that weak anchorage in democratically elected politicians leads to high regulatory authority, confirming the significance of non‐state actors in this policy field. More generally, our findings support but also qualify expectations about the compatibility and mutual reinforcement of democratic quality and regulatory authority at the transnational level.     

An analysis of self-reported suicide attempts and ideation in a national sample of incarcerated individuals convicted of sexual crimes

ABSTRACT

Suicide is the leading cause of preventable death in US jails and prisons, with rates three to nine times higher than those of the general population. Although suicide in correctional settings has been recognised as a serious problem, the research on suicide among incarcerated individuals remains limited. Individuals who have committed sexual offenses may be at an elevated risk for suicide. Specifically, they have been found to report high rates of hopelessness and depressive mood, and approximately 14% of individuals convicted of sexual offenses have reported a suicide attempt at some point in their lives. Most of these data are based upon official reports and may represent an underreporting of the true prevalence of the problem. The current study provides an analysis of the prevalence and factors associated with self-reported suicidal thoughts and behaviours in a large national sample of individuals convicted of a sexually based crime. Overall, 17.9% of the offenders reported an attempted suicide in their lifetime, 15.1% reported experiencing suicidal ideation but never made an attempt. Risk factors for suicide attempts and ideation for this population are reported. The findings are discussed in the context of suicide prevention and intervention efforts among those who have committed sex offenses.

略论行政违法的概念及其构成要件

行政违法是指行政主体及行政公务人员违反行政法律规范但尚未构成犯罪而应当承担行政责任的行政行为。其构成要件包括:主体为行政主体及行政公务人员,所侵害的是受行政法律规范所保护的行政关系,实施了违反行政法律规范的行为,实施行政违法行为时主观上有过错。探讨行政违法行为,对于追究行政主体及其公务人员的法律责任,推进依法行政、建设法治政府等具有重要意义。     

“Value Grabbing”: A Political Ecology of Rent

This paper aims to redress the under-appreciated significance of rent for political ecological analysis. We introduce the notion of value grabbing, defined as the appropriation of (surplus) value through rent. A concept that is analytically distinct from accumulation, rent is both a social relation and a distributional process that is increasingly central to the reproduction of contemporary capitalism. Emphasis is placed on the “grabbing” of value in order to shed light on the processes at work by which surplus value is distributed unevenly between different classes and fractions of classes. A focus on rent within political ecology, we argue, can help us distinguish between two organically related but analytically distinct “moments”: (a) the creation of property rights that establish rent relations and (b) the struggle over the appropriation and distribution of surplus value generated by the rent relation itself. We explore some of the implications of this perspective for understanding new forms of socio-ecological struggles and their varied relations to the state. We maintain that a value-grabbing perspective has far-reaching consequences for political ecology, as it provides a sharp conceptual tool for situating a wide range of socio-ecological conflicts and movements as class struggles over value appropriation and distribution.     

Youth organizations,citizenship, and guidelines for tourism in the wake of mass tourism in Finland

This paper will study tourism as a site of citizenship formation with a particular focus on the arrangements and lived practices of citizenship in the Finnish Youth Organization and in a sub-section of Northern Ostrobothnian Travel Club between 1965 and 1985. From the perspective of the model of citizenship in Finland, modern mass tourism was not unproblematic and it was uniquely incorporated in the program and activities of the Finnish Youth Organization, underlining the wider social and civic utility of tourism. In this paper, the examination of archive materials from this particular historical period will provide a nuanced understanding of the mutual formation of citizenship and tourism at multiple geographical scales and insight into how the model of citizenship has been of great importance for mobile people in many ways.     

The rise of the far right in Greece and opposition to ‘othering’, hate speech,and crime by civil and civic organizations

This article focuses on forms of opposition to ‘othering’ and far-right politics in present-day Greece. This opposition takes a variety of forms, comes from a range of actors, and is motivated by a number of concerns with differing assessments of what should be done. More specifically, the article focuses on the far right in Greece and discrimination, hate speech, and hate crime against the ‘other’ from the perspectives of those who are active in mobilizing against racism and counteracting the country’s populist and neo-nationalist turn. Concentrating on the forces opposing discrimination, the analysis describes present-day social movements and actions from grassroots to governmental level, their strategies and politics, their diversity of thought and action, and their contribution in providing the resources for social change, and the production of new meaning in the context of anti-racism in Greece. Trying to provide answers as to how social movements and activists produce meaning, we argue that activists develop less intentional, inadvertent meanings which emerge in the course of the not-always conscious schemas of their struggle. This calls for a more dynamic explanation of the relationship between practice and meaning-making in social movement contexts.     

Interorganizational Collaborations for Humanitarian Aid: An Analysis of Partnership,Community, and Single Organization Outcomes

Abstract

This article explores collaborative activities across organizational and sectoral boundaries. Interorganizational collaborations are an increasingly common setup to address societal needs; however, current research lacks insights into such collaborations and their outcomes. This study contributes to the existing literature by assessing empirically perceptions of interorganizational collaboration outcomes, considering different dimensions that should be measured when planning and performing tasks of social interest. The article is set in the context of disaster relief, where actors from different humanitarian relief organizations within the public and nonprofit sector engage in collaborative activities. I describe how interorganizational collaborations create outcomes for (1) the partnership structure that is established, (2) single organizational members involved in the collaborative activity, and (3) the community targeted by the interorganizational operation.
