媒体监督与司法独立的法理分析

司法独立是法治国家的要求,又是实现司法公正的保障。在实践中,人们对司法公正的期待日益迫切,对作为公权力的司法权的腐败尤为关注。司法权需要监督,但监督要有一个度。由于我国缺乏对媒体的规范,媒体在行使监督权过程中干预了司法,影响了司法独立,产生了媒体监督与司法独立的冲突。要解决这一冲突必须了解冲突产生的背景及原因,找出解决冲突的合适的方法,从而将媒体监督与司法独立之间的冲突转化为良性互动。     

论取消我国民事检察监督制度

民事检察监督作为我国民事诉讼的一项重要制度 ,自 1991年以来获得了一些发展 ,但是现行民事检察监督存在着以下问题 :检察机关如何发现生效裁判的错误 ,检察监督是否真正达到了立法者所期望的效果 ,检察监督对当事人有无实际意义 ,检察机关自身行为谁来监督等。此外 ,检察机关的监督人地位与民事诉讼改革呈现出来的目标趋向当事人主义模式存在着无法兼容的矛盾。基于以上原因 ,本文认为应当取消民事检察监督     

I tweet like a white person tbh! #whitewashed: examining the language of internalized racism and the policing of ethnic identity on Twitter

Using data extracted from Twitter, this study analyzes the English expression whitewashed as it occurs with and without a hashtag (e.g.: #whitewashed vs. whitewashed) through corpus analysis. As whitewashed has evolved to take on racial connotations to mean being too assimilated to a dominant white culture, I investigate whether the presence of a hashtag has an effect on how often this racial meaning of English whitewashed is employed. Based on collocative data, the findings suggest that the use of #whitewashed carries a meaning predominately informed by internalized racism and works to bind ethnic minorities to racial stereotypes. The study explores #whitewashed as a metacomment on human behavior, as #whitewashed serves to characterize beliefs about what actions are considered socially marked when performing an ethnic identity. In contrast to #whitewashed is the colloquial expression fobby, which characterizes an individual as being “too ethnic”; both (#)whitewashed and (#)fobby are discussed in tandem in this paper, for they create a double bind that marks the boundaries of ethnic identity. In this paper, I suggest that Twitter users mediate the demands of internalized racism by using #whitewashed to mark their tweets.     

The dynamics of doping: Lance Armstrong,the United States Anti‐Doping Agency and the regulatory governance of professional cycling

On 10 October 2012, the United States Anti‐Doping Agency published an investigative report on the use of performance‐enhancing drugs by professional cyclist Lance Armstrong. The report paints a disconcerting picture of the doping program that Armstrong and his US Postal Service professional cycling team managed to carry out for several years, despite being subject to many inspections. It contains a wealth of unique empirical data, including a large number of affidavits. In this article, we use this data to answer the question of how Armstrong was able to prolong prohibited behavior. In doing so, we focus in particular on the interactions between Armstrong and the many doping inspectors he encountered. Our analysis results in a variety of answers to this question. First, inspectors were confronted with an inspectee who behaved as an “amoral calculator” and acted strategically. The strategies of inspectors were not adequately attuned to such behavior. Second, the team's internal professional control was neutralized by various factors, including its strict hierarchy and the many friendships within the team. And, finally, the environment created strong incentives to start doping and subsequently deny doing so. We argue that the dynamics underlying doping necessitate a combination of measures to regulate the use of performance‐enhancing drugs in the field of professional cycling and beyond.     

Negotiation and Conflict Resolution Education in the Age of the MOOC

Even as online learning is increasingly embraced by institutions of higher education, the past decade has seen the arrival of yet another new educational vehicle: massive online open courses (MOOCs). These courses are designed to disseminate knowledge at an unprecedented scale — even as they engender concerns about quality, learning efficacy, and the future of higher education. In this article, I discuss the MOOC phenomenon and describe a MOOC on negotiation that I developed and taught, exploring the advantages that such a course offers for negotiation and conflict resolution education in particular.     

廉洁政治建设视野下的纪检监察公共关系构建

构建纪检监察公共关系是纪检监察机关综合运用公共关系理论争取公众支持,扩大社会参与,接受群众监督,塑造自身良好形象的一种职能活动,也是保持党同人民群众血肉联系的创新之举,更是以反腐倡廉实际成效推动廉洁政治建设题中应有之义。在廉洁政治建设视野下构建纪检监察公共关系,需要建立健全反腐倡廉工作公开机制,营造崇廉尚洁的社会氛围;拓展创新反腐倡廉工作参与机制,搭建科学有效的平台体系;健全完善反腐倡廉工作监督机制,提升队伍建设的内外合力。同时,从健全组织体系、掌握工作原则、注重系统培养等方面着手,增强纪检监察工作的针对性和实效性,从而为做好新形势下纪检监察工作提供有力保障。     

关于反腐倡廉体制机制建设若干问题的新思考

反腐倡廉建设必须建立健全一套有效的制约和监督权力的体制机制,这是破解腐败高发、多发的基本途径。只有组建一个由预防腐败署、纪检监察机关、司法机关构成的预防与惩治腐败完整体系,才能充分发挥结构科学、运行规范、监督有效的功能,形成一个能够保证各职能机关各负其责、相对独立、依法治理的运行方式。完善干部重大事项报告制度、巡视制度和"一案双查"等制度,逐步形成不敢腐的惩戒机制、不能腐的防范机制、不易腐的保障机制,才能有效遏制腐败。同时把构建决策科学、执行坚决、监督有力的权力运行体系,作为关住权力的制度笼子。这是我们党实现依法治国的国家战略和顶层设计的新思考,是跳出历史周期律支配的新路径。     

高校纪委监督同级党委的困境与出路

高校纪委监督同级党委作为党章赋予各级纪律检查机关的一项重要职能,是强化党内权力监督制约机制的重要手段,是贯彻落实党风廉政建设责任制的内在需求,是确保高校科学发展的坚强政治保障。针对当前纪检监察体制机制不顺、监督制度设计滞后、部分监督对象接受同级监督意识不强、纪委监督乏力等问题,高校要进一步明确党委主体责任,建立健全高校权力运行机制,不断完善监督机制,并培育监督文化,营造同级监督的良好环境,从而最大限度提高高校纪委监督同级党委的效率和质量。     

社会工作对青少年网络成瘾问题的干预

青少年网络成瘾给青少年的身体、心理和社会性发展带来了极大威胁。究其原因,主要是青少年身心发展不成熟、网络的极大吸引力以及家庭教育失位、学校教育失力与社会环境的复杂共同作用的结果。因此,社会工作者要通过各种方式做好预防工作,并在正确判断青少年网络成瘾＂真假性＂的基础上,激发青少年治疗网瘾的动机,以有效治疗网络成瘾的青少年,并评估成效,跟进服务。
