On The Outside Looking In: Reflections on the Role of Inspection in Driving Up Quality in the Criminal Justice System

This article examines the role of external inspection in enhancing the quality of a criminal justice system. It seeks to answer six foundational questions: how should we understand the nature and purposes of criminal justice inspection? what methodologies ought it to employ? who should do it? what values should it respect? how much does it cost? and does it ‘work'? The article reveals that the difference between inspection and other forms of scrutiny activity is largely a matter of emphasis; that the same is true of the difference between inspection and research; that ‘lay’ involvement in inspection can be beneficial; that independence is a core value for inspection, albeit one that is best understood as independence of judgement; that transparency is a further key value but not always honoured; and that evidence that inspection improves service delivery and hence justifies its costs is weak and further research is needed.     

论纪检监察机关办案方式的调整——以刑事诉讼法的最新修正为背景

2012年刑事诉讼法修正案将对纪检监察机关的调查取证活动和现有的办案模式产生一定的影响。为实现纪检监察程序与刑事诉讼程序的无缝对接,需要对纪检监察机关的调查取证方式和办案模式进行必要调整。在调查取证方面,应当提高调查取证程序的规范性,加强对被调查人基本权利的保障,保证所取证据在刑事诉讼中的证据能力,必要时还应对取证程序的合法性进行证明。在办案模式方面,应当与检察机关建立新型的合作分工关系,在证据收集及程序进行方面对检察机关予以协助,并参与相关的诉讼活动。     

Disrupting Conventional Law Firm Business Models using Document Assembly

Document assembly software is a technology that is fundamentalto disrupting law firms. This article uses the framework setout by Clayton Christensen in The Innovator’s Dilemmaand subsequent books to examine the range of business modelsthat use document assembly software, from those that are sustainingin relation to law firms to those that are disruptive in relationto law firms. It looks at three barriers that slow down thepace of disruption: a shortage of the right people, rules againstunauthorised practice, and inadequate capitalisation of lawfirms. These barriers will be overcome on a piecemeal basisas disruptive forces advance and undercut the billable hour.     

高校学生网上评教的有效性探讨

随着高校教学质量评估活动的开展,学生网上评教作为一种课堂教学质量评价、监督、考核机制,正越来越多地在国内高校课堂教学质量监控中被采用,其积极意义受到各高校的肯定。科学地制定课堂教学质量评价指标体系是学生网上评教有效性的前提,积极倡导学生的广泛参与是提高网上评教有效性的基础．客观地统计、分析和及时反馈评教结果是提高网上评教有效性的关键。     

论摹仿签名字迹的检验分析

摹仿签名字迹属于伪装字迹的一种,是文字检验工作中一个重点和难点。新形势下摹仿签名字迹的手段有所变化。当前摹仿签名字迹从摹仿手法上可分为五类:复制摹仿、临摹、套摹、练习摹仿、记忆摹仿。由于摹仿手法不同,特点不同,对摹仿签名字迹必须采取相应的检验方法进行检验分析。     

浙江省江山市2005—2008年非法行医行政处罚案例分析

为对非法行医现象和行政处罚情况进行分析,从而为做好非法行医查处工作提出建议。我单位通过对江山市2005-2008年共86起非法行医行政处罚案例,从案由、违法主体类别、处罚情况等进行研究。研究结果显示,86例行政处罚中,以农村和城乡结合部为据点,以未取得《医疗机构执业许可证》擅自执业最多,其次是使用非卫生技术人员从事医疗卫生技术工作：主体类别以个体为主;罚款平均为每件次2994元,处罚额度过低。打击非法行医任务重、难度大,社会关注度高,需要加大执法力度,加强部门联动,加快社区卫生服务能力建设和完善合作医疗制度,强化培训,实行责任追究,建议修改相关法律法规,有效打击非法行医。     

Forensic investigation of cross platform massively multiplayer online games: Minecraft as a case study

Minecraft, a Massively Multiplayer Online Game (MMOG), has reportedly millions of players from different age groups worldwide. With Minecraft being so popular, particularly with younger audiences, it is no surprise that the interactive nature of Minecraft has facilitated the commission of criminal activities such as denial of service attacks against gamers, cyberbullying, swatting, sexual communication, and online child grooming. In this research, there is a simulated scenario of a typical Minecraft setting, using a Linux Ubuntu 16.04.3 machine (acting as the MMOG server) and Windows client devices running Minecraft. Server and client devices are then examined to reveal the type and extent of evidential artefacts that can be extracted.     

The world at their fingertips? The mental wellbeing of online distance-based law students

In recent years there has been an increased interest in student mental wellbeing within higher education. In terms of legal education, much of this has been focused upon the United States (US) and Australia, with a lack of United Kingdom (UK)-based empirical data available. Although there is now extensive provision of online distance learning options available to UK (and other) law students, there is a notable lack of research into the possible challenges which are specific to this form of tertiary offering. This paper seeks to contribute to the development of research in this area by reporting upon, and analysing, preliminary data gathered from an empirical study of the mental wellbeing of online distance learning law students.     

创新基层痕迹检验工作开展的策略分析

痕迹检验作为刑事案件侦破过程中的关键环节,主要是通过对刑事案件现场或者疑似现场进行与犯罪行为相关的痕迹物证的发现与提取,并借助相应的技术手段获取其中包含的重要信息,为案件侦破提供相应信息指引和佐证。随着痕迹检验理论和技术的丰富,近年来我国基层痕迹检验工作开展的效率和效果得到了明显的提升。但同时需要注意的是,现代化技术犯罪行为的增加以及罪犯反侦查技术的使用,使得基层痕迹检验工作面临的压力不断加大。因此,基层痕迹检验工作需要通过有效的创新加以推进,从而适应形势发展的要求。
