宪政与法治是国家实现持久善治的正道

时代发展到今天,宪政信念与法治理念已经根植于现代民主社会的政治文化之中,宪政实践和法治建设之于国家实现善治的保障价值日益被人们所普遍认知;宪政、法治、民生在政治国家的有机结合与生动实践,虽会因各国发展阶段、发展层次、发展水平的不同而有所差异,但就本质和信念而言,概不应因意识形态的差异而予以随意取舍;宪政、法治、民生三者在清明世界之中互为表里、互为因果、同为一体,考其三者的发育程度、实质品位和取舍存废,则大致可知国之兴废的大势;正是它们之间的逻辑运动才一而再、再而三生动实在地演绎着人类社会和政治国家命运迥异的盛世悲歌。     

Juvenile convicts and their colonial familial lives

Convicts were transported from Britain to Van Diemen’s Land from 1803 until 1853. Approximately 10 000–13 000 juveniles were among the 148 000 convicts transported. This article has traced the lives of female and male juvenile convicts transported, who were sentenced at the Old Bailey (the Central Criminal Court in London), and voyaged to Van Diemen’s Land. By exploring individual lives, and contextualising their experiences, it is possible to go beyond the circumstances of offending–through to their punishment period, to their lives upon release. This article will focus on one aspect of juvenile convict lives post-transportation–their familial life. The method of nominal record-linkage has been used across a variety of criminal and non-criminal records (including civil records and newspapers) in order to build up a picture of these young offenders. Going beyond the institution and focusing directly on female and male juveniles is important in understanding the lives of this unique group. From the behaviour of the juvenile convicts themselves, to the decisions of the administrators and the conditions of the penal colony into which they were thrust; were these female and male juvenile convicts able to form ‘settled’ colonial lives and which factors inhibited or facilitated this process?

我国清朝法在官吏的录用条件、日常监督考核程序以及对官员保持品味义务等方面均有详实的规定和具体要求。我国台湾地区保持公职人员品味义务的规定过于原则,可操作性不强。为构建现代警务制度,应在参酌域外警察法先进经验的基础上,不断健全和完善我国的警察法相关制度。     

终身监禁是将“牢底坐穿”吗？——终身监禁变更执行的法教义学分析

终身监禁是将“牢底坐穿”吗？对此需要从法教义学的视角对终身监禁变更执行中的争议问题进行分析。终身监禁不是《刑法》第50条第1款死缓变更的例外规定，被判终身监禁的罪犯在死缓考验期间有重大立功表现的，应当减为25年有期徒刑。终身监禁中“不得减刑”的规定不是《刑法》第78条“可以减刑”的例外规定，而是该条“应当减刑”的例外规定，罪犯在终身监禁执行期间有重大立功表现的，不能减为有期徒刑，而应继续执行终身监禁。终身监禁不是《刑事诉讼法》第265条暂予监外执行的例外规定，对于被判终身监禁的罪犯可否暂予监外执行，应当根据《刑事诉讼法》第265条的规定予以确定。总之，判处终身监禁并不意味着罪犯一定要将“牢底坐穿”，执行终身监禁则意味着罪犯要将“牢底坐穿”。     

生命权、身体权、健康权的法定救助义务

生命权、身体权和健康权是自然人享有的最基本的人格权,应受到最大限度的保护。当自然人处于紧急危难状态时,负有法定紧急救助义务的组织或个人应履行紧急救助义务,否则需承担相应的法律责任。鼓励其他负有一般救助义务的主体进行紧急救助,妥善发挥好人条款的积极引导作用,对改善见死不救的不良社会风气,弘扬社会主义核心价值观必将产生积极的影响。     

《民法典》诚实信用原则对不当商标申请行为的规制

诚实信用原则是民法的基本原则,同样贯穿于商标申请、使用等行为的各个方面,民事主体无论是申请注册商标还是商标使用都需严格遵守诚实信用原则。国家知识产权局商标局以《商标法》第10条第1款第8项的"其他不良影响"对系列"火神山""雷神山""李文亮"商标的注册申请进行"管控"。但"不良影响"具有严格的适用条件,而非商标申请行为可能会产生消极、负面影响。运用"不良影响"对不当商标申请行为进行管控不符合商标法的立法本意,以违反了诚实信用原则进行规制更加合适。     

Understanding the dynamics of good neighbourliness under Rawlings and Kufuor

It is widely recognised that leadership influences relations between neighbouring states in international affairs. This article seeks to further illuminate the relationship between leadership idiosyncrasies and the nature of Ghana’s neighbour relations under Presidents Rawlings and Kufuor. The argument is that, while political institutionalisation and the international environment may influence neighbour relations to some degree, leader idiosyncrasy is an important intervening variable. Indeed, based on the findings, the international environment may have had less influence on Ghana’s neighbour relations in the period under study (1981–2008) than conventional wisdom suggests.

One of Prime Minister Blair's last speeches was on his governments relationship to the media, and the at times damaging impact of the 'sensation hungry media' on every aspect of public life, many of whom were too frightened to take on the 'feral beasts'. He argued that his government had to attempt to deal with the media power, that 'spin' is an attempt to handle that power, that the media attack private life and that in the end the media must manage themselves.
