The mainstream scholarship assessing EU external action frames the subject in terms of success or failure to achieve the intended effects, the latter generally defined against the EU's own stated objectives. Resting on a tacit assumption that EU engagement in third states is a good thing, these analyses are framed as ‘positive impact or no impact’ and tend to neglect the wider effects of EU policies. This article maintains that EU external action may and often does have unintended consequences, thus expanding the study of EU impact beyond the sheer study of EU effectiveness. Drawing on broader literature on unintended consequences, the article proposes a framework for analyzing unintended consequences of EU external action. It synthesizes and adapts to the EU context a classification of unintended consequences and, in order to illustrate its utility, applies the proposed framework to three empirical examples derived from EU neighbourhood, migration and trade policies. 相似文献

Media coverage of Supreme Court decisions is not well-understood, with studies typically focusing on features of decisions such as issue area and opinion authorship, and ignoring the political and legal importance of those decisions. Because the Court is both secretive and esoteric, and because it does not engage in traditional public relations activities, media must proxy importance by looking to available cues, such as interest group participation. Importantly, some indicators of importance are available before a decision is rendered; thus I examine both pre- and post-decision media coverage of cases. I show that expected legal and political impact drive media coverage of Court decisions, and that the decision-level features that prior studies have focused on are much less important in determining coverage than has been previously thought. 相似文献

This article assesses the utility of impact assessments (IAs) as an effective tool for mainstreaming. Specifically, it analyses whether the European Union's (EU's) system of integrated impact assessments (IIAs) contributes to the realization of six mainstreaming objectives defined in the EU treaties. The article first studies whether the legal framework for the EU's system of IIAs makes it a viable tool for mainstreaming. It then proceeds with an empirical analysis of 35 IAs to assess the extent to which mainstreaming objectives are taken into account in practice. The analysis shows that all six mainstreaming objectives have a place within the IIA system, but the system does not ensure systematic consideration of them. There is considerable variation across mainstreaming agendas, as well as across Directorates‐General. The article concludes that the IIA system is no panacea for mainstreaming, and proposes changes to the institutional framework to improve its mainstreaming potential. 相似文献

Post-9/11, and especially with the dramatic rise of Islamic State in Iraq and the Levant (ISIL), the author advocates a collective right to security. Plotting a course through state absolutism and liberalism, one finds communitarianism as a philosophy to support this right to security. The communitarian right to security is based on an interpretation of European human rights law, particularly positive duties of the state, to protect the rights to life of individuals from violations by non-state actors such as suspected terrorists. This study examines the adjustment of offenders from shock incarceration programs (boot-camp prisons) during community supervision over a 1-year followup period in five states. Their performance is compared to comparison groups who were eligible for the shock program but did not attend. An index was used to quantify the positive activities of offenders. The results provide little conclusive evidence that the shock incarceration programs had a positive effect on offender behavior. The data do suggest that supervision intensity plays an important role in shaping offenders' activities during community supervision.This investigation was supported in part by Grant 90-DD-CX-0061 from the National Institute of Justice, Office of Justice Programs, U.S. Department of Justice to the University of Maryland. Seven subjects participated in a two-part study to evaluate mouth alcohol dissipation in alcohol positive subjects. In part one, subjects rinsed their mouths with a vodka solution and were breath tested after 1, 2, 3, 4, and 5 min intervals. On average, breath alcohol concentration (BrAC) decreased 20.4% (range 3.2-47.9%) between 1 and 2 min after rinsing. In part two of the study, multiple breath tests were administered after rinsing once with the vodka solution. The BrAC decreased more than 0.020 g/210 L between the first and second tests for all subjects (average 0.095 g/210 L, range 0.021-0.162 g/210 L). The average time for subjects to reach their unbiased BrAC was 9.35 min (range 4-13 min) after rinsing. This study reaffirms the need for duplicate breath testing and confirms that the minimum of a 15-min observation period is sufficient for mouth alcohol to dissipate in alcohol positive subjects. 相似文献

法益的体系性位置可以从法益与实定法的关系、讨论法益问题的领域两个角度来分析。在不同领域内讨论的法益,有不同的概念选择,发挥不同的功能。犯罪立法概念中的法益只能是宪法性法益,其功能在于为刑事立法者提供适当的刑事政策标准。犯罪司法概念中的法益,在入罪判断时只能是后刑法法益,可以指导解释刑法规定的行为构成;在出罪判断时只能是宪法性法益,通过法益价值的衡量,对符合行为构成的行为进行正当化处理。 相似文献
