中国与东盟关系2012～2013年回顾与展望

本文对2012～2013年的中国与东盟交往与合作进行回顾与展望,并提出加强中国与东盟合作的建议。     

Negotiating from strength: Arms control and the rhetoric of denial

This essay examines the argument strategy of the Reagan administration and its supporters in response to the INF treaty. By attempting to define the successful completion of the treaty as proof of the validity of “negotiating from strength,” the administration sought to deny the existence of real change within the Soviet Union. This strategy left the administration unable to cope with dramatic arms control proposals later made by the Soviets, trapping the United States in a purely reactive posture.     

HIGH TIMES FOR HATE CRIMES: EXPLAINING THE TEMPORAL CLUSTERING OF HATE‐MOTIVATED OFFENDING

This research explains the temporal clustering of hate crimes. It is hypothesized that many hate crimes are retaliatory in nature and tend to increase, sometimes dramatically, in the aftermath of an antecedent event that results in one group harboring a grievance against another. Three types of events are used to test and refine the argument: 1) contentious criminal trials involving interracial crimes, 2) lethal terrorist attacks, and 3) appellate court decisions concerning same‐sex marriage. The results from time‐series analyses indicate that contentious trial verdicts and lethal domestic terrorist attacks precede spikes in racially or religiously motivated hate crimes, whereas less evidence is found for antigay hate crimes after appellate court rulings that grant rights to same‐sex partners. The model put forth in this article complements prior work by explaining in part the timing of hate crime clusters.     

Environmental crime prosecutions in Ireland, 2004–2014

Despite increased interest in environmental crime and green criminology, few studies address the use of criminal penalties in response to environmental crimes. A handful of published examples employ data from the United States or the Flanders court system, and little is known about how other nations punish environmental violations. Addressing this issue, the current study examined the use of criminal environmental penalties in Ireland from 2004 to 2014. Few criminal environmental cases (N = 147) and few environmental offenders (N = 154) were represented in these data over time. Consistent with the expectations of green/environmental crime researchers, mean penalties for environmental violations, which in Ireland only include fines and investigative cost recovery penalties, were rather small. Unlike in the US or Flanders, the majority of offenders were corporate offenders as opposed to individuals. Contextual factors related to Ireland’s economy, history and use of criminal sanctions should be used to interpret these factors, and prevent generalising from these data.

我国区域警务合作机制构建

现在我国的区域警务合作机制不论是在实施的效率、增加合作机会和层次以及警务资源的共享等方面还存在着很多的问题,这就要求我们要从建立新型的合作模式、更新现有的合作手段、转变原有的合作观念等方面努力完善我国的区域警务合作机制,只有这样才能进一步提高我国区域警务合作的工作效率、放大其实际效果,从而实现区域警务合作有效促进系统内部交流合作,控制社会面的目标。     

群体性事件发生原因研究的再审视——层次分析方法的引入与应用

层次分析方法就是将导致某一事件发生的原因进行分层。将层次分析方法应用到群体性事件发生的原因研究中,群体性事件发生的原因可分为结构、体制机制和个人三个层次。通过比较三个不同层次上变量的重要性,结构层次上的变量最为根本和重要,体制机制层次上的变量次之,个人层次上的变量可视为常数。加强对结构和体制机制层次上的变量的研究,有助于深入探究群体性事件发生的深层次原因。     

当代青年知识分子的历史使命与自身塑造

知识分子是一个众说纷纭的话题.既涉及到概念本身的界定厘清,又关联着知识分子阶层的一言一行.发展中国,更离不开绵延数千年的文化传统,加之近几十年历史的风云变幻、政策更迭,知识分子研究越加莫衷一是.但也充分表明了知识分子在一个社会中是何其重要,百年来跌宕起伏的中华民族复兴史诗即是明证.而青年知识分子在这一历程中所展现的决心、意志和能力,必将使知识分子的内涵再添亮色.当代青年知识分子既承继先驱精英所遗留的宝贵财富,又抹不去“知识”赋予人们的天然印记,更面临着遽然变化的世情、国情、党情,何去何从便成了一个至关重要的问题.因此,通过把握知识分子内涵,认清青年知识分子所承担的历史使命和历史责任,从而塑造知识分子的全新形象,是他们这一代终究绕不开的现实命题和未竟之任.     

我国刑事错案防控与纠错机制之思考——张高平叔侄案引发的思考

刑事案件的错案防控与纠错机制,体现国家的人权保护状态、刑事司法水平,国家的法治文明状态以及司法权与其他国家权力的宪法关系.本文以张高平叔侄案为契机,分析我国刑事错案产生的原因,在阐明转变执法理念的前提下,重点就法官独立司法、行为监督和责任追究的平衡和机制的构建上进行了论述.     

经济犯罪的现代化变迁动力——兼析经济犯罪的防治实践

随着我国社会主义市场经济的进步和发展,社会现代化建设的水平不断提高,受经济形态和社会生产方式的影响,经济犯罪不断的出现,且形式多样,给我国经济的发展带来了极大的影响,导致经济犯罪呈现出不断变迁的趋势.引起这种变化的因素有很多,其中最主要的当属经济转型、社会结构调整以及社会控制.鉴于经济犯罪带来的巨大影响,我国政府必须要高度重视对经济犯罪的查处与防治,确保我国经济的安全,保证国民经济的正常发展.
