关于提高农民权利意识的思考

对于农民权利意识的现状,人们一直都习惯于用“淡薄”或“淡漠”来概括。然而“淡薄”、“淡漠”仅仅是其浅表性特征的反映。事实上,农民在行使权利过程中,并不是处于盲目的状态,而是具有其固有的、传统的对权利的认知和体验模式,而这一模式是探寻农民权利意识生长途径的逻辑起点之一,因此是不应该被忽视的。     

转型期我国农民政治参与的经济动因

我国现阶段的农民政治参与是指农民在社会主义市场经济的影响下 ,在改革中经济利益受到了冲击 ,积极参与到政治中来 ,以试图影响政府决策 ,保护自身的经济利益。处于转型期的农民政治参与表现出手段性的特点。经济发展为农民参与政治提供了原动力。只有深化农村经济体制改革 ,保障农民经济利益 ,才能促进农民的政治参与。     

农业现代化与农业教育改革

由于实现农业现代化必然要受到其主体的农民的整体素质和价值观念的制约，要有相适应的农业人口智力结构作支撑，于是，能否建立起一个健全有力的农业教育体系就显得极为重要了。建国后很长一段时间，我国农业教育并未受到足够的重视，而且还出现过严重的只讲数量不讲质量的弊端。十一届三中全会后，我国农业教育在专业、内容结构，层次结构，体制结构，以及“三教”统筹等诸方面，相应地进行了规模很大的调整和改革。这种调整和改革为世纪之交的中国农业教育的发展提供了有益的启示

Practical significance: It is important to know that the Swiss Trade Marks Office appliesa strict test when it comes to geographical references in trademarks. Usually, the applicant is required to limit the listof goods, although it is questionable whether the trade markreally suggests that the goods stem from a certain country.Foreign decisions are not binding for the Swiss Trade MarksOffice and in this regard usually disregarded.

文章主要以最高人民法院和最高人民检察院作出的涉税犯罪司法解释为中心，集中探讨了我国刑法司法解释的观念障碍、涉税犯罪司法解释的问题表现以及克服刑法司法解释观念障碍的基本对策。     

ENGLISH COURTS' TREATMENT OF THE CHILDREN OF SAME‐SEX COUPLES

This article reviews the historical approach of the English Courts to the children who are raised in same‐sex households; it discusses the very recent reformation of attitude of the courts, and of the legislators, to such family arrangements, and it examines the current attitude of the English Courts. The article considers how the courts have struggled historically to apply ordinary welfare principles in the different context of homosexual parenting, and discusses the complex inter‐play of family relationships when children are born into same‐sex families through donor insemination. The article discusses the ongoing challenges for the courts in dealing with cases of this kind.     

我国农村信贷资金供给不足的探讨

近年来,我国对于"三农"的关注度不断提高,在完善和加强农村金融服务方面已经取得了很大的成效。我国农村地区基本上形成了以"商业性金融、政策性金融、合作性金融"为主体的农村金融组织,这一金融体系对"三农"经济的发展发挥了很大的支持作用。但是也存在很多问题,主要集中在农民日益增长的贷款需求与金融机构追求效益偏好之间的矛盾,农村信贷资金供给不足,资金短缺仍然是目前我国农村经济发展的"瓶颈"。     

论数额犯的未遂形态

我国刑法分则罪状是以一人犯罪既遂模式加以规定的。在数额犯中,＂数额＂不是界分犯罪既遂与未遂的标尺,也不是数额犯刑罚发动的内在动因,＂数额＂是数额犯犯罪构成要件中量的规格,是一种犯罪构成要件要素,在犯罪成立层面起到区分罪与非罪的作用。数额犯存在未遂的犯罪停止形态,这并非是由＂数额＂本身所规定,而是由刑法总则中关于未遂犯罪的一般规定以及《刑法》第13条犯罪概念的＂但书＂规定所决定的。     

农民组织在陕甘宁边区减租斗争中的历史作用和现实启示——兼论农民组织对边区和谐乡村建设的作用

抗战爆发后，中国共产党制定了减租减息的土地政策。在陕甘宁边区开展的减租斗争中，农民组织起到了重要作用，即调动广大农民积极性，推动减租工作的开展；组织生产并支援抗战；进行有效的民众教育和动员，提高了农民的政治觉悟。农民组织对边区和谐乡村建设发挥的重要作用，对于今天社会主义新农村建设和和谐社会建设有着重要的启示意义。     

Multiple job holding in rural villages and the Chinese road to development

This paper examines some of the interrelations that exist between rural China's peasant economy and the wider economy in which it is embedded. In doing so it focuses on the circular flows that link town and countryside. Multiple job holding is strategic in this respect. The paper draws on research undertaken in a peasant village in Hebei Province. The research highlights some remarkable differences that exist between development processes in China and in other developing countries and traces these back to a combination of an enlightened rural policy and the strong linkages that exist between rural China and its urban ‘global factory’.
