论公平正义在构建和谐社会中的地位

公平正义是建设社会主义和谐社会的核心价值。从公平正义是解决社会主义初级阶段主要矛盾的现实要求，是社会主义和谐社会中主体需要的价值实现以及是社会主义社会的本质要求等方面。可以看出公平正义在和谐社会六个基本特征中处于基础性的重要层面，对其他本质特征起着支配、规定和约束的作用。     

儒家义利观及其当代价值

儒家重义轻利,但并不否定利,是否重利,要根据＂人＂与＂利＂的具体情况而定,儒家义利观在今天具有很强的现实意义。儒家＂利不可去＂的主张,启示我们：要充分肯定人基本的利益需求,而不是相反。儒家＂以义节利＂的做法,启示我们：必须在道德规范的框架内追求利益,而不是唯利是图。儒家＂灭人欲＂的激进主张,启示我们：人类的欲望是无止境的,在相对稀缺的物质资源面前,我们必须懂得节制自己的欲望。     

少年司法中“宽严相济”刑事政策的应用——赵某、钱某故意伤害致人死亡一案的评析

青少年犯罪现象与日俱增，已经成为全社会共同关注的焦点问题。如何正确对待犯罪的青少年，怎样感化、引导他们，使他们重新回归社会、回归家庭，是司法工作人员所要面对的重要课题。在刑事审判中，要以法官为主导，正确贯彻“宽严相济”的刑事司法政策，通过个案达到法律效果和社会效果的统一，使“宽严相济”的刑事司法政策在构建社会主义和谐社会中发挥应有的作用。     

论涉外案件处置的制约因素及解决路径

涉外案件处置中存在较多的制约因素,表现为法律法规尚不完备,现行法律法规关于涉外案件实体性和程序性权利设置不合理,涉外案件办案机制不健全。宜深化执法理念,构建完善的涉外案件处置法律体系,完善涉外案件警务合作机制;提高办案人员素质,增强办理涉外刑事案件的能力。     

论警察出庭作证的程序保障——以《波士顿警察局规则与程序规则320》为蓝本

警察出庭作证问题一直都是法学理论研究和司法实务界讨论的热点问题。我国警察出庭作证之所以存在障碍,一方面是由于刑事诉讼法对警察出庭作证问题规定的不够明确,另一方面是缺乏保障警察出庭作证的程序规则,从而造成警察不出庭理所当然的错误观念。在有关警察出庭作证的程序保障方面,立法比较成熟的美国可以给我们提供一个学习、借鉴的蓝本,特别是《波士顿警察局规则与程序规则320》。     

欧洲法院的司法独立性对欧洲一体化进程的贡献

半个世纪以来,欧洲一体化进程的实践证明,经济一体化、政治一体化的实现都离不开统一的欧洲法律体系的建设。欧洲法院司法实践证明,在欧洲一体化进程中,欧洲法院司法独立的作用功不可没。文章从分析欧洲法院的特点入手阐述其司法独立性及其在欧洲一体化进程中的作用。     

Fair treatment,fair play? The relationship between fair treatment perceptions,political trust and compliant and cooperative attitudes cross-nationally

Obtaining citizens’ voluntary compliance with political decisions is a fundamental democratic challenge. Fair treatment by public officials plays a key role in theoretical and empirical studies on citizens’ compliance and cooperation. Yet it is unclear whether citizens within different societies react to (un)fair treatment in the same way. Using multilevel structural equation modelling and multilevel regression analysis on the European Social Survey 2010–2 (N = 52,458), this article shows that perceptions of fair treatment by police officers are associated with higher levels of trust in political institutions and in turn stronger compliant and cooperative attitudes of citizens in 27 countries. Yet the link between perceptions of unfair treatment and institutional trust is stronger in countries in which fair behaviour is more prevalent. While fair treatment is often considered to be a universal norm affecting citizens in a uniform way, this article sheds light on important cross-national variations.     

Alternative South–South development collaboration? The role of China in the Coega Special Economic Zone in South Africa

Aid, in the form of financial aid and investment, has become increasingly prevalent in both bilateral and multilateral partnerships in the BRICS. In Africa, the Forum on China–Africa Cooperation provides the official framings for forms of development assistance to the continent, with financial forms of aid available through the New Development Bank and the China–Africa Development Bank (CADFund). This article explores how Chinese international development assistance has influenced South Africa's economic growth and development strategies and is reshaping South Africa as “gateway” to Africa and continental leader. Special economic zones (SEZs) have become a prioritised form of BRICS development collaboration particularly in terms of Chinese trade and investment expansionism into Africa through South Africa. Chinese international development assistance and foreign direct investment in South Africa in particular are very notable and have been strengthened during the Chinese official state visit prior to the Johannesburg BRICS Summit in 2018. The article critically analyses the development policy discourse on BRICS spearheading an alternative model of South–South international cooperation by examining the Coega SEZ in South Africa, hailed as the most SEZ in Africa. The article critically examines the development alternative potential of the Coega SEZ.     

Restraining Gulliver: Institutional reform and the strengthening of state capacity and compliance

Governance in the developing world is fraught with problems of corruption, weak institutions, and inadequate expertise among bureaucrats. Failing to enforce laws and regulations is one way in which these problems manifest themselves. In this paper, we evaluate changes across three institutions charged with oversight or administration of labor justice in Mexico. We find that both autonomy from the executive and professionalization are necessary to improve compliance with labor law over time. Our study shows that professionalization can occur in several ways, including through training, merit hiring, and introducing experienced external administrators. The implications of the study are that reforms that increase the independence and legal authority of oversight institutions should be complemented by efforts to strengthen the professionalism of bureaucrats.     

RemoteForensicCSI: Enriching teaching,training and learning through networking and timely CPD

The COVID-19 pandemic brought about rapid, transformational change to pedagogic practice on a global scale. During this time, educators across all levels needed to significantly broaden and upskill their digital skills and competence to instantaneously turn face-2-face content into remote, online provision, particularly during periods of national lockdown. Whilst there was significant e-content available in some subject domains, there were limited e-resources available to those working within the criminal justice sector. The #RemoteForensicCSI network was established in attempts to fill this gap and support both practitioner and learner transition within further and higher education and industry.This article evaluates the value and impact that the #RemoteForensicCSI initiative had on the personal development of network participants, their peers and learners, whilst considering, reflecting on and recommending how remote delivery may influence the future of teaching, training and learning within education and the wider criminal justice sector.
