One lawyer acting for two clients: implications arising from an experimental practice model ‘Family Matters’

The legal services market has faced unprecedented change following implementation of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LASPO). Alternative business models and wider use of digital technologies have developed alongside debates about the future of legal practice in family law. Arguments have been made for new hybrid models that combine legal advice with mediation and for solicitors to be enabled to work with two clients. This paper contributes to that debate by highlighting implications for such practice innovations based on research evidence of solicitors’ experiences of delivering an experimental model of practice: ‘Family Matters Guides’. This model, piloted by Resolution, involved the Guides providing intensive support and legal information (not legal advice) to both separating parents to help them reach agreements. This paper is timely as the professions await the new regulations from the Solicitors Regulation Authority (autumn 2018) making flexible practice models a reality.     

Dr. Death? Professionalism,Virtue, and U.S. Physician Participation in the Death Penalty

In the United States at present, the death penalty is a possible sentence in 31 out of 50 states, as well as within the military and for federal cases. In the U.S., numbers of executions are declining, in part due to moratoriums in place and challenges to execution by lethal injection. Participation by physicians in lethal injection executions has been steadfastly viewed by professional medical organizations as contrary to their ethical standards. However, physicians have participated in lethal injection executions, and the morality of the death penalty itself is a matter of intense social and political debate. Medical ethics commentators and professional organizations have typically held that the prohibition on physician participation in the death penalty is independent of the ethical status of the death penalty itself. This article argues that this view is untenable, and that it is tied to a view of professional role virtue that is similarly untenable. At the same time, it argues that, given the morally uncertain status of the death penalty, it is plausible that virtuous physicians may either refuse or choose to participate in some aspects of the death penalty.

律师制度起源于西方,法律职业主义是其主流指导理念。法律职业主义由三大基石构成。随着现代批判性思潮对其批判的展开,有必要重新审视国家主义、商业主义以及技术性职业主义和公共性职业主义的利弊。我国学术界和律师界所持的多是技术性职业主义的观点,政府的管制理念存在一定的模糊与混乱。以容纳多种伦理观为己任的“市民公共领域”理论,可能是建构我国律师职业定位新模式的可行路径。     

高职高专公共事业类专业两年制课程体系改革研究的基本思路

高职高专公共事业类专业两年制课程体系的改革,需要把学科体系变为能力体系,把专业学科为本位变为以职业岗位和工作能力为本位,也就是说,要以就业市场为导向设置课程,其特色具体体现在：各专业根据自身特点,主要根据就业岗位群的职业工作任务核心能力标准,在此基础上分析知识构成,遵循高等教育学习规律设置专业基础课、专业课程和专业延展课程,构建专业核心能力和延展能力培养课程集群,形成将“模块式”与“三段式”综合集成的能力本位为主的新型高职教育课程体系。

高职院校的人才培养特色主要表现在三个方面：培养目标具有鲜明的应用性,教学过程突出实践性,专业和课程设置具有适应经济社会需求的针对性和灵活性。产学合作教育、“双证书”教育和实践教学是高职院校人才培养特色建设的主要内容。

亲和力是师生纯洁感情的升华与凝结,它是师生在教学活动和日常交往中形成的一种精神力量,"两课"教师如果能与学生之间形成这种亲和力,并适时、适度地灵活运用它,就会极大地提高教学效果,从而真正实现教书育人的教育目的.     

刑法第306条存与废:倾听法律职业人的声音

刑法第306条(又称律师伪证罪)从其诞生之日起就面临着当存还是当废的巨大争议,这些争议或来自学理或来自实践中的相关利益群体。2009年底至2010年初的李庄案再次使得这一争论从幕后转至台前。通过考察法律职业人对第306条的真实态度,可以深入地发掘争议背后的社会因素:即司法机关观念上的误区;诉讼结构的不合理;追诉程序上的瑕疵,从而从实体和程序上为刑法第306条的未来寻求一条理性的出路———存而慎用。     

论司法鉴定人资格认证框架的构建

通过对我国司法鉴定人资格管理中存在的问题分析,在借鉴相关行业管理模式的基础上,以国际标准化组织发布的ISO/IEC17024准则为指导.提出将人员认证与鉴定人职业资格相结合,将资格考试和能力验证作为鉴定人认证的主要评价手段,尝试在现有法律制度和管理模式下构建我国司法鉴定人资格认证的基本框架.     

警察职业化建设的社会价值

公安队伍的长远发展要依赖正规化与职业化建设的协同与统筹。在对待职业化和正规化的关系问题上,不能因一种事物的存在而忽视甚至淹没相关事物的存在及其价值。警察职业化建设的社会价值表现在：其一,达成公安队伍方向与个人意志、目标与任务的统一,有利于凝聚警心、确保稳定;其二,统一队伍建设规范与举措,明确职业化建设标准,使得警察队伍建设走向可持续发展的轨迹;其三,通过警察职业建设,全面系统的体现警察职业的社会责任;其四,谋求找准警察自身职能定位,以此形成良好公共关系。     

我院实行班导师制度问题研究

在已设有辅导员的大学里,给学生配备班导师,这在我国部分普通高校和部分高职高专院校属于新生事物、正在试行和探索中。本文从班导师制问题的提出出发,借鉴其他高等院校的具体做法,我院试行班导师制度的实践与探索和即将实行班导师制度急需解决的问题等多方面进行探讨,以此推动班导师制度尽快建立,来提升学生专业素养的培养,引导学生对自己专业知识的学习和掌握,增强学生学习的主动性和自觉性,以形成良好学风。
