Repression without Exception: A Study of Protest Bans during Turkey’s State of Emergency (2016-2018)
ABSTRACT Following the coup attempt of 15 July 2016, the Turkish government declared a state of emergency that would last for two years. In this paper, we focus on an understudied aspect of this period, protest repression during the state of emergency, using an original dataset of protest bans issued in 2007–2019. Engaging with the theoretical claims of emergency scholarship, our paper demonstrates that emergency powers were used to target areas, groups, and issues that were not related to the ‘urgency’ underpinning emergency rule. Moreover, such derogations of rights were perpetuated after the termination of the state of emergency within so-called ordinary legality. These practices were nevertheless embedded in the already authoritarian political-institutional context of Turkey and its layered history of emergencies. 相似文献

In 1997 a small group of animal rights protesters devised a strategy of legal and illegal protests that almost closed down one of Europe's largest animal testing firms, Huntingdon Life Science (HLS). The animal rights protesters successfully disrupted the operations of HLS and severed its links with some of the world's largest financial institutions. This case study examines the "protest game" that was played between the animal rights protesters, HLS, and its business partners. In the first section, I describe the interactions between the parties to the dispute, applying negotiation analytic concepts to better explicate the structure of the game, the alternatives available to the players, and the psychological heuristics and biases that influenced decision making. The conclusion suggests alternative ways in which the protesters and the life sciences industry could resolve the dispute over the ethics and cruelty of animal testing. 相似文献

1996年《中华人民共和国律师法》的制定和新的刑事诉讼法及刑法的相继实施,给人以极大的鼓舞,但我国当前的律师执业状况却不容乐观,修改后的刑事诉讼法仍然解决不了控辩双方力量不均衡的问题。检察机关的法律监督权在审判阶段成了凌驾于辩护职能与审判职能之上的一项权利,严重破坏了诉讼结构。而刑法第306条规定的"辩护人、诉讼代理人帮助伪造证据罪"更是悬在律师头上的"达摩克利斯之剑"。因此,努力改善辩护律师的执业环境,使得我国能够满足国际最低司法公正标准,已成为我国整个刑事程序亟待改革的问题。 相似文献

The articles in this special issue are drawn from papers presented at a conference entitled “Neoliberalism and/as Terror”, held at the Nottingham Conference Centre at Nottingham Trent University by the Critical Terrorism Studies BISA Working Group (CSTWG) on 15–16 September 2014. The conference was supported by both a BISA workshop grant and supplementary funds from Nottingham Trent University’s Politics and International Relations Department and the Critical Studies on Terrorism journal. Papers presented at the conference aimed to extend research into the diverse linkages between neoliberalism and terrorism, including but extending beyond the contextualisation of pre-emptive counterterrorism technologies and privatised securities within relevant economic and ideological contexts. Thus, the conference sought also to stimulate research into the ways that neoliberalism could itself be understood as terrorism, asking – amongst other questions – whether populations are themselves terrorised by neoliberal policy. 民事诉讼法确立了民事抗诉制度 ,但其规定十分笼统。实践中 ,检法两家常常各执己见 ,争论不休 ,严重削弱了检察监督的力度。本文认为 ,在抗诉案件的审级上 ,应确立“抗同级、同级审”原则 ;在审限上 ,应从接到人民检察院抗诉书的次日算起 ,在再审中检察机关的地位、任务及权限方面 ,立法均应予以具体规定。此外 ,对检察机关启动抗诉程序的权力应予以必要限制 ,以避免检察权与审判权的无谓冲突。 相似文献
