论我国刑法中刑事被害人保护的缺失——兼及检察机关公诉权与刑事被害人保护的利害冲突

刑事被害人在犯罪行为结构中的重要地位表明,刑事被害人在刑事立法和司法中应当得到与其所遭受的犯罪侵害相适应的刑法保护。但是,由于扭曲的犯罪观和群体主义本位价值观的制约,以检察机关的公诉权为代表的公众利益却侵蚀了刑法对刑事被害人的保护。     

对我国政府信息公开的几点思考

政府信息公开是推进民主政治、推进政治体制改革、推进政治文明的重要措施,目前我国政府信息偏重保密,公开程度较低,且政府为社会提供信息的方式和渠道过少,这既有认识上的原因,也存在政府工作缺乏有效监督机制的问题,尤其是保密问题成为政府信息公开的难点。为此,我们必须从法律、法规上来解决问题,从组织上来落实政府信息公开的工作。     

The "Essential Domino" of Military Operations: American Public Opinion and the Use of Force

It is a commonly held belief that the foreign policy issue to which the American public is most sensitive is the use of military force. Because American public opinion regarding the use of force is highly palpable, salient, and organized, and because decisions regarding the use of force are some of the most important decisions the nation ever has to consider, the analysis of public opinion regarding military involvement is academically significant and policy relevant. The indication from policymakers is that American military operations require public support. As a result, scholars and analysts have come to realize that public opinion is the "essential domino" of military operations. The relationship between mass American public opinion and the use of military force has become, therefore, the focus of numerous studies and surveys. There are currently several competing explanations—schools of thought—in the literature on why the mass public supports the use of force. This article is an attempt to identify the most prominent schools of thought on public opinion and the use of force, and the central factors associated with each school. Such a review is important to generating policy–relevant guidance pertaining to public opinion and the use of force—an objective made more pressing by the current war against terrorism.     

美国冒犯性商标注册审查标准的变化及其启示——从涉新冠疫情商标申请谈起

《美国兰哈姆法》第2条a款和我国《商标法》第10条第1款第8项在国际公约义务和惯例、立法目的、条文开放性上有相似之处,但在商标注册层面的表达自由和遵循公序良俗边界的认定上差异巨大。表达自由不应逾越遵循公序良俗的国际惯例和国内司法习惯,美国式的完全放开商标注册层面的表达自由不符合我国传统价值观下公众的合理预期。我国在适用"不良影响"条款时需要把握表达自由与遵循公序良俗二者的界限,避免过宽适用"不良影响"条款而吞噬表达自由的空间,应以本土性价值判断克制条款的适用。     

Advancing police use of force research and practice: urgent issues and prospects

Leading police scholars and practitioners were asked to reflect on the most urgent issues that need to be addressed on the topic of use of force. Four themes emerged from their contributions: use of force and de-escalation training needs to improve and be evaluated; new ways of conceptualizing use of force encounters and better use of force response models need to be developed; the inequitable application of force, and how to remediate biases, needs to be more fully understood; and misconceptions about police use of force need to be identified and corrected. The highlighted topics serve as an agenda for future research. Such research should provide greater insight into when, where, and why force is used by police officers, and how it can be applied appropriately. If implemented, the practical recommendations included in the contributions should have a positive impact on police performance, public trust and confidence in the police, and citizen and officer safety.     

对创新公安教育培训工作的再思考

公安部发布了修订后的《公安机关人民警察训练条令》,对公安培训工作提出了新要求。面对公安培训工作存在问题,紧紧围绕“四项建设”,创新教育培训理念、创新培训训练形式、创新培训教官团队建设、创新培训激励机制和考试考核体系、创新教育培训实战成果转化就成为提高培训质量的必由之路。     

民警在治安调解中的效力分析

治安调解作为警察行政管理中的一项重要职能,对维护社会治安、稳定公众情绪起到至关重要的作用。在市场经济体制下,我国基层公安民警愈来愈多地面临着在处理治安违法的同时需要附带解决由此产生的经济纠纷,具有化解群众矛盾、厘清经济纠纷作用的治安调解被广泛运用于治安执法过程中。然而,在立法和司法实践中,治安调解与人民调解、诉讼调解的效力并未实现有机衔接,有必要厘清应对之策。

随着网络的发展,现实中的群体性突发事件极容易变成网络舆情,对应对群体性突发事件带来了严峻的挑战。要增强新形势下应对群体性突发事件的能力,必须探明群体性突发事件网络舆情的演变规律。群体性突发事件网络舆情的演变包括生成、爆发、稳定、终结四个阶段。在这个演变过程中,群体性突发事件网络舆情都处于动态变化中。

自网络诽谤司法解释颁布以来,引起社会的广泛关注,尤其是对网络大"V"的惩处,更使人们对于网络诽谤犯罪和网络寻衅滋事犯罪产生了一系列质疑。基于对"网络空间"和现实社会相关概念的理解,进一步探讨网络秩序和公共秩序以及公共秩序严重混乱等问题,从而对解释第5条进行解读。     

What Future for the Ombudsman?

The ombudsman institution, in both the public and private sectors, is increasingly identified with the ethos of consumerism and the protection of consumer rights. The current trend is exemplified and reinforced by the EU ADR Directive and by the government response to a recent inquiry into complaints conducted by the Public Administration Select Committee. This article argues that the dominant consumerist ethos diminishes the ability of the ombudsman institution to fulfil its potential. If the ombudsman institution, in particular as manifest in the office of the UK Parliamentary Ombudsman, is to serve the public interest, it must instead promote human rights principles and constitutional morality, adopt a process that is marked by public reasoning and participation and seek by a whole‐system approach to realise a vision that is integrated and truly democratic.
