民事公诉制度质疑

近来不少学者主张在我国应尽快建立民事公诉制度,赋予检察机关在一定范围内的民事起诉权,而从保护社会公益、解决群众性纠纷、保护弱者和加强法律监督四个方面分析,民事公诉制度在理论上存在着误区和在实际运作上可能陷入困境.其不具有存在的合理性、合法性和必要性,解决相关问题应加大行政执法力度,加强检察监督,赋予检察机关民事诉讼参诉权.     

加入WTO带给公安工作的机遇、挑战与对策

加入WTO是中国深化改革、扩大开放、加快发展的必然选择 ,也是实现整个社会长期稳定繁荣、经济持续增长的客观需要。入世不仅会使公安工作拥有更为广泛的服务空间 ,而且也将推动公安机关自身改革的进程 ,亦将拓展公安机关与国际间司法交往与合作的机会。但WTO是一把“双刃剑” ,在带来巨大利益的同时 ,也必然会给包括公安工作在内的社会生活各方面带来巨大的风险和挑战 ,社会治安将会更加波动 ,犯罪活动将会更加突出 ,文化侵袭将会更加严重 ,公安任务将会更加繁重。公安机关应采取积极主动的针对性措施 ,加强公安思想建设 ,全力维护社会政治稳定 ;加强公安队伍建设 ,全面提高公安民警素质 ;加强公安法制建设确保严格公正文明执法 ;加强公安作风建设 ,积极大力推行警务公开。从而更好地服从服务于经济建设 ,确保社会治安的持续稳定。     

对中国证券业加入WTO面临问题的思考

中国加入 WT O后 ,证券业的开放是一种必然的趋势。面对这种状况 ,我国证券业应当采取的措施是 :加快金融改革 ,提高金融运行的市场化程度 ;逐步推进金融业的混业经营 ,提高经济证券化程度 ;大力培育较大规模证券经营机构 ;改革和完善证券市场的创新机制 ;建立有效的市场监管体系     

Challenging U.S. Policymakers' Image of an Isolationist Public

A persisting question in international studies is whether academic research can have an impact on the making of foreign policy. Much research has shown that policy decisions can be greatly influenced by misperceptions, just as much as by objective factors. The article describes an effort by academic researchers to challenge U.S. policymakers' image of an actor in the U.S. foreign policy process—the American public. The study's focus was a widely held assumption in the U.S. foreign policy community that the American public in the wake of the Cold War was entering a renewed phase of isolationism, similar to the interwar years. The study first interviewed policy practitioners on their perceptions of the public, then performed a comprehensive review of existing polling data, and finally conducted new polls with input from policymakers themselves. The net result of the elite interviews and the analysis of public attitudes revealed a significant gap in all areas, which is presented in synopsis. Interviews with policy practitioners reveal two key dynamics that could well contribute to policymakers' misreading the public: a failure to seek out information about the public and a tendency to assume that the vocal public is representative of the general public. Indications that the study did have some impact on the thinking of policy practitioners are discussed in the conclusion.     

Understanding food security and international security links in the context of climate change

Food production has been changing significantly in recent years as a result of climate change and of growing demand for food. This article aims to understand the link between food security and international security in the context of climate change, applying a systematic and qualitative analysis of the literature using the bibliometric method. This research observes that climate change tends to affect agricultural productivity, exposing societies to risk and the need for migration. However, good governance, together with international cooperation, can reduce the hazards of food insecurity, strengthening ties between countries and stimulating a fairer and more inclusive form of international trade.     

Foreign Terrorist Fighters: managing a twenty-first century threat

In the aftermath of the Arab uprisings Foreign Terrorist Fighters (FTFs) have emerged as a significant security challenge. Since the 1980s and the Soviet occupation of Afghanistan the notion of a ‘foreign fighter’ has been closely linked, if not synonymous, with those ideologically or religiously motivated individuals who have travelled to join conflicts in Islamic lands. This article will explore the contemporary FTF movement, offering a comparison of Afghanistan in the 1980s and Syria in the contemporary period. It will explore the international community’s expansive responses to the challenge of FTFs, with special focus on the role of the United Nations.     

How irresponsible are rising powers?

Rising powers like Brazil, China and India have recently made significant gains in their capabilities as states. Therefore many IR scholars are claiming that these powers must now contribute more to the provision of global public goods like a clean environment, free trade and human rights. This article will argue that reasonably democratic international political discourses are another global public good whose greater supply is sorely needed and that rising powers are having a positive impact on the creation of such discourses. Thus rising powers are not behaving as irresponsibly as many IR scholars assume.     

Agenda and Public Policy: Evidence From Chile

Based on Kingdon’s model and the punctuated equilibrium theory, this article analyzes the process of four Chilean public policies from 1990 to 2013. Evidence was collected from 205 interviews, official documents, 3,905 press clippings, and academic literature. Grounded theory was employed to analyze interviews. The analysis shows a tacit alliance between power and expert knowledge, that presidential motivation seems to be a key factor for an idea to be included in government agenda, that Chile’s policy-making process is rather elitist, and that its characteristics coincide with the “inside access model of agenda building.”     

NPM Reforms in Napoleonic Countries: A Comparative Study of Management Accounting Innovations in Greek and Italian Municipalities

This is a comparative study of the rationale and effects of management accounting innovations in Greek and Italian municipalities, as part of the NPM reform in the public sector. This article aims to understand the extent of adoption of accounting innovations in Greek and Italian municipalities, and the factors affecting the specific techniques in use. The study reports on a survey based on medium-sized and large Italian and Greek municipalities, targeted at public municipalities’ accountants, the users of accounting techniques. The study identifies the intended purposes of NPM reform and, particularly, management accounting innovations, analyzes a set of factors that affect the implementation of management accounting technologies, and discusses determinants and features of such innovation on a comparative perspective.     

Is Managerial Work in the Public and Private Sectors Really “Different”? A Comparative Study of Managerial Work Activities

This article aims to discern the extent to which managerial work is similar and different in the public and private sectors. Using propositions and structured categories for describing what managers do, this article compares results of an observational study conducted in the Canadian public sector with similar studies from the private sector. Through a comparison of work type, hours, location, activities, and contact patterns, this research finds few differences in managerial work activities between the two sectors, despite contextual and situational differences. Possible explanations are explored, implications of the findings are discussed, and future research directions are proposed.
