While both India and Brazil are seriously affected by the HIV/AIDS epidemic, each country has chosen a different approach to providing affordable pharmaceutical treatment. Whereas the Indian government has paved the way for market-driven solutions, Brazilian public authorities are strongly involved in the research and production of HIV/AIDS medication. Brazilian regulations permit comprehensive and free provision of HIV/AIDS drugs, whereas the majority of the affected population in India does not receive adequate pharmaceutical treatment. To explain the different policy outputs, we draw on the developmental state literature. Efficient decisionmaking structures, a devoted bureaucracy, and effective policy instruments enable public authorities to provide public goods even in the context of relative scarcity. We show that the assumptions of developmental state theory have to be complemented by the assessment of civil society actors' potential to trigger governmental interventions in the market.  相似文献

This article examines the implications of the World Trade Organization (WTO) China-Intellectual Property Rights Enforcement case for the relationship between human rights law and trade-related intellectual property law. It shows that, despite the theory whereby international trade law can spontaneously support the freedom of expression and possibly other human rights, the parties and the panel were, in practice, oblivious to the human rights context of the dispute. In the WTO, human rights considerations will be integrated with international trade law (and intellectual property law within it) only if a party makes explicit arguments to this effect, and a panel opts to consider such arguments on their merits, not through issue avoidance.  相似文献

Abstract: Issues of risk and public protection are currently a critical, and politically sensitive, area of practice for probation and youth justice services in England and Wales. The language of public protection shapes practice in significant ways, yet this use of terminology is an issue which has received relatively little attention. This article examines the current debate between policy makers and independent inspectors concerning the use of the terms ‘harm’ and ‘serious harm’ to illustrate how linguistic confusion can hinder practice. The article concludes with suggestions for an alternative vocabulary that could bring greater clarity to risk assessment and risk management processes.  相似文献

This paper explores utilisation of the term small business in contemporary politics in the United Kingdom. First, the policy and practice implications of the term small business are examined, through the lens of political rhetoric. Use of the term over the period from 2004 to 2013 is examined, drawing upon the DataArt Guardian NewsTraces platform as both a method of initially visualising an overall pattern of the term’s use during the 10-year period, and a medium for facilitating data collection for analysis. The research question is: how is the term “small business” used in political rhetoric in the UK, in the identification of policy problems and solutions, and the creation of pending narrative? It is determined that the term small business is an ideograph with different and often competing meanings for various interest groups, and suffers from serious imprecision despite policy efforts which strive for legitimacy. Even with spikes in use reflecting election cycles and periods of economic stress, the term’s power is in its mutable but appealing vagueness, and its enduring quality as pending narrative. This leaves open obvious questions of both policy efficacy and the sufficiency of ideographic-laced rhetoric as a substitute for meaningful policy.  相似文献

In Western European democracies opposition to the European Union is commonly found at the ideological extremes. Yet, the Euroscepticism of radical left-wing and radical right-wing parties has been shown to have distinct roots and manifestations. The article investigates whether these differences are mirrored at the citizen level. Using data from the European Election Study (2009/2014) and the European Social Survey (2008/2012) in 15 West European countries, it is found that left-wing and right-wing citizens not only differ in the object of their Euroscepticism, but also in their motivations for being sceptical of the EU. Left-wing Eurosceptics are dissatisfied with the current functioning of the EU, but do not oppose further European integration per se, while right-wing Eurosceptics categorically reject European integration. Euroscepticism among left-wing citizens is motivated by economic and cultural concerns, whereas for right-wing citizens Euroscepticism is solely anchored in cultural attitudes. These results refine the common ‘horseshoe’ understanding of ideology and Euroscepticism.  相似文献

The aim of this article is to analyse citizens’ attitudes towards governmental accountability in 24 European countries and to examine the influence of contextual and individual factors on perceptions of accountability. Using as a dataset the 2012 European Social Survey, the results show that citizens respond positively when the media provides reliable information on which to judge the government, when individuals perceive that governments perform well, when individuals live in more extensive and generous welfare states and when they live in countries where the rule of law is firmly established. In addition, the findings also provide evidence that compared to politically left-wing citizens, right-wing supporters have, on average, a higher perception of governmental accountability. In particular, the findings show strong positive evaluations of right-wing governments by right-wing voters in comparison with left-wing governments by left-wing voters.  相似文献

Education plays an important role in the political, social and economic divisions that have recently characterised Western Europe. Despite the many analyses of education and its political consequences, however, previous research has not investigated whether government policy caters more to the preferences of the higher educated than to the preferences of the lower educated. We address this question using an original dataset of public opinion and government policy in the Netherlands. This data reveals that policy representation is starkly unequal. The association between support for policy change and actual change is much stronger for highly educated citizens than for low and middle educated citizens, and only the highly educated appear to have any independent influence on policy. This inequality extends to the economic and cultural dimensions of political competition. Our findings have major implications for the educational divide in Western Europe, as they reflect both a consequence and cause of this divide.  相似文献

Do natural disasters prolong civil conflict? Or are disasters more likely to encourage peace as hostilities diminish when confronting shared hardship or as shifts in the balance of power between insurgents and the state hasten cessation? To address these questions, this study performs an event history analysis of disasters’ impact on the duration of 224 armed intrastate conflicts occurring in 86 states between 1946 and 2005. I contend that natural disasters increase conflict duration by decreasing the state’s capacity to suppress insurgency, while reinforcing insurgent groups’ ability to evade capture and avoid defeat. First, disasters’ economic impact coupled with state financial outlays for disaster relief and reconstruction, reduce resources available for counterinsurgency and nation building in conflict zones. Second, the military’s role in administering humanitarian assistance can reduce the availability of troops and military hardware for counterinsurgency, prompt temporary ceasefires with insurgents, or both. Third, natural disasters can cause infrastructural damages that disproportionately hinder the state’s capacity to execute counterinsurgency missions, thereby making insurgent forces more difficult to capture and overcome. The combination of these dynamics should encourage longer conflicts in states with higher incidence of disaster. Empirical evidence strongly supports this contention, indicating that states with greater disaster vulnerability fight longer wars.  相似文献
