The Institutional Dimension of the Entrepreneurship

This paper discusses the institutional dimension of the entrepreneurship. Besides providing products for the society, entrepreneurs silently influence the institution, which is perceptually invisible but actually exists with deep significance. Therefore, it is argued that a corporate may be destructive to institution even though it creates value for the society. This paper divides institution into three levels including organization, general rules and culture and interprets the reason why the “rational behaviors” of a entrepreneur may form a “prevalent atmosphere” deviating from the natural laws which may finally destroy the social institutional environment. In the end, it is believed in the paper that the social responsibility of entrepreneurs includes not only the commitment to public interest and environment protection etc., but also the efforts to consciously promote the institutional improvement.

在完善社会主义市场经济体制和市场化劳动关系中,人们愈来愈重视理性和经济理性的作用与研究。这是一个极具社会经济价值的问题。和谐劳资关系的构建根本在于"合理"性,关键在于这个"理"应该怎样讲。这个"理"必须是社会理性和经济理性的有机结合。     

论商法的传统与理性基础——历史传统与形式理性对民商分立的影响

民法与商法构成了传统私法的整体 ,但是 ,民法与商法的分立或者合一争论此起彼伏。我们不仅要问 :民商分立是一个理性的选择 ,还是一个自然的历史过程 ?是科学的分类还是历史分类 ?即使是在今天西方许多学者呼吁建立民商合一的具有法典化传统的国家 ,也只是“雷声大而雨点小” ,象德国、法国这样的较早地拥有民法典的国家 ,民法与商法的合一也没有完成。理性与单纯的价值判断并不是推动民商合一的全部因素 ,更不是决定性因素 ,而历史与传统才是商法产生的基础 ,也是其存在的基础 ,也是民商分立的真正支持 ,也许正是历史与传统的因素真正阻碍着民商合一。     

A psychological perspective on moral reasoning,processes of decision-making,and moral resistance

ABSTRACT

This article presents a psychological approach on the development of social and moral judgments that has relevance for the topics of public justification and world politics. In contrast with approaches assuming that morality is primarily determined by emotions and non-rational, the research discussed shows that moral development involves the construction of thinking about welfare, justice, and rights. In parallel with judgments in the moral domain, individuals construct judgments about conventions in the social system and areas of personal jurisdiction. Research documents that moral and social decisions involve processes of coordination, or weighing and balancing, moral and non-moral considerations and goals, as well as different moral goals. Processes of coordination are also involved in decisions about cultural practices that include social inequalities and relationships between those in dominant and subordinate positions in social hierarchies. Judgments about the fairness of practices entailing inequalities produce social opposition and moral resistance.     

论我国释明权制度的立法必要--以我国民事审判方式改革为视角

释明权是大陆法系民事诉讼中的一项重要法律制度.随着我国审判方式改革的推进,诉讼模式转换所带来的适应性问题是不容忽视的,而在当事人主导的诉讼程序中引入释明权制度不失为一种比较理想的方案.但在审判实务界,也一直未能对释明权制度引起足够的重视.释明权制度对我国民事审判方式的改革和整个民事诉讼目的的实现有着重大的意义,在我国的存在有其可能性与合理性,它能在法律层面系统地赋予和规范法官的诉讼指挥权.     

“中国梦”的经济哲学研究

"中国梦"是一种国家理想,它牵引着社会的发展方向。"好经济"是一种群众期盼,与经院经济学家的理论构思有着较大的差别。"中国梦"与"好经济"的现实基础和实现力量具有一致性,那就是生产实践和劳动人民。然而,这二者又不是一个层面的内容,"好经济"既是"中国梦"型塑和拓展的前提,也是"中国梦"的此岸性。     

犯罪人真的是不理性的吗——与陈和华教授商榷

犯罪学研究的犯罪人应当是理性的犯罪人。行为人选择犯罪虽然在价值理性的角度看存在不理性的成分,但是犯罪学的研究应当注重犯罪人行为的实践理性与工具理性。犯罪人对犯罪的长期后果（法律后果）低自控与低自珍不是决定犯罪人非理性的决定因素。适应性非理性应当注重对于犯罪情境的分析。当代理性选择理论强调犯罪人的有限理性,犯罪预防的落脚点在于对于犯罪人犯罪机会的控制与犯罪具体社会情境的抑制。     

网络民主参与的伦理意义及实现路径研究

随着网络及相关技术的不断发展，构建有序的网络民主参与路径，成为社会主义政治文明建设和国家治理现代化的重要方面。文章论述了网络民主参与具有提高公众参与国家事务积极性、提高网民政治素养和道德觉悟、推动国家治理体系和治理能力现代化等伦理意义。讨论了当前网络民主参与存在少数网民网络民主参与的理性不足、在一些舆情发展过程中缺乏有效地舆论引导能力等问题，并认为网络政治伦理体系建设的滞后等是导致各种问题的主要原因之一。提出培育网民公共理性，加强和完善舆论引导能力，特别是构建具有中国特色的网络政治伦理体系，可从根本上解决网络民主参与的诸多问题，筑造网络民主参与的有效路径，推进国家治理现代化。     

浅析侦查中的直觉决策

直觉决策从心理意识的角度研究决策者的决策行为,对经典的"经济人"追求"最优决策"的决策假说提出了挑战,是目前决策理论发展的新趋势。而侦查活动的特点决定了直觉在侦查决策中是一个无法回避的问题,同时也发挥着无可替代的作用。因此,用直觉决策的理论来分析侦查工作,正视直觉在侦查决策中的作用,注重直觉决策与理性分析的结合,并在组织内部形成经验的良性传承,将有助于提高侦查决策的水平与质量,改善公安工作。
