中国和瑞典劳动合同期限的比较研究

在劳动关系中,劳动合同期限反映了一个国家劳动力市场状况和劳动关系基本现状,体现劳动者在劳动过程中的主体地位和社会价值。我国劳动立法对劳动合同期限的笼统规定不利于建立稳定的劳动关系,不利于培养熟练技术工人阶层,进而影响我国产业发展和社会稳定。短期劳动合同的弊端日见凸现,劳动合同期限已成为劳动合同立法的焦点问题。通过与劳动关系比较稳定的瑞典劳动合同比较研究,提出对我国现行劳动合同期限的完善和建议。     

新中国建立初期北京解决娼妓问题述论

北京近代以来多是中国政治中心，所以和其他工商业发达的城市相比妓女数量较少，采取断然禁娼不会产生较大的社会动荡，故新中国建立之初北京一夜之间封闭了全市所有的妓院，并对妓女进行集中收容、教育、改造和安置。这一方式被称为“北京方式”。北京市封闭妓院、改造妓女，取得了巨大的成功，在教育方式、区别对待妓院经管人员与普通妓女、社会动员等方面积累了一些可资借鉴的经验。

Effective prison rehabilitation system： Special reference to Sri Lanka

Prison is one of the main and important agencies which involves in the criminal justice process. Offenders who are sentenced to imprisonment are sent to this institution for rehabilitation. The main objective of the prison institution is to rehabilitate prisoners thereby helping them to understand what was wrong with their behaviors and helping them to become productive citizens in the future after releasing from prison. In order to achieve this task, the prison system should take necessary steps to conduct an effective rehabilitation process during the imprisonment period and to ensure the protection of their human rights. The present situation in prisons, the increasing rate of the reconvicted and the recidivism demonstrate that the prison system in Sri Lanka is not able to successfully reach its main goal that of the adequate rehabilitation of offenders and sufficient protection of their rights. This paper focuses on an effective prison rehabilitation system for Sri Lanka through the protection of rights of prisoners. To reach this goal, the role and the importance of the concept of rehabilitation as a main objective of punishment, present international regional and national laws relating to the rights of the prisoner, existing prison system in Sri Lanka, the current problems in our prison system and reasons for the problems are discussed. Furthermore, the initiatives and the measures that could be taken for an effective prison rehabilitation system in Sri Lanka and the role of the public and privates institutions in this regard are also considered.     

Rehabilitation of abandoned housing projects： A comparative analysis on laws and practices in Peninsular Malaysia,New South Wales and Australia

Even though there are laws and policies promulgated by the Malaysian government to govern housing industry, abandoned housing project is still one of the housing malaises in Peninsular Malaysia. If it is not feasible to rehabilitate the abandoned housing projects, they will be stalled forever to the detriment of the purchasers. Virtually, there is no universal way to resolve this problem due to the fact that issues faced by the stakeholders are different in almost every abandoned housing project. Thus, different methods are absolutely necessary to tackle the problems especially to rehabilitate those projects. To this point, laws and practices in New South Wales, Australia may deserve consideration.     

Programs for Men who Perpetrate Domestic Violence: An Examination of the Issues Underlying the Effectiveness of Intervention Programs

This review paper seeks to explore some of the reasons why rehabilitation programs for male perpetrators of domestic violence appear to be less effective in reducing recidivism than programs for other offender groups. It is argued that while the model of systems response to domestic violence has predominated at the inter-agency level, further consideration might be given to way in which men’s intervention groups are both designed and delivered. It is concluded that the program logic of men’s domestic violence programs is rarely articulated leading to low levels of program integrity, and that one way to further improve program effectiveness is to incorporate some of the approaches evident in more general violence prevention programs and from what is know about good practice in general about offender rehabilitation.

初论矫正项目

矫正项目的出现与发展源自于监禁教育刑思想。作为监狱系统专门用来实现罪犯某个具体矫正目标的系统化、程序化、规范化、可操作性的干预措施或课程,矫正项目在罪犯的教育改造中具有非常重要的作用价值。矫正项目具有科学性、专业性、多学科性、规范性、整合性和开放性等特征,是教育改造罪犯比较先进的一种新型手段和有效载体,对于创新教育改造具有重大借鉴价值和广泛应用前景。     

论我国劳动争议处理体制的重构

随着我国经济体制改革和劳动制度改革的不断深入 ,我国的劳动争议的呈现出新的特点 ,同时现行的劳动争议处理制度存在的缺陷也日益暴露。因此笔者认为需要对我国的劳动争议处理制度进行重构 ,实行“或裁或审和特别的审判专属管辖”相结合的劳动争议处理制度     

Child-related leave and women’s labour market outcomes: towards a new paradigm in the European Union?

The current European Union (EU) legislative framework on child-related leave is facilitating an imbalance in the take-up of leave by women over men. There is a consolidated EU right to maternity leave for mothers but there is no parallel EU right to paternity leave for fathers. The EU right to parental leave is for both working mothers and fathers, but its design does not encourage an equal take-up by women and men. The aim of this article is to gain insight into the effects of child-related leave on women’s labour market outcomes. On the one hand, it reviews and analyses economic literature which points to the adverse consequences of leave on women’s earnings, and even on women’s labour market participation when the absences from work are very prolonged. On the other hand, it underlines the new direction followed by the European Commission towards greater equality between men and women at home and at work.
