法律实证研究中的伦理问题 以刑事法为视角

在刑事法律实证研究中,由于被研究者多为极易受到研究伤害的弱势群体,研究过程及结果又往往涉及司法改革和司法公正等重大问题,因而研究伦理亟需规范。实证研究本质上是一种生产知识的方法,对刑事法律实证研究的伦理规范主要是对研究权力的规范,目的是防止知识、权力与资本的“共谋”。应当遵循自律、纪律和法律的总体思路,设立伦理审查委员会,依据尊重、保护、公正、全面的原则,规范我国的刑事法律实证研究。在规范的同时还要建立相应的保障机制,以解决实践中法律实证研究难以开展的不利局面。     

民事间接强制执行适用原则研究

民事间接强制执行的适用原则,是指导与规范民事间接强制执行措施的基本准则。由于大陆法系各国在间接强制执行措施的设置以及立法指导思想存在差异,致使有关这一原则的规定不尽相同。为了指导我国间接强制执行,以及保证有关间接强制执行的规范性与统一性,我国不仅应当采用立法的形式对于间接强制执行的适用原则作出规定,而且这些规定应当体现执行措施申请原则、间接强制执行特定原则以及间接强制执行有限原则。     

Ethical and legal dilemmas surrounding bio-banking

The interaction of medical technology and advancements in human life and biological tissue offers many possibilities and issues, for example the area of assisted conception and the identification and treatment of disease. However, hand-in-hand with these, ethical dilemmas arise. The overarching ethical issue surrounding cryo-preserved embryos is： Should an embryo be accorded the status of ＇life＇ or should it be labeled nothing more than ＇property＇？ This question is the interaction between frozen embryos and divorce, adoption, research and terminal incidents; it is a legal and ethical quagmire that cannot be readily resolved. This issue is of particular moral importance when one contemplates the fact that the scientific definition of life is dealt with on a continuum ranging from the metabolic view to the emergence of self-consciousness. The question must become property versus life or, in essence, sale or destruction of property versus sale or destruction of life. As this paper will show, the underlying attitudes of the progenitors involved in cryogenics can be driven by the darker side of our species; that side being the possible exploitation of those individuals or those capable of becoming individuals for personal and community gain while denying or rationalizing that point of view to society as a whole.     

“科学主义”对大陆法系影响的考察与反思

中国当下法学界对法律知识属性及法学学科定位的探讨,正推动着新时期中国法律与法学的智识转型。而在此进程中,也开放和引发出了对＂科学主义＂问题的反思。由于＂科学主义＂渊源于大陆法系的知识脉络与谱系,再加上近代中国法治建设深受大陆法系的影响,因而,对于＂科学主义＂在欧陆产生的社会背景及其对大陆法系的影响进行考察和反思,便具有了深刻的意义。＂科学主义＂在近代欧陆国家的产生缘于近代西方自然科学的兴盛和欧陆各国公共领域的缺乏,而＂科学主义＂一经形成便对近代大陆法系产生了深刻影响并引发了诸多问题。实践表明,只有文化论法律观的引入和确立,才能从根本上超越和克服＂科学主义＂对法律及法学发展的不良影响。     

足迹学研究课题归纳

所谓课题无非就是尚未解决的问题。足迹学研究课题有理论与实践两个方面的内容：从理论研究层面剖析,足迹学主要存在验证、丰富与完善自身理论体系等相关课题;从实践应甩层面探讨,足迹学需要解淡的主要是应用广度与深度,以及信度与效度等若干课题。它们基本反映了今后一段时期内足迹学学科建设过程申需要解决与面临的重点与关键。     

Benford's Law for Quality Assurance of Manner of Death Counts in Small and Large Databases

To assess if Benford's law, a mathematical law used for quality assurance in accounting, can be applied as a quality assurance measure for the manner of death determination. We examined a regional forensic pathology service's monthly manner of death counts (N = 2352) from 2011 to 2013, and provincial monthly and weekly death counts from 2009 to 2013 (N = 81,831). We tested whether each dataset's leading digit followed Benford's law via the chi‐square test. For each database, we assessed whether number 1 was the most common leading digit. The manner of death counts first digit followed Benford's law in all the three datasets. Two of the three datasets had 1 as the most frequent leading digit. The manner of death data in this study showed qualities consistent with Benford's law. The law has potential as a quality assurance metric in the manner of death determination for both small and large databases.

论司法警官院校科研建设的科学化

科研工作在司法警官院校占有重要地位,只有全面提高司法警院科研建设科学化水平,才能使司法警院科研建设走上科学发展的道路,为司法系统培养高素质的人才及提供理论服务。目前,司法警官院校科研科学化建设存在着评价机制、激励机制不完善,管理水平有待提高等问题。分析这些问题并找到问题的原因,才能找到有效的途径,提高司法警官院校科研建设的科学化水平。     

促进北京市社科规划项目科研成果转化的对策建议

本文在对“六五”到“十五”期间北京市哲学社会科学规划项目研究成果应用转化的情况和问题调研分析的基础上,引进知识管理理念,提出在“十一五”规划项目管理中针对科研成果应用转化的具体可行的管理建议和措施。
