回归后澳门金融发展的前景

本文以“九九”回归为背景，分析了澳门金融业的现状，指出其存在的主要问题和缺陷，如金融市场不发达、金融结构单一、金融业对外依赖性强、信贷资产结构不合理存在金融泡沫及资金利用不充分等等，并影响到澳门金融业未能发挥其应有的作用。针对上述问题，对回归后澳门金融业如何进一步发展，逐步完善其结构，发挥现代经济的核心作用，作了对策性探讨。

本文以北京某医院住院部的工伤截瘫患者为研究对象，着重阐述社会制度尤其是工伤保险政策对工伤截瘫患者的影响。试图通过此研究引起社会各界对工伤患者的社会回归问题的关注，促成相关问题的解决。     

卓越管理的“黄金法则”——试论加强行政伦理建设

行政伦理,也就是关于“治国”的伦理。它是执政党、国家机构和全体公职人员在治理国家的过程中,以权、责、利的统一为基础,以协调个人、组织与社会的关系为核心的行政行为准则和规范系统。行政伦理在“以德治国”中具有关键性价值。行政伦理失范的问题目前较为普遍。主要原因之一是行政运作过程中缺乏最基本的行政伦理规范和法制秩序。从自律性特点分析,需要加强行政伦理的养成机制建设,就是要加强行政伦理的教育与修养;从他律性特点分析,需要加强行政伦理的监督机制建设,不但要完善现有的法律,加大执法力度,而且要加快对行政伦理立法。

Back Home? Refugees' Experiences of their First Visit back to their Country of Origin

This paper argues that the first visit ‘back home’is important for refugees because it acts as a catalyst forrenewed engagements with host country and country of origin.The study shows that conditions in both countries impact ondecision-making and ultimately that integration and return cancoexist. The first re-connection with ‘home’ isdescribed as a memorable event in and of itself. Marked by anawareness of the passing of time, it provides both an end towaiting and worrying and a measure of one's progress (or lackof) in life, thus enabling participants to move on. Establishmentof safety nets in both host and home countries as a conditionfor permanent return distinguishes the predicament of theserefugees from that of other migrants. As the meeting betweenimagination and reality, the first visit contributes to there-examination of the refugee cycle, the myth of return andthe meaning of home in a context where return encompasses onediscrete experience, the visit, and subsequent events. Overall,the paper provides a link between the literature on return asimagined while in exile and accounts of the reality of post-return.     

论侵害人格权之获益返还——兼论《侵权责任法》第20条的适用

侵害他人人格权获得利润,本为现今之普遍现象。但是如何处置此种不当获益,乃民法上之重大课题。我国《侵权责任法》第20条对此设有较为周全之规定,但未言明该请求权之性质,对其适用恐嫌不妥。因此,以批判的观点检讨现行立法及学说的规定,认为其实质上是不法管理制度,并认为其适用范围仅限于人格权受侵害之财产损失,不及于精神损害。同时明确其构成要件和法律效果,明确其与侵权损害赔偿请求权及权益侵害不当得利请求权的关系,至为关键。

The Impact of Socio-Cultural Integration on Return Intentions: Evidence from a Survey on Romanian Migrants

Abstract

This article analyzes the impact of socio-cultural integration on migrants’ intention to return to their country of origin. It distinguishes between the potential effects of inter-ethnic relations, language proficiency and perception of discrimination as components of integration. It uses individual-level data collected through an original survey among Romanian migrants in January 2018. It aims to test the effects of socio-cultural integration against those of alternative explanations provided in the literature. The findings indicate that the perception of discrimination, assessment of public institutions’ performance and belonging feelings are important predictors for return intentions.     

德性的复归与出路——麦金太尔德性视域中的亚里士多德

在希腊时代各种冲突的德性观念中,亚里士多德的德性观始终据于中心地位。然而,自启蒙运动以来,由于亚里士多德的德性传统被摒弃,德性已经退居边缘地带。为寻求摆脱道德困境的出路,麦金太尔在追溯以亚里士多德为中心的德性传统的同时,提出了他自己的现代德性论。而麦金太尔的德性论亦是对亚里士多德德性传统的复归和充实。本文旨在通过对亚里士多德德性传统和麦金太尔的德性理论的分析,厘定德性的概念,对西方德性伦理进行有益的梳理。
