在风险社会,风险具有高度的不确定性,即风险在发生、预防、控制和所致结果方面都是不确定的,这在食品侵权领域表现为食品侵权事件的大规模性,即牵涉的受害人主体众多,且受到影响的社会秩序范围广、时间长、程度深。针对食品侵权事件的该种特性,并考虑到我国相关法律规制欠缺准确性,故应该坚持危险责任理论在食品安全领域的应用,以加强对于弱势消费者群体的保护,减轻国家和政府的负担,维护社会的稳定和有序发展。 相似文献

This essay considers how the current compulsion to digital reproduction – the urge to digitize, network, and online previously not-online materials – offers researchers of and within queer circuits the opportunity to defamiliarize and denaturalize our participation in academic systems of exploitation and to reorient our work towards decolonizing research economies, habits, protocols, and relationships. It takes the Cabaret Commons, the authors’ speculative digital archive of and for trans- feminist and queer (TFQ) grassroots performance scenes in Canada, Mexico, and the United States, as its point of departure. The authors frame TFQ performance and party scenes as negotiated intimacies, cultivating ethics of vulnerability and risk, which operate within and as networked intimate publics. Reading across decolonial, queer, feminist, and trans- ethics and methods, this essay revisits the value of ephemerality, of strategic evaporation, non-storage, and forgetting in online research contexts. 相似文献

‘Electronic Monitoring’ (EM) uses devices to monitor individuals’ whereabouts. In 2010, South London and Maudsley medium secure unit introduced EM to monitor individuals on leave. Analysis after two years revealed EM was associated with increased unescorted leave and reduced leave violation; however, comparative costs were not established. This study aims to compare costs of EM for patients on leave by comparing average total cost per patient with and without EM. Costs were compared before and after implementation of EM. Total cost of leave for each group was divided by number of patients to generate average total cost per patient. The average total cost per patient without EM was £1702; £1617 with EM. Although cost decreased, this was not statistically significant. The results showed no significant difference between average total costs per patient before and after EM. The finding of EM being cost-neutral is cautiously optimistic. Further trials are recommended. 相似文献

Many large-N cross-national studies claim to show that political institutions and phenomena determine where foreign direct investment (FDI) flows. In this article, I argue that these studies tend to overemphasize statistical significance and often neglect to assess the explanatory or predictive power of their theories. To illustrate the problem, I estimate variations of a statistical model published in an influential article on “Political Risk, Institutions, and FDI.” I find that none of the political variables that the authors consider accounts for much of the variation in aggregate FDI inflows. To ensure that this underwhelming result is not driven by misspecification or measurement error, I leverage a large firm-level data set on the investment location decisions of thousands of multinational firms. Using nonparametric machine-learning techniques and out-of-sample tests, I show that gravity variables can help us develop very accurate expectations about firm behavior but that none of the 31 “political determinants” of FDI that I consider can do much to improve our expectations. These findings have important implications because they suggest that governments retain some room to move in the face of economic globalization. 相似文献

In this article, we explored the effect of prior victimization severity on perceived risk using a cross-national sample. We extracted data for all variables from the International Criminal Victimization Survey (ICVS) and the European Survey on Crime Safety (EU ICS). Using Ordinary Least Squares (OLS) regression for both pooled data and individual countries, we found that, in addition to numerous control and prior victimization variables, our key independent variable—perceived severity of victimization—generally influences levels of perceived risk. 由“吸毒驾驶”引发的恶性交通事故频发,呈日益增长且难以遏制的态势。针对“吸毒驾驶”日趋严重问题,公安机关在推动“毒驾入刑”和查处“吸毒驾驶”方面做出了不懈的努力,国务院在关于《禁毒法实施和禁毒工作情况的报告》中也曾建议《刑法》增设“毒驾罪”。2011年我国出台《刑法修正案(八)》,把醉酒驾驶规定为犯罪,与“醉驾”相比,“吸毒驾驶”对道路交通安全和社会公共安全的危害更大。本文以同醉酒驾驶作风险比较和从刑事侦查作操作考量为视角,对“吸毒驾驶”入刑的必要性、可行性及几个关键性问题进行论述。 相似文献

证券式众筹虽为一种新型的互联网融资方式,但仍具有集资性和公众性的双重特点,这表明证券式众筹可能面临擅自发行和欺诈发行证券的风险,故有必要对其进行监管。较之于传统公开发行,域外立法已创新证券式众筹监管理念,并作出相应的制度设计,其监管重点已单纯从发行人信息披露、投资者适当向兼顾投融资限额、投资权利维护转变以及强化中介机构在证券式众筹监管中的作用,此举或许可为我国证券式众筹合法化及其监管制度的确立提供有效借鉴。须创新证券式众筹的监管理念,并分别从发行人、中介机构资格与义务设定以及投资者权利的直接维护来确立证券式众筹监管的法律进路。 相似文献
