民间借贷犯罪化趋势的原因探析及对策建议——以非法吸收公众存款罪为中心的考察

北京地区高发的非法吸收公众存款犯罪,在行为模式和犯罪成因上都具有独特性,使我们有必要重新审视本罪的司法认定。从认识层面看,非法吸存入罪是防范金融风险的必要措施,以放贷为目的吸存、以吸存为业、不顾风险吸存用于实业的行为均应列入非法吸收公众存款罪的打击范围。从实践层面看,打击非法吸存犯罪存在取证、定性和追赃上的难题,需要社会与司法形成合力,加强综合治理。放松对非法吸存行为的打击不仅无助于解决民间融资的困境,反而可能进一步恶化民间融资的秩序。     

An assessment of Bayesian and multinomial logistic regression classification systems to analyse admixed individuals

Multinomial logistic regression (MLR) has been applied to the prediction of hair and eye colour. Here we apply it to the prediction of biogeographical ancestry (BGA) in a test set of 1092 admixed and non-admixed genotypes from the 1000 Genomes Project using a training set of 571 non-admixed genotypes from the HGDP CEPH cell line panel. Predicted BGAs are consistent with those of Structure, a naïve Bayesian classifier.

特许经营作为民营化的一种常见方式被广泛应用于公用事业领域，但我国公用事业特许经营决策机制中风险评估制度的缺失，使公用事业市场化改革隐藏着巨大风险。通过对风险评估制度内涵及其性质的分析，揭示出风险评估的作用及其局限性，并试图在此基础上构建一套行之有效的风险评估制度，以确保评估主体的独立、评估内容的全面、评估程序的科学和公正、评估结论的说理和公开。     

Issues in Risk Assessment in Child Protective Services

ABSTRACT

Child welfare organizations throughout North America have expended millions of dollars to develop, implement, and institutionalize formal risk assessment models to improve decision making for maltreated children and their families. This article summarizes findings of the risk assessment literature and concludes that many risk assessment protocols currently in use may not improve either the consistency or the accuracy of protective service decisions for maltreated children. The article recommends strategies to improve decisions that promote child safety by utilizing a continuum of empirically supported decision making tools, each designed for a specific purpose during the life of the case.

Deregulation and Emergency Contraception: A Way Forward for Women's Health Care?

A deregulation of medicines is currently underway in the U.K. and France. Emergency contraception has become available over the counter in pharmacies in both countries. This might constitute a further step in the liberalisation of contraception, something which has always received support from women’s organisations and from women themselves. It also forms part of a current revolution in patient behaviour. This article examines the law governing the deregulation of emergency contraception in the U.K. and France and assesses how far this might serve to empower women to take control of their own reproductive health care provision. It considers some of the British feminist critiques of the limit to patient’s autonomy put forward by Sheldon(1998), Foster (1998), and Murphy (1998).
