对三个公安基本理论问题的思考

在实施依法治国、依法行政和依法治警的条件下 ,公安机关的职能应该有区别于其它社会部门的职业性表述 ;除了继续贯彻执行党委领导下的群众路线这一根本路线外 ,应该拟定一个指导新时期公安工作的基本路线 ;传统的公安工作政策应该有所调整和创新。     

准据法选择的新方法:基于人本视角的研究

Traditional theory often emphasizes the abstract national sovereignty not private rights. The value and rules of the method to choose applicable law need to be constructed. In the theory based on the protection of people and the private rights, The method to choose applicable law should be on the premise of respecting national sovereignty, which should attach more importance to the protection of private rights, respect the principal position of people, give play to the role of the body of the people, safeguard the interests of the people, pay attention to the value of people, be placed in the equal status of domestic and foreign law, emphasize the foreign-related civil and commercial disputes solved properly and protect the civil right from damage.     

The Search for Job Satisfaction: A Survey of Alabama Policing

This study examines police job satisfaction and its association with general occupational attraction. Police officers from sixteen municipal departments (n = 1,114) across one southern state (Alabama) were found to possess moderate-high overall job satisfaction, with regression analysis supporting the conclusions of prior studies that demographics are of little value to understanding job satisfaction. The findings convey that 25% of job satisfaction variance can be explained from six variables (in order of importance): social contribution, pay, adventure/excitement, autonomy, peer respect, and job security. The importance of benefits and community respect was unsupported, as were partner and special operation assignments. The author concludes that a great portion of police satisfaction hinges on the realization of work environment expectations, and that departments must proactively construct policies to enhance fulfillment of officer aspirations.

社会发展的原动力,历来有多种说法,实事求是地讲,从宏观角度看即人民群众日益增长的物质民主文化需求,从微观角度看是个人的利己性和利他性。其根源在于人的物质属性与社会属性,在于自然界生存竞争即适者生存过程中个体选择与群体选择的对立统一。对这个需求的不断满足,利己性和利他性的不断发挥作用,有力地推动着科技生产力的发展和阶级斗争的进取,推动着人类社会的整体演绎。对这个问题的深入探析,有助于促进科学发展观以人为本理念的贯彻,促进社会主义民主与法制建设,促进社会主义市场经济体制健康发展,和谐社会务实构建。     

Race-Based Peremptory Challenges: An Empirical Analysis of Litigation from the U.S. Court of Appeals, 2002–2006

This paper examines race-based peremptory challenges. Such challenges occur during the voir dire jury selection process. The process allows both the defense and the prosecution to strike jurors who they believe will not decide cases fairly. However, in the case of Batson v. Kentucky 476 U.S. 79 (1986), the Supreme Court ruled that race could not be used as a factor in eliminating prospective jurors. This paper examines federal litigation for five years in which it was alleged that race was used as a factor in removing a juror. An examination of the cases revealed that most of the cases involved sole male litigants who allege that there were multiple race-based peremptory challenges used in their cases. Moreover, most of the cases that led to the allegations involved violent offenses. Other case characteristics are noted, but of most significance was the finding that most appellants lost their cases. As such, the courts felt that most of the challenges were, in fact, race neutral. The implications of this research are discussed. This study was funded by an undergraduate research grant from Penn State University.

“80后”群体受到社会广泛关注。“80后”大学生在思想观念、价值取向、人生态度等方面表现出鲜明群体特征。“抗震救灾”等公共事件凸显“80后”大学生“值得信赖，敢担重任”。科学发展观对“80后”大学生教育有重要引领作用。“80后”大学生教育的路径选择要以科学发展观为统领，以学生的发展为目的，以学生的成才为根本。     

农村房产执行的法律障碍及其出路

农村房产如何执行,我国法律和司法解释基本空白,而现今的宅基地制度、房产制度、社保制度等,又构成了执行农村房产的重重障碍.将农村房屋使用权从所有权中分离出来或将农村宅基地所有权收归国有是消除这道障碍的两个出路,前者是在现有土地所有权制度上作技术性的添加,让房屋使用权承载执行的需要,避免土地制度遭受执行的冲击,后者则是对农村土地所有权制度作部分修改,使宅基地使用权的城乡二元分立结构走向城乡一元的统一,从而实现城乡房产执行制度的并轨.同时农村房产执行中应体现人权高于债权的理念,应尊重当地民风民俗,保障房屋共有人、承租人及同村村民的优先购买权,这样既有利于债权人权利的实现又促进了和谐社会的建设.     

The gender politics of executive candidate selection and reselection

This research provides new theoretical and empirical insights into the gender politics of the springboards to chief executive office. The extremely masculinised composition of the relatively few top national executive positions has posed a serious impediment to empirically assessing the conditions that may facilitate women's under-representation and men's over-representation. To overcome this constraint, this study looks at the top regional executive office across four West European countries that present a multilevel state structure – namely Austria, Germany, Spain and the United Kingdom. Using two original datasets, the article examines the ways in which the selection and reselection of regional prime ministerial candidates is shaped by individual, organisational and institutional factors that produce heterogeneous experiences and career opportunities across sex. The results show that women have not shattered the glass ceiling at the regional level and pinpoint the fact that they are held to higher standards, benefit less from the political resources they possess and are more dependent on the decision environment in which parties select executive candidates. The conclusion is that the rules of the game guiding selection and reselection processes are strongly biased towards men.
