论我国建立民事诉讼快速审判程序的立法选择

我国的民商事纠纷的不断增加，便人民法院受理的民商事案件数量也快速增长。为了应对不断增长的诉讼潮，关键在于健全我国的民事审判程序体系，增设一个独立于现有审判程序的，全新而又高效的审判程序就是重中之重。根据现代民事诉讼法理，综合考量我国历史文化因素和现实状况。在民事诉讼中，建立快速审判程序是我国民事诉讼法的应然选择。     

Arrogant Posh Boys? The Social Composition of the Parliamentary Conservative Party and the Effect of Cameron's ‘A’ List

In the light of the recent controversy over Andrew Mitchell's alleged ‘pleb’ comments to police officers and Nadine Dorries’ characterisation of David Cameron and George Osborne as ‘arrogant posh boys, this article examines the social composition of the parliamentary Conservative Party. It looks at previous attempts to widen the social base of the PCP and analyses the effect of Cameron's priority or ‘A’ list of candidates on the composition of the 2010 PCP. The article asks whether the perception that the Conservatives are the party of the rich has damaged the party's electoral appeal and if so what can be done to rectify the situation.     

判例生成与中国案例指导制度

依据法律功能主义,我国案例指导制度可纳入广义的判例制度之中。判例生成制度是判例制度的物质基础。我国指导性案例的生成,主要依赖最高人民法院的司法外权力,采取不以司法等级权威为基础的案例选拔方式,没有遵循普遍的形式主义进路,没有严格依傍法院体系和审级制度,其实效有待观察。最高人民法院和高级人民法院都应成为判例法院,并可遴选自己法院的案例为指导性案例,现行案例遴选标准大体符合判例遴选的一般原理。判例遴选制度对应的是有限援引制度,有限援引制度在成文法语境中并不会面临普通法语境中的正当性质疑,案例指导制度应允许法官直接援引指导性案例。案例指导制度的未来发展应与我国整体司法改革彼此深化、相互促进。     

新农村建设视阈下农村非政府组织能力建设的现实困境与路径选择——以福建省部分地区调研为例

非政府组织是新农村建设中不可忽视的重要社会力量,其能力建设关系到非政府组织作用的最终发挥,关系到社会主义新农村建设的进程和成效.但由于相关体制、机制的约束和新农村建设中存在的新情况、新需求,使得目前我国农村非政府组织能力建设还存在一定的现实困境.因此,必须大力加强农村非政府组织的能力建设,使其为新农村建设作出应有的贡献.     

A deterrent to diversity: The conditional effect of electoral rules on the nomination of women candidates

Previous literature regarding the effects of electoral systems on candidate selection has implied a false dichotomy regarding proportional representation (PR) versus single member districts (SMD). This paper unpacks the category of proportional representation, and finds significant differences in the behavior of selectorates depending on their configuration of PR. Using both a natural experiment as well as an original data set comprised of 1095 party lists, I find that the type of proportional representation – i.e., whether or not the voters are allowed to pick a particular candidate from the party list – can have a significant effect on the number of women candidates selected to run for office. Further, I find that the strength of this effect depends on cultural gender norms; if a substantial segment of society believes that women are best in traditional roles, not as leaders, there is a significant, negative effect of the decisive intraparty preference vote on the nomination of women candidates.

Selfish and Indoctrinated Economists?

Many people believe that economists in general are more selfish than other people and that this greater selfishness is due to economics education. This paper offers empirical evidence against this widely held belief. Using a unique data set on giving behaviour in connection with two social funds at the University of Zurich, it is shown that economics education does not make people act more selfishly. Rather, this natural experiment suggests that the particular behaviour of economists can be explained by a selection effect.JEL Classification: A13, A20, H41
