权力视野下的行政国与法治国

二战以后,行政国已成为各国行政权扩展后的一种普遍现象,而从古典法学理论开始就追求的法治国,在现代中国完善法治的进程中又有着重要的意义。行政权与法治权是一对古老的矛盾,是传统三权中最为强势的一对权力关系。行政权与行政国,立法权与法治国的纵向关系、行政权与立法权,行政国与法治国的横向关系、立法权与行政国,行政权与法治国的交叉关系是四者之间的基本关系范畴,而行政国与法治国的关系也是基于这个关系之上。     

论农村基层民主建设中的几个辩证关系

新中国60年,农村基层民主建设获得了巨大的进步,但也还存在许多改进的空间,若要进一步解放农村的民主动力,必须以辩证的思维正视＂治＂与＂乱＂之争、＂进＂与＂退＂之思、＂政＂与＂民＂之辨、＂上＂与＂下＂之衡、＂刚＂与＂柔＂之合,从认识和实践上解决一系列难题。     

“关东州”的殖民文化研究——以日语教育为中心

"关东州"的日语教育始于日俄战争期间,随着租借期限的延长,其殖民教育政策及措施在不断地发展。到"九.一八"事变之前,其奴化教育体系已然成型,同时,为了长期维护日本的殖民统治,推进普及日语教育策略,还建立了奖励学习外语的"语学检定"制度。在《关东州人教育令》颁布后,奴化教育达到了顶峰,以实现对大连地区乃至整个东北进行文化侵略和殖民奴化教育的目的。     

鸭肝炎病毒VP1和VP3基因的克隆及其杆状病毒表达载体的构建

为了构建鸭肝炎病毒VP1和VP3结构蛋白基因的杆状病毒表达载体,以RT-PCR方法扩增鸭肝炎病毒的VP1和VP3基因,克隆至pGEM-T载体。经筛选测序验证后,以BamHⅠ+XhoⅠ双酶切回收VP1和VP3目的片段,与经相同方法处理的杆状病毒转座载体pFastBac1连接,得到重组质粒pFastBac1-VP1和pFastBac1-VP3。将经酶切及测序鉴定的阳性重组质粒转化入含穿梭载体Bacmid的感受态细胞DH10Bac,发生转座作用,经抗性及蓝白斑筛选,成功获得各自携带VP1和VP3基因的重组穿梭载体,将其命名为rBacmid-VP1、rBacmid-VP3。研究结果为进一步在昆虫细胞中表达VP1或VP3基因,开发研制鸭肝炎病毒基因工程疫苗奠定了基础。     

TRAGIC CONSCIOUSNESS,NATURAL LANGUAGE AND MODERN SPIRIT OF THE RULE OF LAW

Tragic consciousness, which originated in childhood, is complex compassion based on strong self-consciousness. After being moralized, tragic consciousness presents the dichotomy of good and evil, which has not only profoundly affected the formation of natural language, but also cradled the theory of natural law and religious spirit. Modern jurisprudence attempts to get rid of the shackles of classics and Christian humanism, to shape the autonomous and self-consistent image of law with the de lege lata as center. However, it is difficult for modern jurisprudence to surpass the natural language which rooted in tragic consciousness, and impossible to neglect or deny the independent value of the human. The inherent conflict within the rule of law makes ironically a tragedy, especially in the context of contemporary China.     

The differential demand for indirect rule: evidence from the North Caucasus

Indirect rule is one of the means that central authorities have long employed in hopes of defusing communal conflict and civil war in multicultural societies. Yet very little is known about the appeal of indirect rule among the ruled themselves. Why do people in some places demand more indirect rule and local autonomy, whereas others seem content to be governed directly by rulers of an alien culture? This is a crucial question with important implications for determining the form of governance that is most likely to provide social order in culturally heterogeneous societies. Although much attention has been given to consider the relative costs and benefits of direct versus indirect rule for the central authorities, the other side of the coin – namely, the variable demand for indirect rule among the members of distinctive cultural groups – has hardly been examined with systematic empirical data. This paper presents a theory of the differential demand for indirect rule and offers an initial test of its principal empirical implications using original micro-level data from the North Caucasus region of Russia. The theory's core claim is that the middle class should express the greatest demand for indirect rule, while both the upper and lower classes should prefer more direct rule. The theory therefore predicts that there will be an inverse parabolic relationship between the demand for indirect rule and economic class. The findings are largely consistent with these theoretical expectations.

刑事错案预防与纠错机制研究——基于浙江张氏“叔侄强奸案”的启示

法治是文明发展到一定历史阶段的标志,也是衡量一个国家发展水平的重要标尺。而余祥林案、“叔侄强奸案”等错案频频发生,引起人们对公平与正义的深深思考,而错案侵蚀着法治的精神,扭曲了法治的灵魂。在目前的刑事司法体制下,必须通过严格的刑事诉讼程序来保障刑事司法公正。基于人类认识的非至上性,司法实践中错案又不可避免地发生,因此及时纠正刑事错案是刑事司法公正的重要体现。目前我国刑事司法中存在错案发现不自觉、错案纠错不及时、申诉渠道不畅通等问题,严重影响了刑事司法公平和正义。坚持检察机关的法律监督职能,积极推动刑事错案纠错机制建设,具有重要的理论价值和现实意义。     

论中国传统文化视域的“网络群体极化”

互联网在现代生活中的重要性日益凸显,但互联网上频发的"网络群体极化"带来了一系列的社会问题。中国传统价值观中道德至上,个人价值、权利和自由的缺失是"网络群体极化"的潜在根由,为解决"网络群体极化"问题,建设健康、有序、文明的网络文化,需要加强互联网法治建设。
