农村集体土地制度的宪法解释

八二宪法的集体土地制度包括所有权层面和使用权层面。无论是五四宪法还是八二宪法,从农民土地所有权到集体土地所有权的变化无非是国家管理农村经济手段的变化。但八二宪法的土地承包经营权之确立既带有国家管理手段变化的色彩,也带有基本权利的色彩。土地承包经营权的出现与自留地的保留一样,也是农民用生存权进行抗争的结果。因为其生存权属性,土地承包经营权具有对抗国家性,当然这种对抗国家性是伴随着现代法治观念的传播逐渐增强的。同时,由于其内在缺陷,生存权无法完全有效对抗国家权力,农村土地承包经营权需要从生存权本质转向自由权本质。

公安交警大队开展辖区交通安全评价与分析是预防道路交通事故的重要措施之一,然而以交通事故四项指数为主的评价指标已经不能对现实的交通安全实际状况进行客观反映,也不能为道路交通安全科学决策提供有力的支持。文章对公安交警大队开展交通安全评价工作过程中评价体系的建立与分析进行了研究,希望能有效地提高交通安全管理工作的效能,同时提高道路交通事故预防工作的针对性和有效性。     

基层公安机关刑事案件管辖模式比较研究

打击刑事犯罪是公安机关的主要职能之一。对基层公安机关刑事案件的管辖问题进行研究,将有利于在现有公安编制不变的条件下,最大限度地提高基层公安机关打击犯罪的职能作用和管理效率。而在我国的基层公安机关中,承担主要刑事案件破案职责的是基层刑侦部门(即刑警队)和派出所。因此,对目前我国比较具有代表性的"所队刑事案件管辖模式"进行较为深入地剖析和探讨,将对不同地区的基层公安机关在刑事案件管辖模式的选择问题上有所裨益,并且有利于最大限度地提高基层公安机关的管理效能。     

公安院校兼职教师队伍建设的思考

作为一类特殊职业教育的承担者,公安院校教师不仅需要扎实的理论功底,公安教育的应用性、实战型特点也对教师教官的实战阅历、实践经验有很高的要求,选聘具有丰富公安实战经验的兼职教师是公安院校师资队伍建设的必然选择.针对当前公安院校兼职教师管理中出现的观念落后、稳定性不强和制度缺失等问题,提出更新教育理念、拓宽选聘范围、更新教学模式和加强制度建设等意见建议,以期为公安院校教师队伍建设提供参考.     

浅谈警用枪支走火的原因及对策

公安民警在日常执勤、执法中涉及枪支走火,造成人员伤亡的原因:民警不规范使用枪支,缺乏专业训练,安全意识差 ,枪支机械故障.对策:组建枪支弹药理论教官队伍,系统进行教学培训,规范使用枪支;严格遵守擦拭保养制度,及时排除枪支走火的故障.     

Promoting empowerment? The World Bank's Village Investment Project in Kyrgyzstan

This article examines the extent to which the World Bank's community-driven Village Investment Project empowered people to influence the choice of local investments (micro-projects) and to exact accountability from their leaders. It is based on qualitative interviews and group discussions in 16 rural communities. The research demonstrates that the project provided an effective mechanism for responsive infrastructure delivery to address local priority needs. However, it did not improve accountability either within or outside the micro-project boundaries. The project's bottom-up development model was not by itself sufficient to enable people to exercise power over local government officials and informal leaders in the absence of effective horizontal accountability institutions within the state.     

POLICE RESPONSE TO DOMESTIC VIOLENCE: SITUATIONS INVOLVING VETERANS EXHIBITING SIGNS OF MENTAL ILLNESS*

Drawing on attribution theory, research on police discretion, and public attitudes toward mental illness, we examine attributional processes in police decision making in response to domestic violence situations involving veterans and nonveterans with signs of mental illness. Using data from experimental vignettes varying veteran status, victim injury, and suspect compliance administered to a sample of 309 police officers, the results indicate that 1) veterans are perceived as less responsible for troublesome behavior but more dangerous than nonveterans, 2) suspects’ veteran status has a significant effect on officers’ preference for mental health treatment versus arrest, and 3) part of the effect of veteran status on officer response is mediated by internal and external attributions for problematic behavior and by perceptions of dangerousness. The study empirically demonstrates countervailing processes in police decision making—recognition of the causes for troublesome behavior and the need for mental health treatment on the one hand and concern for community safety and enforcing the law on the other.     

The Politics of Jurisdiction

Jurisdiction is a central concept in the framing of the legal world but it has received short shrift in mainstream legal theory. This article examines the prevailing conceptual forms of jurisdiction in order to retrieve space for the political. The study of jurisdiction is also the study of the political community that it invokes and authorises. The first part of the article examines the three forms that jurisdiction takes in contemporary scholarship (territory, community, governance) to show that each form overlooks some implication of the political community that is tethered to jurisdiction. The second part of the article flips the inquiry to demonstrate the oversight of jurisdiction in theories of sovereign exception. The emergent understanding of jurisdiction as political provides an anchor for the study of jurisdiction going forward and highlights the potential role for jurisdictional arrangements in contemporary public law and constitutional law settings.     

Behavior Research: Improving Social Services for Young People in the Community

This research is based on a social community centre for young people. Researchers have been working together with social workers in carrying out the practical research. Using a process of problem solving, making improvement plans, applying theories into practice, feedback evaluation, and seeking further questions, we are continuously working to improve the quality of social services for young people. We also hope to improve social work methods and the professionalism of social workers.
