This Final Report is based on a series of dialogues between family law academics and practitioners from many disciplines, a FLER Project survey, and research conducted by law students at Hofstra University and Northeastern University. 2     

Crisis (hostage) negotiators weigh in: the skills,behaviors, and qualities that characterize an expert crisis negotiator

This research identified what skills, behaviors, and qualities experienced crisis (hostage) negotiators believe enhance or harm their success during negotiation. 188 negotiators from various countries (primarily United States) voluntarily completed an online survey in which they listed the aforementioned characteristics and reported on various aspects of their own background and behaviors. Open-response questions were coded and quantitative methods revealed what qualities were listed most frequently by negotiators. Active listening, displays of empathy, effective communication, and remaining calm and collected appear at the top of their to-do lists. Conversely, being confrontational, arguing, yelling, and interrupting were reported as behaviors to be avoided. Most negotiators attend trainings multiple times a year and read on the topic of crisis negotiation. About half follow a model during negotiations, typically the FBI’s Behavioral Change Stairway Model. Findings are discussed with relevance to future research directions and improvement of negotiator trainings.     

Improving soft skills and communication in response to youth unemployment

Several studies have been conducted into the high rates of graduate youth unemployment in South Africa. Results from these investigations have isolated some determinants which can be categorised under three broad headings – government, business practices and graduate attributes. the article focuses on graduates’ attributes that negatively impact on their employability. One attribute that was identified was their soft skills, particularly, their communication ability or their levels of pragmatic language usage. Pragmatic competence is an ability which is not always consequential to ordinary language development; there needs to be explicit instruction for such development. This is a reflective article with the objective of examining the nature of communication in the workplace and what strategies can enhance graduates’ communication ability, and in turn improve their employability. this article concludes that enhancing graduates’ communication skills should be a cooperative venture involving all the stakeholders in education – students, parents, higher education institutions, business and government.     

当代警察个人防护技能构成及其未来发展

人民警察作为人民大众的守护神，在面对穷凶极恶的犯罪分子以及其他危险时，都必须在合法、合情、合理并确保自身安全的前提下挺身而出。由于犯罪分子疯狂的作案手段让人难以预料，使警察职业时时刻刻面临未知风险，这就决定了个人防护技能对于警察的至关重要性。因此，对警察所必须掌握的个人防护技能的研究具有极其重要的现实意义。该文结合时代背景以及警察职业特点，采用文献资料研究与自身实战经验相结合的研究方法，尝试对警察防护技能进行探讨并提出相应的建议。     

关于大学生参与社会实践的几点思考

社会实践是培养大学生专业技能及社会适应能力的重要环节。学校需从完善运行机制、注重基地建设、突出专业特色、强化社会服务等方面统筹考虑、扎实推进、确保实效。

警务实战技能战术教学中的思维能力培养

警务实战技能战术是民警在一线工作中所需的必备技能。但在实际工作中,现场情况的处置并不是单单的动作行为,其中包含了大量的对现场情况分析及处置结果的预计,这就需要处置民警具有良好的思维能力,它既包含了普通的对一般问题的思维方法,也包含了对警务警情的专业思维方法。在警务实战技能战术教学中培养学员的这种处置思维能力,提高其在实际工作中的处置能力具有重要意义。     

关于强化高职文科学生职业能力培养的探讨

学生职业实践能力的高低决定了他们的就业竞争力。这些年,法律文秘专业毕业生就业情况一直很好,学生在同类院校毕业生中具有较强的就业竞争力。取得这一成绩的原因在于推行以下工作：校企合作构建基于工作过程系统化的课程体系,深化＂课证融合＂教学内容改革,推进认知实训、仿真实训、顶岗实习三段式职业核心技能培养体系实施及改革考核方式等,强化学生职业能力的培养。     

以个案谈法官的判决技巧——以爱克福得公司诉深圳市房产局案为例

最高人民法院公布的《中国行政审判案例》中的爱克福得公司诉深圳市房产局案展示了法官在案件判决方式上的技巧和智慧。它避开了本应该是争点的规范冲突适用问题,转换审理思路将免责事由的审查列为争议焦点。这个案例只是法官巧妙运用判决技巧的一个缩影,在最高人民法院公布的典型案件中大量地展示了法官的判决技巧和智慧。也正是这些回避和模糊的判断技巧为学者们的研究设置了障碍,使我们对案件有了不同观点的交锋和争鸣,同时也正是对这些技巧和智慧的把握为我国法治环境的改善和司法的进步产生着不可估量的积极作用。
