信息网络传播权的适用靳学军

制定《世界知识产权组织版权公约》(WCT)第8条是为了将数字网络中的作品传播权纳入到著作权中。我国著作权法中信息网络传播权的立法目的与WCT第8条相同。不能脱离数字网络传播方式来理解“选定的时间和地点”要件。数字网络传播具有交互性,即在数字网络中,数字信号是否开始向某个特定用户传输由该用户“在其个人选定的时间和地点”决定。从文义解释出发,数字网络传播也应适用信息网络传播权。为弥补立法缺陷,可以删除“选定的时间和地点”要件,合并广播权,确立实至名归的信息网络传播权。     

Intergenerational Transmission of Convictions for Different Types of Offenses

The Cambridge Study in Delinquent Development is a prospective longitudinal survey of 411 London males from age 8 to age 56. This article compares the convictions of 343 adult sons (searched up to the median age of 29) with the convictions of their fathers up to the same age. There was significant intergenerational transmission of convictions, since 43% of the sons of convicted fathers were themselves convicted, compared with 18% of the sons of unconvicted fathers. There was significant intergenerational transmission of burglary, serious and minor theft, violence, threatening behavior, carrying an offensive weapon, and serious motoring offenses. The most important mediators between parental and child convictions were the family renting rather than owning their own home, poor parental supervision, an antiestablishment attitude of the father, parental physical punishment of the child, and separation of the son from his father. Implications for the prevention of intergenerational transmission are drawn.     

Drones,state terrorism and international law

The conventional wisdom among US foreign policymakers is that drones enable precise strikes, and therefore limit collateral damage. In contrast, critics point out that many civilian casualties have ensued, and they variously cite poor intelligence and imprecision of the strikes as reasons for this. Critics have also raised concerns that the US and its allies are engaging in “lawfare” to legitimise violations of human rights law. As such, some have questioned whether academic engagement with the legal questions surrounding targeted killings amount to collusion with state attempts to legitimise human rights violations. This article will argue that by conceptualising the targeted killings programme as a form of state terrorism, we are better equipped to provide a critical analysis of the drones programme within the context of a long history of violence and terrorism which has underpinned the imperial and neo-imperial projects of the UK and US. The article will then argue that there are important similarities between the targeted killings programme, and previous UK and US counterinsurgency operations, including prior uses of air power, and operations involving the internment of terror suspects, and the targeting of specific individuals for interrogation and torture or disappearance. Common to these programmes is that they are forms of policing aimed at crushing rebellions, stifling disorder and constructing or maintaining particular political economies, through terror. Also common to these programmes are the attempts made either to conceal illicit actions, or in the event they are exposed, to shroud them in a veil of legitimacy. The article concludes by offering some brief reflections on why we should not abandon the quest to resolve the thorny legal questions around the targeted killings programme.     

Effects of Parental Substance Abuse on Current Levels of Domestic Violence: A Possible Elaboration of Intergenerational Transmission Processes

Research conducted on the intergenerational transmission of domestic violence has framed much of its inquiry from within the context of social learning theory. Although consistently significant, the effect size of social learning-derived intergenerational transmission variables is often small. This study was undertaken in an effort to broaden the theoretical basis of intergenerational transmission of family violence by assessing if incorporating parental substance abuse variables with exposure to violence in family of origin would increase the predictive power of a multiple regression model. Subjects (N = 74) were men in treatment for domestic violence. Paternal substance abuse was found to exert effects on respondents' violent behavior comparable to those from exposure to family of origin violence. Findings supported a need to broaden theoretical views of the etiology of domestic violence perpetration.

货币政策传导机制是金融宏观调控的一个重要组成部分。货币政策传导机制作为一个复杂问题,涉及多个环节,多种因素,多个主体,从而导致贷币政策的实施效果受到影响。笔者从货币政策传导的各个环节入手,实证分析了我国货币政策传导机制存在的问题,并提出了相应的对策。     

羊脑多头蚴的超微结构观察

为观察羊脑多头蚴的超微结构,寻找自然感染羊脑多头蚴的病羊,采集多头带绦虫续绦期幼虫,固定于25mL/L戊二醛中,分别取其头节、囊壁、颈部区,超薄切片后进行透射电镜观察。结果表明,羊脑多头蚴的囊壁结构具有微毛,远离头节的囊壁微毛与头节附近颈部区囊壁的微毛分布情况不同;囊壁可明显分为皮层、间质层、实质区;在实质区可观察到皮层细胞、实质细胞、成石灰小体细胞、焰细胞、成肌细胞以及排泄系统结构;头节中可观察到很发达的肌纤维结构,头节内部有类似于囊壁的皮层结构,并可见粗大微毛,细胞种类明显少于囊壁实质区,含颗粒的囊泡结构明显增多。证明羊脑多头蚴囊壁的结构和细胞种类与其他绦虫相似,但有比较发达的排泄系统;头节外表面无皮层结构,仅有呈环状围绕的纤维和囊泡结构。

决胜脱贫攻坚期间,向贫困村派驻工作队是贯彻落实党中央精准扶贫精准脱贫政策、全面建成小康社会的一种重要工作方式,也是党中央开展农村工作长期以来形成的一种有效工作机制。在项目扶贫场域中,驻村工作队的角色定位与运行逻辑既非一种"科层化运作"的"常轨"运行,又非一种"反科层化运作"的"逆轨"运行,而是一种超越"常轨""逆轨"等运行方式的"超常轨化运行"实践样态。这样一种运行实践的内在逻辑机理,可以从宏观层面的压力型体制下运动式和动员式的治理路径依赖、中观层面的组织场域下富有弹性化和灵活性的制度执行过程、微观层面的乡土逻辑下人格化和自利性的行为互动等三个维度加以阐释。

国内外输电线路设计规范风荷载取值标准的比较

以我国现行电力行业标准DL/T 5154-2002和DL/T 5092-1999关于风荷载的计算规定为基准,对国内外4套有代表性的输电线路设计规范风荷载的取值标准进行了分析比较,初步摸清了国内外规范风荷载标准值差异的定量数据.计算结果表明,我国输电线路铁塔结构的风荷载标准值普遍低于国外规范相同条件下的风荷载标准值,规范修订时建议将基本风压的统计重现期提高到50a一遇,并对我国输电线路基本风压的合理取值和统计风速的基准高度进行适当的调整.
