完善我国行政复议工作人员制度的思考——以美国联邦行政法法官制度为例

我国现行行政复议工作人员管理制度存在着诸多问题,特别是在选拔、聘任、奖惩以及救济制度中均存在不同程度的限制或影响行政复议活动公正性发挥的现象.美国联邦行政法法官制度中的选拔、聘任、奖惩以及救济采取分散管理权力的方式,以保证行政法法官的独立性.本文分析了美国联邦行政法法官制度的特点,提出了完善我国行政复议工作人员制度建设的具体建议.     

Promoting work-related activities in a high secure setting: exploration of staff and patients’ views

Introduction: Adults diagnosed with mental disorders, in particular those who have a history of offending, have low employment rates. Here we explore staff and patients’ views on the importance of work and vocational activities offered at a high secure hospital. Method: Two hundred seventy-six patients and 106 staff were approached; 54.3% of the patients and 58% of staff completed the questionnaire. Results: Educational achievement in patients was low but nearly two-thirds of patients had been engaged in some form of work prior to admission. Staff and patients felt that vocational opportunities offered in the hospital should more closely resemble ‘real work’ and they broadly agreed on the areas of activities of potential benefit. Staff felt more strongly than patients that patients lose work-related skills during admission. Both groups recognised the importance of work for mental health and in preventing reoffending. Conclusion: Detention in such settings provides an opportunity for patients to maintain as well as expand on skills aiding their future reintegration into work settings.

Understanding the links between perceived prison conditions and prison staff

In the Dutch prison system, motivational treatment is seen as one of the key contributors to a dignified and humane prison climate, stimulating inmates to assume personal responsibility and to change their lives. Staff are seen as the crucial factor to attaining this goal. The assumption is that the staff’s work situation has an impact on how inmates are treated. How inmates are treated in turn influences how they perceive prison conditions. In this study, we will examine the correlations between work situation, treatment styles and perceived prison conditions by means of a multilevel linear regression. The results show that a good work situation for prison staff is a precondition for practicing an active approach to inmates. In addition, inmates are more satisfied with the prison conditions if the various treatment styles are thoroughly applied. A balance between providing support and structure for inmates appears to be very important. Motivational treatment proves to be significantly correlated to the inmates’ satisfaction regarding prison conditions.     

我国刑法中“国家工作人员”的再研究

通过再次研究我国有关“国家工作人员”的刑事立法史和现行刑法第 93条的规定及相关的立法与司法解释 ,从宪法根据、学理和法理的角度界定国家工作人员、国家机关工作人员、准国家工作人员的概念、范围及逻辑关系 ,提出不宜将中国共产党的机关和中国人民政治协商会议等列为国家机关范围的建议 ,且在确定其国家工作人员身份时 ,将前者归属于政党或人民团体中 ,将后者归属于其他依法从事公务的人员。并建议将各级人大代表、签订用人合同的临时执法与司法人员、受委托管理经营国有财产的人员均纳入准国家工作人员的范围。

社区是职工困难群体社会保障的重点地区。社区工会是职工困难群体社会保障的重要力量 ,因而必须要加强社区工会建设。

工会肩负着维护职工群众合法权益的基本职能,如何最大限度地维护广大职工的合法权益,主要是坚持和深化职工代表大会制度,健全和完善以职代会制度为主体的职工参与民主选举、民主决策、民主管理、民主监督,维护职工政治权利的维权机制;坚持和深化平等协商、集体合同制度,健全和完善以平等协商、集体合同制度为主体的协调企业内部劳动关系、维护职工经济利益的协调机制.
