This concept of the Silk Road Economic Belt reprises the ancient traditions of the Silk Road:solidarity,equality,trust,mutual benei t,inclusiveness and learning from each other.More importantly,it also conforms to the global trend of seeking peace,cooperation and win-win development.     

Do government sponsored marriage promotion policies place undue pressure on individual rights?

The dominance of social science research in the debate over the Bush Administration’s Healthy Marriage Initiative may explain why questions regarding the proper role of government in regulating adult intimacy have received little attention. Social science research focuses on outcomes such as well-being and health. In contrast, rights-based legal theory considers whether state action undermines the rights of individuals. In this article, I intend to shift the debate over marriage promotion policy from questions of child well-being to questions of individual rights. I will ask the following questions: Do individuals have a liberty interest in making their own choices about intimate relationships, such as marriage? Do federally-financed (and frequently state-run) marriage programs compromise this liberty interest? Are there any constitutional grounds for objecting to marriage promotion policy?

COMPARATIVE STUDY OF INTERNATIONAL CARRIAGE OF GOODS BY RAILWAY BETWEEN CIM AND SMGS

China and some of its trade partners in Western Europe apply different legal regimes for international carriage of goods by railway — respectively Agreement on International Railway Freight Transportation (SMGS) and Uniform Rules Concerning the Contract of International Carriage of Goods by Rail (CIM). For transportation of goods by railway between China and Western Europe both the CIM and the SMGS are often applicable. China’s initiative “the Belt and Road” promotes development of railway transport in Eurasia and creates new incentives for comparative study between those two international legal systems. This article provides a brief historical outline of comparative studies between the CIM and SMGS. This article also purports to show that some similarities and differences between the two regimes might be better understood from the perspective of comparative legal history. Taking into account inter alia the common origin of the current versions of the CIM and SMGS in the 4th revision of the CIM of 1933, differences and similarities between two legal regimes have been analysed with regard to the following topics: the scope of application of the CIM and SMGS; the nature of the carrier’s liability under the CIM and SMGS; exclusivity of the CIM, exclusivity of the contract of carriage under the SMGS; period of responsibility; persons for whom the carrier is liable.     

刑事立案程序有关问题及其制度完善

我国刑事诉讼法规定了立案程序,由此而引发了立案前能否采取侦查措施以及立案前措施到底属于何种法律程序性质的争论。本文批判了这类争论的建构主义唯理论理路,引入实践理性理论范式,经分析认为立案程序本身即为一道多余的法定程序,立案前措施的法律程序性质的名分并不重要,关键要看该类措施的采取是否为发现犯罪事实真相之所需。侦查措施的采取一旦要涉及他人人身、财产权利的时候,是由侦查机关自主决定还是要得到批准,受到法官的审查和监督,这才是刑事程序启动环节中的关键问题。

China's "Belt and Road" initiative is emerging as the Western-dominated world order is declining.Capitalism has intensified the rich-poor divide and power politics have led to great upheavals.Western values have caused a "value dislocation" for non-Western countries.The world is calling for new development concepts.The "Belt and Road"initiative has emerged as an answer.It embodies China's ideas on global development.First,it works for the "common prosperity" of every country,which will ease contradictions between the South and the North.Second,it emphasizes geo-economic integration that will heal the fragmentation of Eurasia.Third,it advocates linkages between people and inclusiveness to create a new kind of civilization.However,many difficulties and challenges lie ahead for the implementation of the "Belt and Road" initiative.     

“一带一路”视角下的工会问题研究

"一带一路"倡仪实施以来,如何与当地工会合作是中资企业在"一带一路"沿线国家投资和经营管理中,在劳动关系方面必须面临的重要问题之一。"一带一路"沿线国家工会特点明显,差异很大。中东欧国家工会组织率高,集体谈判覆盖率也高;东南亚国家工会组织率相对较低,但组织力量很强。工会与其他非政府组织的各自力量、相互关系也不尽相同,中东欧地区工会组织强大,雇主联合会也强大;西亚北非地区工会组织力量弱,但有其他非政府组织代行部分工会职能。因此,应该从遵守工会相关法律制度,提升对构建和谐劳动关系重要性的认识,找到与东道国工会恰当的合作模式,避免简单移植等方面出发,提高中资企业与当地工会合作的能力。
